Is it legal for a non-resident to have an unloaded handgun/rifle securely locked in a case in their locked car on a college campus?

It is my understanding that someone who possesses a permit recognized by OH is able to have a handgun in their car as long as it is locked in their vehicle.

http://www.handgunlaw.us/states/ohio.pdf

However, does this apply to someone who does not have a permit recognized by OH? I have an Indiana LTCH and carry when able, but have had to be disarmed while at college. I am not old enough to get a permit that OH recognizes yet, and was wondering if I would be breaking a law if I were to keep my handgun in my car.

See page 5. You cannot carry a loaded gun in a car without a valid permit. Ohio is not one of those states that allow carry in a car without a valid permit.

Ohio's law only prohibits carrying a concealed handgun on a college campus. Here is the relevant law:

A valid license does not authorize the licensee to carry a concealed handgun into any of the following places:

(5) Any premises owned or leased by any public or private college, university, or other institution of higher education, unless the handgun is in a locked motor vehicle or the licensee is in the immediate process of placing the handgun in a locked motor vehicle;

Notice it only mentions handguns, not long guns and only "concealed" handguns. Technically, open carry is legal but I sure wouldn't want the attention it would draw from the police.

As long as your guns were unloaded and stored in your car per Ohio's vehicle transport law, you would be legal.

I am not a lawyer and this is not legal advice.

benminer, I recognize that I could not have a loaded gun locked in my car without a permit, however the question was about an UNloaded gun. I do appreciate the response though.

Thank you for the codes rtroha, that does clear things up a bit.
While open carry is still technically legal on campus, I would not want to be the guinea pig that inadvertently caused it to become illegal...

soccer:

Looks (IANAL) like "FOPA" (empty, locked in the trunk, ammunition in a separate container) would be fine. Without a reciprocal license, you can't carry the thing concealed under any circumstances (well, maybe in your own home), but you can transport the gun, and are NOT restricted to "no stops".... ("No stops" allows you to cross states like New York. You can stop for fuel, bathroom, or meals, but "overnight" may be a problem.)

If you're licensed, the gun need not be unloaded, btw, whether you stow it when you drive onto the campus, or before that. Without a license, it must be secured, unloaded, etc.

(OH has an unusual "loaded" law. Even though you can Open Carry without a license, you can't transport a loaded handgun without a license. A loaded magazine or speedloader that's useful with a weapon in the vehicle makes the gun loaded, even if we're talking "bus" with the gun in the back seat and the magazine in the driver's glovebox.... This was just changed from "no ammunition in the vehicle at all.")

However, somebody needs to chime in here - if you're under 21, you may have other problems having a handgun outside of "adult" supervision.

(I got carded a few years ago while trying to buy an adult video game. The countergal apologized, but "I have to".... She wasn't old enough to buy it. I'm older than her parents....)

Regards,

A Indiana resident with a concealed carry permit can't carry in Ohio, since your state has no training requirement, no matter what age you are.

stickhauler:

I think you have to be 21, but an FL license might be an option at that point....

I quit worrying about being 21 about 42 years ago, but still get a little green when my daughter orders something with alcohol in it at a restaurant. Then I remember that she's 23.... :D The good news is that I haven't had to change a diaper in about 21 years. The bad news is that I still remember how :( ....

For Some Reason...

I was thinking that the minimum age you could legally have possession of any handgun was 21 also, at least without adult supervision. Florida law prohibits issuing a CCW license to a person under age 21 as well.

You can legally possess a handgun at 18 in many states, and in Indiana you can get an LTCH (License to Carry Handgun) at 18. You have to buy in a private transfer under 18, as you can't buy from an FFL until 21.
