Let's say I live in Texas and I sell or buy a gun from someone else who is also a Texas resident, but it's not face-to-face. Can we ship/receive the gun without using an FFL, since it's an in-state private transfer?

Anyone know for sure what the legality of this is? I'm having the darndest time finding a clear answer...

It's legal as far as Federal law, although you might have a hard time finding a shipper will ship a firearm between 2 nonlicensees. I have no idea what Texas law says.

Texas law is mute on the subject. For the exact wording of the BATF regs, see item B7, B8, and B9 here:

The BATF regs web page

Summarized - as long as you and the other party are legally able to own a gun of the type involved in the transaction, you may legally ship it within your state of residence without using an FFL. Common or contract carrier can be used for both handguns and long guns. You may also ship long guns via USPS registered service. Handguns are NOT mailable via USPS.

It's not a bad idea to print out the above web page, highlight the items noted, and keep a copy with you when you go to ship the gun. You might also make an extra copy to give the shipper for their files. It's settled several arguments for me.

Ok, thanks for settling that for me.

I guess whether or not you can actually get UPS or FedEx to ship the gun is another question altogether...
