Police officer given Swiss Army knife as retirement gift from colleagues, who then arrest and charge him for "possessing a knife in public without good reason" when it's found in his luggage when he takes a vacation...

Swiss Army knife leads ex-police chief to fall foul of his old force

As a keen hiker, Brian Seaton was delighted to receive a Swiss Army Knife as a retirement gift from his colleagues in the force.

But the former chief inspector ended up back in the arms of the law after he tried to take it on a walking holiday in Spain.

His one-time comrades in the Leicestershire force questioned him and he was taken to court charged with possessing a knife in public without good reason.

Mr Seaton, 63, was dragged through the courts in a case that lasted nine months at a cost to the taxpayer of up to £10,000.

Mr Seaton, a policeman for more than 20 years until his retirement in 1996, said yesterday: 'I can't believe this ever went so far. It's a farce.'

His ordeal began as he boarded a flight to Majorca at East Midlands airport last June.

Security staff, who were on heightened alert for potential trouble-makers heading to the World Cup, found the three-inch knife in Mr Seaton's hand luggage, Leicester Magistrates' Court heard.

It was inside his washbag, which he had transferred to his carry-on bag after check-in staff told him his suitcase was too heavy.

He had forgotten the knife was there but it was spotted in an X-ray scan during a security check.

Mr Seaton immediately handed it over and assumed the matter was closed. But when he tried to reclaim it at Loughborough police station on his return from Spain, he found that his troubles were just beginning.

He was told officers wanted to interview him, and he agreed to be questioned but refused a formal caution.

A file was passed on to the Crown Prosecution Service, which decided there was enough evidence to prosecute Mr Seaton. The father of two said: 'When I found out what was happening I couldn't believe it.'

He was finally cleared on Wednesday after District Judge David Meredith heard he needed the knife to open tins and cut food while hiking in the mountains.

The judge said: 'It was a good reason. That good reason is not invalidated because you suddenly enter a certain part of the airport.'

Mr Seaton of Markfield, Leicester, said: 'There have been a number of court hearings, a pretrial review, an audience with the district judge and then the trial.

'It has been hanging around for nine months, and I'm not sure that it has been a good use of public money.

'Now I'm just glad it's over.' Mr Seaton's solicitor, David Leigh, last night estimated the cost of bringing the case to trial to be between £5,000 and £10,000.

He added 'All along it has been difficult to see the case to answer here, but the CPS has continued with this.'

Mr Seaton's MP, David Tredinnick, said the case was an example of the 'law being an ass'.

The Tory MP for Bosworth added: 'It seems strange that a retired chief inspector would be prosecuted when he clearly intended to go walking and had a valid explanation for carrying the knife.

'A reasonable person would have assumed he had made a reasonable mistake and it is regrettable that this case went as far as it did.'

The knife was returned to Mr Seaton immediately after the case.

Leicestershire Police said: 'Officers conducted a thorough investigation into the alleged offence and the evidence gathered was then put before the Crown Prosecution Service.'

Leicestershire CPS said the case was brought in line with the Code for Crown Prosecutors, and that it believed there were grounds to prosecute with a realistic prospect of conviction. (Emphasis mine - T)

Glasgow had a random patdown for knives

when I was visiting there in '96. I was backpacking and carried a folding knife and was very aware of Bobbies whenever I was out in public.
Now you must have proof of need(part of your trade or occupation) to carry one in public. A butcher gets a pass if there is one on the front seat of his car or in a brown paper bag on his lunch break. Just having one without JUSTIFICATION gets you thrown in jail.

Soon, all that will be left of England is however much got transplanted to America. It's pointless to worry about England; we've got ourselves to worry about. Everything that's happened over there and everything that will happen over there could very well happen here.
 
I don't feel bad for him at all. In fact he probably gets exactly what he deserves. He is from the same pool of people that banned guns, kitchen knives, soon to be Samurai swords, glass cups in bars, and a whole plethora of other items. AND apparently he was trying to get his knife through the airport xrays. What would happen here. We'd all be labeled terrorists and be in prison.

