ar-15 in upstate ny?

cmmg has a bargain bin ar-15, i can afford, but it's illegal in upstate new york (assult rifle ban)

it seems like it's not that hard to make the ar new york state legal,
i.e. change stock and remove bayonete lug
do FFL provide that service?

or do i have to find a new york state legal rifle / order in pieces ?

All AR-15s are illegal in New York state.

NY doesn't follow the "two or more" rule like, for example, Jersey does. All you need is one thing that a politician who's never touched a gun thinks is scary looking.

In fact, I'm pretty sure ARs are banned by name.

I don't know if the FFl will do it but you could have it shipped to someone in a state with less strict gun laws and have them make it NY legal and you could pick it up. I saw a "sporting" AR-15 in dicks sporting goods and I know several people that have an AR-15 so they can't all be illegal and according to wikipedia NY does follow the 2 or more rule. It could be inaccurate but I found this to be helpful.

Mini-14?

I don't want to rehash the Mini-14 vs. AR-15 debate, although I note that many AR-15 fans seem to have a good deal of distain for the Ruger. HOWEVER, there are a lot of similarities between the two rifles, and you can get a lot from a Mini-14 that you'd otherwise get from an AR-15, apparently without running afoul of NY's draconian gun laws. Like an AR-15, the Mini-14:

1. Shoots both .223 and 5.56 (except for the Target configuration).

2. Eats most any ammo in .223/5.56 (maybe better than an AR-15).

3. Is a semi-auto rifle, with > 10 round capacity (but I believe you have a 10 round max in NYS).

4. Can serve as a platform to mount all kinds of stuff: scopes, lights, lasers, red dots, ACOGs, yada, yada.

5. Has a lot of other aftermarket add-ons available (just don't cross into "assault weapon" territory).

Other positives:

1. It's not as scary-looking to the anti-gun crowd, especally the Ranch carbine with the wood stock.

2. It's arguably more rugged and can take more abuse than an AR-15 (I'll probably get some abuse for this comment), especially the stainless Ranch rifle (granted, I'm biased).

3. It's less expensive than many (most?) AR-15s.

4. It has a relatively short overall length.

5. It's relatively lightweight.

On the downside:

1. Off the shelf, the Mini-14 lacks the paramilitary look popular with the tacti-cool crowd.

2. There's only one manufacturer of the actual rifle, so you can't mix and match parts.

3. Certain parts are just not available. For example, I understand that if you need a new firing pin, you have to send the entire rifle to Ruger.

4. Any magazine other than a Ruger "factory" magazine may not work well...or at all (though in my limited experience, factory magazines work without a hitch).

5. The Mini-14 probably won't hold up as well to a long period of rapid fire. And, if a part of an a AR-15 craps out from rapid fire (a barrel, for example), you can easily replace the part.

6. Reputedly, Mini-14s - especially the older ones - lack the accuracy of many AR-15s.

P.S. Don't get me wrong. If I didn't live in NJ, I'd probably buy an AR-15, too!

The NYS AWB is a mirror of the old federal ban. You can own any pre-ban weapon if you want the fun features, or you can get the neutered ones alla the old federal ban. So, yes AR-15s are legal in NYS if they are pre-ban or neutered post-ban.

bought a pre ban bushmaster from a guy in texas a couple of years back. great gun! paid 850 + 20. transfer in ct.

sold it through gunbroker to a guy living in texas, planning on moving to ny-1500.

gonna move to south carolina next year--toys aplenty if i choose.

It is not a problem getting an AR-15 in NY. Most any gun store has them and if you watch publications like the want Ad Digest you will see lots of them. Many people paniced and bought them a couple years ago and are now selling them. A NY "AR" has a fixed or pinned stock and no bayonette mount. New mags will be 10 round, but pre-ban mags are legal and readily available online. It would take all of 15 minutes to make a CMMG Ar NY compliant, but you cannot receive it in NY in it's current configuration. Best idea is to look for a used one or, to save money, build one yourself - it is not that hard. Also you can buy/build a lower and then buy any of many uppers as long as the bayonette lug is removed.

Talk to the person selling it and see if they will do the work for you or find one already done, or buy a Lower receiver and build one, its; pretty easy and way cheaper than buying one already done.

what's the best way to go about this? sourcing a complete upper and a complete lower separately, or is there an even cheaper route, that doesn't involve expensive special tools?

You can easily have $150 in tools and some are nessacary to get it done right.
Pin starters and roll pin punches cant be picked up at home depot but you can mess up the job without them.
The universal wrench is a must IMO as well as clamping devises to hold the receivers in a vice without damage.
For just one gun I might just bite the bullet and buy retail.

AR's at ALL gun shows

If you go to ANY gun show in NYS you will see LOTS of AR platform and AK platform rifles.

They are sold by those with FFL's and are totally legal or they would not be allowed either in the show or by the dealers.

They dont want to lose their FFL.

I shoot at a local range and there are tons of AR's there and they are all bought in NYS,as was mentioned the pre - ban are a better deal.

And I do believe its a crime to use a pre ban mag in a post ban gun.

But I have not ever heard of an arrest for such a silly crime.
