Doing your own "background" check on prospective buyers

Do it and include the guy making FTF buyers go through a 5 day cooling off period and a homemade 4473.

In addition I also requite fingerprints and a DNA sample. :D
 
Wow. Typically, the only question I ask of someone is "do you have enough cash to meet my asking price."

If someone started asking me about my background, for driver's license, HCP, etc. I would back out of the deal. That's just creepy and intrusive.
 
Willypete, for the win. If the guy passe's the smell test I'll sell him the firearm. No questions asked. If he fails the smell test, No sale regardless of any ID. He may have.

The only time I ever bought a firearm from a private party was a guy I met online who happened to have an old 40 Smith for sale. We met and I gave him the cash and he gave me the firearm, no questions asked, no bill of sale. He did tell me a bit of the history of the gun and threw in a good holster for free though. Nice guy, I'd buy again from him.

I didn't have a CCW back then but I do now. If that had been his requirement I might still be looking for decently priced personal protection

This same arguement is happening in legal right now here is my response to that thread

think this is one of those topics that people just split into two camps on and neither side is going to convince the other to change.

I get a bill of sale or a reciept or whatever yu want to call it to (hopefully) protect me from any litigation and that’s the only reason I get one. I don’t want you to take the gun I sold you, abuse it, have it malfunction or blow up on you and have you come back and try to sue me over it.

I don’t think showing a cop a bill of sale that I could have printed out yesterday is going to do me any good if the police show up asking about a gun I sold. I suppose it might help me if the police had reason to check the serial number of a gun I bought and it came up hot but even then I’m not sure. In either case I’m not participating in any police investigation of any crime with out competent legal counsel.

Also, I doubt very seriously that a charge of “Perjury” because of what I put on a home made bill of sale would hold up in any court in the country.

IMO if you are that paranoid (Yup, I went there) over selling a gun to a stranger then you should either sell it on consignment at your LGS or have an FFL do an official transfer for you.
 
I ask if they're legally permitted to purchase a gun, and ask to see a DL to verify they live in-state. They can put their thumb over the name and address, I just want the pic to match. As long as they don't creep me out or look like gangstas and have the cash, they get the gun. I've only sold guns at gun shows, not in some parking lot somewhere.
 
I've never sold a gun and never intend to.
I like buying guns and if I bought it I must have liked it.
If it doesn't work properly it will get fixed.

I didn't give any personal info other than my name, which is enough to search public records.
 
It's you firearm. I think if you only want to sell to one eyed, deaf, red headed women it is your choice.

I'm pretty leery of anyone who wants all that information. I have never had anyone demand that information from me in a private party transaction. Most of the time, I don't even know the other party's name (and vice versa). I've yet to see a law that requires to you play Inspector Clouseau.

Like I said, I did my due diligence and made sure he had no record. But I was not going to sell it to someone who was a gang member or a wannabe gang member. It also made me wonder if his idea was fake and that's why no record's came back. Gun is still sitting in my safe nearly a year later. I don't care.


It was my firearm and I choose who I want to sell it to or not. Same with ANY private seller. I don't want to have to carry on my conscience for the rest of my life that some woman was gang raped or innocent child was shot in the crossfire of a gang shootout with my rifle.

That's quite a load of assumptions you made there. How did you get a background check back so quickly in an alleyway? Is there some app for your smartphone that does this? :scrutiny:

Part in bold: that sounds a lot like something from VPC or the Brady Bunch. Of course, it wouldn't be your rifle once you sold it, nor would you be responsible for the actions of someone else.
 
I don't get it. Why do people want to go through these unnecessary procedures. You guys are going to help the liberals disarm us.
 
For out of state sales, of course it all goes through my FFL. If I weren't selling to in in-state friend, I wouldn't want the hassle of keeping track of it all. The anti's would love me, because I would use my FFL, even for in-state transfers to people I don't know. (I haven't actually DONE any of those though) That's what FFL's are there for, in my opinion. It removes the hassle and personal responsibility from me for keeping track of the sale/transfer. My guy charges $25, which I pass on to the buyer.

My state requires that the seller be held accountable for the buyer to be an Ohio resident, 21 or older, and be eligible for purchase. I figure that looking at the CHL kills those birds with one stone as a reasonable attempt. I think we will start seeing more undercover "stings" through Armslist as the left needs fuel for their dying little flame. I think most judges would see that you performed due diligence by requesting the CCW permit. Again, just me.... I'm certainly not advocating that any laws or rules be changed.

Me: Gotta CCW and FL DL?
buyer: Yes, see here they are.
Me: Okay.
Money and pistol change hands thanks for buying. Back ground check that is good enough for me.

Me: I want to buy your pistol.
Seller: Gotta CCW and DL?
Me: I will tell you I am a resident of the state and am not a prohibited person. That's all you're getting. Either sell to me or don't.

As long as I don't have reason to believe they're a prohibited person, yes. And it is perfectly within the limits of the law.
 
I make a copy of their DL.

This way should the weapon be discovered at the scene of a crime I can tell the cops "This is the guy I sold the weapon to".
 
Those of you who keep records.
Are you buying and selling due to good deals you find that you can't pass up?
Are you buying the guns with the intention of keeping them and either get tired of them or find something else you would rather have?

I've only been at this 2-1/2 years but I couldn't even think of selling any of mine.

Mostly this^^^.

No matter how nice a gun feels in the store, I really never know if I'm going to keep it until I've had it for a while.
And my tastes changes after a while...I'm on a revolver kick right now.

Nice story. Why did you meet this guy in an alley, anyway? I think you should stick to telling stories about buying guns from gun stores . . .
