I have a question for anyone familiar with the current North Carolina handgun laws. I understand the concept of the current system regarding a pistol purchase permit and the concealed carry permit, but what is the law regarding handguns purchased prior to becoming a resident of NC? My brother moved to NC a few years ago and he brought with him a revolver that he purchased through a private sale back in the 70’s, when he was serving in the Navy. This is the only firearm he has ever purchased, and will not be making any future firearm purchases, so he has no desire to apply for a concealed carry permit. Is he in violation of NC law for possessing a handgun without a valid permit?

Your brother's possession of a handgun that he acquired when he was a resident of another state does not trigger any state laws in North Carolina.

North Carolina law requires a Pistol Purchase Permit or a Concealed Handgun Permit for the purchase/sale, transfer/receipt, etc. of a handgun within the state; both FFL and private transactions are subject to that requirement.

Note that I said "does not trigger any state laws in North Carolina."

I was busy when I wrote the earlier response and did not have time to look up a twist in NC law.

If you brother lives in Durham County, the county has an ordinance, which is grandfathered under state law, that requires the registration of handguns. A bill is pending in the legislature to repeal that ordinance.

Thanks for the clarification. He does not live in Durham County, so that will be one less thing to worry about.
