California 10 day wait status

Cause she has nothing to fear, that is why. This case involving the city clerk that won't issue same sex marriage certificates is a good one to watch.

As an elected goverment representative and a paid government employee, it is Kamala Harris' job to enforce the law. I don't give a wet toot what she thinks about the law, I only want her to do the job she was elected to do. This same sex marriage arrest of the clerk may put fear in some government hack s' eyes when they dont do their jobs.
 
The arrest over the marriage license perplexes me. The Supreme Court can not make laws, congress passes laws. There is no law regarding same sex marriage, just a ruling from scrotus, hence, the arrest is bogus to begin with.

How can the judge let the AG drag her feet for so long. Wrong is wrong.

You may want to do some independent research on this.

The SCOTUS did not make "a law", they just ruled on the constitutionality of an existing KY law...pursuant to a law suit...which is their proper function

It doesn't work this way. SCOTUS doesn't make law, that's true, but they do get to interpret the law and they have interpreted the marriage laws to apply to both heterosexual and homosexual couples equally. It's done, the fat lady has sung, time to adjust to the new reality. As a public official Kim Davis doesn't get to impose her personal beliefs, religious or otherwise, on the public contrary to the law. The judge ordered her to follow the law, she refused and that's why she's in jail.

This is not the same thing. While I don't doubt that the AG would drag her feet if she could, it's not her call at the moment.

The case, Silvester v. Harris, was appealed to the 9th Circuit. The injunction that would have removed the 10 day waiting period was stayed by the 9th Circuit pending appeal. So the ball is in their court for now and will remain there until they decide to hear the case.

And, due to the amount of cases that are on their docket, the Ninth Circuit Court of Appeals is very slow compared to the other Circuit Courts.

May not see a ruling from them for another 2-3 years.
