This bill is on the General Calendar for 3-12-04 (Friday)/legislative day 31. It must get a pass vote in the Rules Committee to be put on the Rules Calendar. It must be on the Rules Calendar to be brought to the House floor for a vote.

All this must be done by the 33rd legislative day and passed to the Senate or the Senate won’t consider it.

A BILL TO BE ENTITLED
AN ACT
To amend Part 3 of Article 4 of Chapter 11 of Title 16 of the Official Code of Georgia Annotated, relating to carrying and possession of firearms, so as to change certain provisions relating to carrying deadly weapons to or at public gatherings; to change certain provisions relating to exemptions from crimes regarding carrying weapons without a license; to amend Code Section 38-3-51 of the Official Code of Georgia Annotated, relating to the emergency powers of the Governor, so as to repeal the Governor´s power to suspend or limit the sale, dispensing, or transportation of firearms in emergencies; to provide for related matters; to provide effective dates; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
Part 3 of Article 4 of Chapter 11 of Title 16 of the Official Code of Georgia Annotated, relating to carrying and possession of firearms, is amended by striking subsection (a) of Code Section 16-11-127, relating to carrying deadly weapons at public gatherings, in its entirety and inserting in lieu thereof the following:
"(a) Except as provided in Code Section 16-11-127.1, a person is guilty of a misdemeanor when he or she carries to or while at a public gathering any explosive compound, firearm, or knife designed for the purpose of offense and defense[underline]; provided, however, that the provisions of this subsection shall not apply to a person who carries a firearm or knife to or while at an eating establishment that derives at least 50 percent of its total annual gross food and beverage sales from the sale of prepared meals or food if such person is licensed to carry a pistol or revolver pursuant to the provisions of Code Section 16-11-129[underline]."

SECTION 2.
Said part is further amended in Code Section 16-11-130, relating to exemptions from crimes regarding carrying weapons without a license, by striking paragraphs (14) and (15) in subsection (a) and inserting in lieu thereof the following:
"(14) County medical examiners and coroners and their sworn officers employed by county government; [strikeout]and [strikeout]
(15) Clerks of the superior courts.[underline]; and[underline]
[underline](16) The clerk of the Supreme Court and the clerk of the Court of Appeals.[underline]"

SECTION 3.
Code Section 38-3-51 of the Official Code of Georgia Annotated, relating to the emergency powers of the Governor, is amended by striking paragraph (8) of subsection (d) and inserting in lieu thereof the following:
"(8) Suspend or limit the sale, dispensing, or transportation of alcoholic beverages, [strikeout]firearms,[strikeout] explosives, and combustibles; [strikeout]provided, however, that any limitation on firearms under this Code section shall not include an individual firearm owned by a private citizen which was legal and owned by that citizen prior to the declaration of state of emergency or disaster or thereafter acquired in compliance with all applicable laws of this state and the United States;[strikeout] and".

SECTION 4.
(a) Section 3, this section, and Section 5 of this Act shall become effective upon approval of this Act by the Governor or upon its becoming law without such approval.
(b) Sections 1 and 2 of this Act shall become effective on July 1, 2004.

SECTION 5.
All laws and parts of laws in conflict with this Act are repealed.
