Gun Accidentally Fires, Hits Chili's Customer


MELBOURNE, Fla. -- A gun belonging to a customer inside a Chili's restaurant in Melbourne accidentally discharged, hitting a nearby person eating dinner, according to police.

Police said officers were called to the restaurant at 955 Wickham Road just after 11:30 p.m. Friday.

When officers arrived, they found the victim had suffered a gunshot wound to the lower leg in a dining area of the restaurant.

After an investigation, police determined the shooting an accident, and the person holding the firearm, Richard Philipoff, was a friend of the victim, Local 6 News partner Florida Today reported.

Police said Philipoff initially left the restaurant reportedly in fear of being arrested. Officers were able to contact him and he returned.

While the shooting appears accidental, police said criminal charges are being reviewed with the State Attorney's Office. Possible charges include possession, improper display/handling and culpable negligence.

The victim of the shooting was not identified, but was reportedly stable and alert and was transported from the scene for evaluation, police said.

The wife and I ate at a Chilis about a week ago, on vacation. It was late, and it was the only thing that was open and close when we arrived at the hotel.

Let me say that I did not feel comfortable leaving my gun in the car with the kind of crowd that was in there. Concealed means concealed, and all that.

But c'mon, if you're gonna break the law and carry in a place that's a no-no, don't fiddle with your roscoe, or it might go off into your buddy's leg, and then you get into even more serious doo-doo.

As well they should. My state has been prosecuting stupid gun mis-handling, and I approve. People HAVE to be responsible for themselves.
 
It's not illegal to carry in Chili's.

I wish Ohio were the same way. No CC inside an establishment that serves alchaolic beverages by the glass (i.e. sells booze).

Not in a booth, not at a table way in the back, not anywhere inside the resturant.

Hopefully someday, that portion of the CCW laws are adressed. And when they are changed, I promise to never handle my firearm directly after eating hot wings, onion rings or chili-cheese fries. :eek:

I wish that "stupid" could be a determining factor in the CCW licensing process....

Not that I can determine if this guy was a CCW holder. Idiots like this don't help us "gun nuts".
 
In Florida, I dont think ccw is off limit in Chili's. Except for maybe the bar area.

I could be wrong, I'm not a lawyer, but the way I read 790, it is illegal to carry a weapon into and establishment that serves alcohol for consumption on premises. Since Chilli's serves beer at the table I would err to the side of caution and leave it in the car.

As for the article, my friend sent me the link and we both got a good laugh out of it.

Stupidity is its own reward. I'll bet the folks who give out the Darwin award will be watching this Einstein in the future.:scrutiny:

That's one thing I like about Pennsylvania. We're allowed to carry in bars. Unfortunately I'm going to South Carolina where they have the stupid no carry "alcohol zones."

Well, I don't drink in public most of the time. I stay away from bars in general because of all the cigarette smoke. My friends and usually go to a coffee house to hang out, so the prohibition against carrying in bars doesn't affect me much.

I guess I shouldn't say that though, because if there are an antis reading this they will lobby to make it illegal to carry a weapon in an establishment that serves caffeine for consumption on premises. Have to protect people from all of those wired gun totin' nuts, don't you know.

Yes you did read it wrong. It says that you can't take it into an establishment that makes the majority of their money from alcohol, ie, a bar. Restaurants are fine as long as you don't sit at the bar, even if they can bring alcohol to your table.

How did the gun "accidentally discharge?" The trigger was pulled. The headline should read "Moron shoots friend in leg in restaurant."

Really nice friend. No, OMG are you OK, let me help, You're going to be OK, It's just a flesh wound. Instead, "Crap, I'm outta' here!"

One more incident for the gun control freaks to point to thanks to a moron. I think two things need to happen - Mr Philipoff need's to have his CCW permit taken away permanently - temporarily pending a safety course because he negligently discharged the firearm, made permanent by the fact that he fled the scene of his negligence.

Second, we need to remind the gun control freaks that thousands more are killed in auto "accidents" every year than firearms "accidents". So is the answer to ban all automobiles?

I wouldn't worry too much guys, if one of the charges is "possession" that implies he was not a CC license holder.

I'd suggest reading Gutmacher's book on this topic. He specifically says that as long as your not in the 'bar area' of a restaurant you're okay.

I'm with the 'hold the dummy responsible for his mistake' crowd.

I would err on the side of caution and keep it on my person in deep concealment. I am convinced that the safest place for a handgun is in the owners possession at ALL times. It can't be stolen, and it can't get into the wrong hands. Of course you must leave it alone while eating your hot wings unless someone is assaulting you or shooting up the joint.

The gun shot probably did not go unnoticed by other patrons. Such an event can influence people for life and they will never support RKBA. For the sake of RKBA, the shooter should be prosecuted. Maybe they can add a charge of "leaving the scene".

The press does this all the time -- writes about what an object did, rather than what someone did with an object. I always wondered why they do this. Maybe it's because objects can't sue for libel, but people can. If you say the man did it, even accidentally, he might be able to sue for his damaged reputation. It's legally safer to say, "gun accidentally fires," or, "SUV runs over two children."
