CCW/Non CCW, Firearms on University and Univ affiliated Housing - Fla

Okay, here's a debate I have been having with one of the local Police Officers. I know that under Florida law, under concealed carry, you cant CCW on a University Campus. Although we are in agreement on that, we are not in agreement on two other things.

1) Can you legally carry, in your glove box, a firearm on a university campus. Not concealed, not under your seat, in your glove box when a student goes to class on campus...

2) In University Affiliated housing, the property is under the control of the university (ie patrolled by university police), but the property is not owned by the university, rather a private housing company. Under their lease, they say that you cant store firearms in your apartment. Can you CCW or even bring a firearm on the affiliated housing's property, legally, as a guest?


Any statutes that relate would be helpful.

My understanding (I am not a lawyer) is that you can have a gun locked in your glovebox while parked at a school or university. As long as the gun stays inside the car, I am pretty sure you are ok. I do know that silly 1000 foot Federal rule does not come into play if you have a Florida CWL, because the CWL authorizes you to carry anywhere that is not on the prohibited list. It is legal to carry your gun on the public sidewalk in front of a school, as long as you are not actually on school property.

If you have a gun in your student housing that is not owned by the university, you are probably violating the terms of your lease, but probably not breaking the law.

Remember, I am not a lawyer and this is a gray area.

i cant quote fl statute but it is somthing like ..... if the firearm is secured in a personal vehicle in a parking lot (any lot public or private, employee or guest) out of view(my understanding is concealed) with who ever is in control of veichle having a ccw it is legal. i had my former employer HR rep read me the statute (i was working for local government at the time) they were pi*sed i was able to have it in my truck... might be why i am looking for a job now....

1. Private individual selling to another private individual who posseses a Pistol Permit

2. FFL holder selling to private individual who posseses a Pistol Permit

State statute forbids the carrying of arms, even by licensed individuals, on campus. As far as off-campus but affiliated housing, I'm honestly not sure - it's a good question I've often wondered about myself. But, if it is not offically campus property, then you should be ok. At that point, any clauses in the lease about legal firearms aren't something you can be arrested on, only evicted on.

The securely stored in your car thing is something that still confuses me a bit as well. The law is also somewhat vague, although basically the closest thing I could ever find was that the only way they could say you can't have one locked in your glovebox, for example, is to make it a condition of parking. For example, if you have a parking permit to park on campus, then you have to follow their conditions. Otherwise, not really? At that point, I'm not even sure if they'd just take away your permit or if you'd be arrested or something.

FTF sales are fine, no paperwork required within the state of Florida, provided the weapon is legal, and that you have a reasonable belief that neither of you are felons or under any condition which restricts firearm ownership.

If you're really concerned, you can always put the condition that you'll only sell to people who hold a valid CWP, but that's just a private condition that you would set.

Most people who do FTF usually keep at least the name, address, and DL number of the person they sold it to, but just in a private fashion. That information isn't submitted to a government database or anything.
