No, it wasn't. It gives some pretty poor examples of how you should be acting if you have to use a firearm in self-defense. Since C1ogden pretty much nailed it in his post above, I'll just copy & paste it again, in case you missed it. Heck, I'll actually break it down for ya.
Fake or not there are lessons here. The guy with the gun escalated or provoked a reaction by giving the bird.
Yup. Escalation is bad. As a CCW holder, you should be doing everything you possibly can to
aviod confrontation. Flipping off an obviously aggressive driver isn't the best way to avoid confrontation.
Was he in reasonable fear of death or serious bodily harm when he drew his gun? Absolutely! But prosecutors will argue that the thugs wouldn't have followed him if he hadn't provoked them.
Exactly. Even without a gun, you're responsible for your actions - having a gun makes you the one who's gotta be the peacemaker - because if things go bad, you've got an impressive amount of force at your disposal. That comes with huge responsibility.
Also, what was legitimate self defense was turned into an armed robbery when he took thier camera.
+1. I can understand wanting to make sure that there was still a chain of evidence, but at that point, he's a guy with a gun demanding the others individuals hand over their property. Doesn't look good.
Knowing it was all on tape I would have told them that I was taking the camera as evidence and that I would turn it over to the local cops.
Yep. Even then it's risky, but at least you've covered your butt to some degree.
He also should have called 911 long before he went down that dead end road. How will the cops react when the punks call first, state that they have been robbed, and give thier location? What will the cops do when they see the car, find the stolen camera, and find the gun? If the video captured the driver telling the punks that he was taking the camera as evidence it could be used to press a false report charge if the punks had called the cops and said they were robbed.
Big, huge, MASSIVE +1. He who calls the cops first, wins. You get your side of the story out there first, and they're the one's who have to play catch-up. They're criminals, which means that they're not going to have a problem lying and spinning things to make you look like the bad guy.
Bingo!
