Certain laws have "intent" as a requirement, IE: certain level of Murder (1st degree premeditation vs Manslaughter). Theft, etc. Those are "criminal" codes/laws. Civil is seperate.
 
Would have been real interesting if one of the home's occupants had a pacemaker, but then again it wouldn't have nearly been the first time someone was kileld by police raiding the wrong address.

So the police broke into the house with the intent of shooting anything that moves and get the wrong house, so it wouldn't be a criminal act?

Like others have asked, what would happen if the homeowners start shooting back when someone busts down their front door, at the police have the wrong house? Are the police going to back off and yell through a bullhorn that they are sorry and that they had the wrong house, or are they going to continue moving with guns blazing until they are satisfies that the occupants have been neutralized?
