Great news for Canada. In a battle that lasted nearly 1/2 a decade the Canadian Supreme Court ruled that the federal government can destroy the gun registry data rather than hand it over to Quebec. It was a 5-4 split and all of the Quebec justices voted to retain the registry which is not good.

Published Friday, March 27, 2015 4:27AM EDT OTTAWA -- A divided Supreme Court of Canada says the federal government has the right to order the destruction of Quebec's federal gun registry data -- but all three Quebec judges on the court disagreed.

By a 5-4 margin, the Supreme Court upheld an earlier Quebec Court of Appeal ruling that sided with the government on its controversial decision to abolish the federal registry for long guns in 2011.

The ruling is a win for the Conservative government, and it also exposes a legal divide over the powers of the provinces versus those of the federal government on the country's highest court.
 
Truly we have made a "first step"! BUT---we have a long way to go. While some of the odorous Liberal law has been "adjusted", there are residual bits and pieces that remain! As we approach the next Federal election we had better work VERY hard to ensure that the NDP and/or the Liberals do not form the next Federal Government, if we wish to keep what we have and go forward.
 
This sounds like federalist oppression. Quebec is unanimous in their representation and someone in Ontario is telling them how to live instead.

I support gun rights, but I bow to the will of the people. What if the supreme court was against?

A Federal legislature, constitutionally empowered to legislate against the States, votes to restore at least some part of the Right to Keep and Bear Arms. A southern state, run by racists, for and on behalf of 'their' people, is worried about their rebellious suppressed minority being armed. The racists try to circumvent the Federal govt.

Should the will of 'the people', in the form of southern racists prevail?

In this case the minority is the Mohawk nation, not African Americans. The racists are French nationalists, not Bull Connor and cronies.

This is as close to a combined 14th amendment & 2nd amendment case as you will find in Canada. It is about the rights of the individual against the State, not about Federal oppression.
The Will of the People is a nebulous term, whenever it comes out of a politicians mouth it means 'We won 50% of the seats, plus 1, so whatever we want to do has divine right behind it.'
Often they are ignoring that the percentage of the citizens who voted for them was well below 25% of the actual qualified electors.

In the Canadian case, the Federal govt. twice went to the polls with the removal of the firearms registry as part of their platform. It was finally passed as a private members bill, rather than as a party sponsored bill. That's about as close to 'will of the people' as you will get these days.

But the political machinations needed to pass the law are irrelevant. Because the right to survive includes the right to self defense. The right to self defense is nothing without the means. Legislation that affects basic human rights should not be looked at through the lens of politics, but evaluated on whether it helps or harms the individual.
 
My understand is this ruling has nothing to do with whether the registry is legal. The debate is whether the Federal government has to turn over their registry to Quebec since Quebec wants to continue a registry. The Supreme Court has ruled, no, the Feds don't have to turn over the registry or even a partial registry of people that live in Quebec. Instead Quebec will start over and create their own registry.

The end will be the same but this ruling will cause Quebec to have to waste money recreating what is already in existence.

That's a very dangerous position, it's the problem with true democracy. 50% +1 can do anything, no matter how wrong, immoral, oppressive, restrictive, or destructive it may be..... After all it would be the will of the people.

Congratulations to Canada, hopefully it is the first steep of many in the right direction.
 
Quebec is a long way from unanimous in their representation.
They cannot create their own registry. Firearms legislation is cover by our Criminal Code. The Provinces cannot amend that. It's Federal jurisdiction only. There are no Provincial firearms laws.
The minority is not the Mohawk nation. The Mohawk nation has nothing to do with any of it. It's firearm owning Quebecers. Quebec's governments(Traitors and Liberals) think they can ignore our Constitution and legal system.
 
I thought Quebec said that they were going to set up their own gun registry as planned, anyway after this ruling.



Can't they do that?
