Gift long gun across state lines

I am a Georgia resident. I brought a rifle with me to Indiana to gift. Both of us went to the local FFL and were told we did not need to do any paperwork, transfer, or 4473 because it was a long gun. I said I wanted to anyway and the response was that it would be a real pain in the butt so I left with my rifle.

Correct info or no?

That has to be the stupidest FFL in America.
1. He should know that ALL transfers from a resident of another state must be transferred through a licensee in the buyer/transferees state of residence.
2. Being a "long gun" doesn't have anything to do with anything.
3. The above is covered in ATF regs, Federal law and by the IOI when this idiot dealer had his initial interview.

To whom may an unlicensed person transfer firearms under the GCA?
A person may transfer a firearm to an unlicensed resident of his or her State, provided the transferor does not know or have reasonable cause to believe the transferee is prohibited from receiving or possessing firearms under Federal law. There may be State laws that regulate intrastate firearm transactions. A person considering transferring a firearm should contact his or her State Attorney General’s Office to inquire about the laws and possible State or local restrictions.

Generally, for a person to lawfully transfer a firearm to an unlicensed person who resides out of State, the firearm must be shipped to a Federal firearms licensee (FFL) within the transferee’s State of residence. The transferee may then receive the firearm from the FFL upon completion of an ATF Form 4473 and a NICS background check.

A person may loan or rent a firearm to a resident of any State for temporary use for lawful sporting purposes, if he or she or she does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law. Another exception is provided for transfers of firearms to nonresidents to carry out a lawful bequest or acquisition by intestate succession. This exception would authorize the transfer of a firearm to a nonresident who inherits a firearm under the will of a decedent.

A person may transfer a firearm to a licensee in any State. However, a firearm other than a curio or relic may not be transferred interstate to a licensed collector.

Yeah that's what I knew but. So I then called around like 6 locals ffls including a bass pro and a cabela's and not one would do a private transfsr for me this weekend. One siad they could but the only person who does it won't be in again till monday and I'm gone by then. The other 5 just don't even do it.

I found those atf faq's after posting this.

I don't mind name and shame this was Blythes in Valparaiso Indiana (Tim at MAC's stomping grounds)

I even told him I believed we had to and he said no we just went and looked the law up.

They'll be hearing more of this.

Edit: FYI I know he knew I was out of state I made that clear and he even checked with somebody else that I was allowed to handle a pistol to check it out because I was out of state (I even showed him my GA carry license once I was established out of state). There was no confusion that it was inter state

One of the things I tell my CHL students is that very often the worst people from which to get legal info are cops, CHL instructors and gun dealers. Always verify what they say with the source, and if they can't show you the source, they're probably full of ****.
 
Yeah I am unfortunately aware of how bad they are for advice. I wasn't after advice I was after a service and was effectively denied while being given incorrect and unsolicited advice. Terrible
 
One of the things I tell my CHL students is that very often the worst people from which to get legal info are cops, CHL instructors and gun dealers.
I was present once when an LEO offered to perform a straw purchase for a family member. I've definitely gotten some bad legal info from folks behind the counter at gun stores, but CHL instructors seem to be a bit better--at least in terms of the laws that they actually have to teach in the courses.