I also throughly agree it is all very ridiculous. Why would you need a good reason to have a knife in public. Hell why do you need a "good" reason to do anything. I have a good reason BECAUSE I WANT TO!:neener:

I believe the worst of it is that we squandered hundreds of thousands of American lives not once, but twice to save England from uncivilized barbarians.

I believe the English would have been happier as German lickspittles.

When are they going to outlaw possession of things like... cobblestones, bricks, tree limbs, and hob-nailed shoes?

And my parents wonder why I would NEVER want to move to the UK to work at the UK office...

I lucked out when I went to England a few years ago. I did not know that they x rayed your bags and passed people through metal detectors when you hop on the train to go to France. They found my Buck knife on my person and a Shrade fixed blade on my buddy. They scooted us aside and told us that it was an automatic trip to jail for carrying around these dangerous instruments of death. After a stern lecture from head security agent, and a trip to a cordoned off area, he told us to stick the knives in the bottom of our bags and lay low until we were out of the country. So there is at least one rational person in charge over there.

I see this incident as being indicative of perhaps a growing problem of western society in general. That is, what I perceive to be, an increase in the tendency for people to exercise their pettiness. I get the impression that folks in general are more prone to disregard common sense and usurp whatever little authority they may have in order to enforce inane rules or laws. We see this attitude reflected in the so-called 'zero tolerance' policies enacted by so many of our institutions. Our society now encourages pathetically small minded people to implement their innate pettiness rather than to employ simple rationale or reasoning. All this done in order to sustain the illusion of public security ...
 
I'm sorry Fn-P9, but you missed the key part of the story.

Seaton handed the knifww over to aiport security. When he tried to reclaim it the police station when he came back he was arrsted. He is not being charged with taking it on a flight, he turned the knife over bewfore boarding.

He was taken to court charged with possessing a knife in public without good reason.

The is sad on several levels, first, that a 3" swiss army knife is grounds for concern. Secondly, that one needs to show cause to carry it, and third, that the media seems to think its only a travesty because he was a police cheif!
 
That's a good point. I actually support enforcement of the law against this fellow. The travesty is the law itself. We should be singing the praises of the prosecutor who had the nerve to apply that law equally. In the US our DA's and US Atty's are often the core of the problem, but in the UK the problem was and is PARLIAMENT and the people who keep reelecting the same lemmings.
 
Hey, I'm GLAD he was charged.

I for one am glad he was charged. Let all of Europe free themselves from all sharp edges and pointy objects. Let them placate the Moroccan's, wave white flags, give-in or whatever they need to do to feel "morally superior". The priniple virtues of Europe are cowardice and weakness; these they seek with a fanatic's zeal and they inquisition who don't go along with that pogram.

If Europe ever gets an agressive neighbor, I bet the whole region could fall in three weeks. Anyone know how long it took Hitler to conquer Europe? How quickly the sheep would fall when all they know is how to placate and beg for mercy.
 
Hmm... let Europe completly collapse upon itself, send in the Boy Scouts, raise the Stars and Stripes over the Old Bailey, and call the Revoultionary War over after 300 years.

As a species homo sapiens is slowly dying off. We are being replaced by an
alternative less capable, irrational species that lacks the capacity for rational thought. All this other species can do is emote, whine, cry and beg for protection from the nanny state. This new species is physically indistinguishable from the original but can be identified by the constant whining for new laws. The new species had been named homo stupidicus.

This change is a result of darwinian action. We have removed the filter from the gene pool and now are paying the price.

Why? The best and brightest of Europe have made their way here on their own for 400 years. What's left is the progeny of failure, moral decay and personal cowardice institutionalized into collective hoplessness.

Let those folks stay right where they are, we want no part of that.

What it should have said is "those of you with the courage to build your own destiny with your own hands, minds and will, come and be welcomed to mankind's last great civilization."

They did and still do. We have nothing to learn from Europe except lessons best not repeated.

I pity the minority of good people in European nations who find themselves delegated to herd animal stature whether they so choose or not
