I was repeatedly cautioned in numerous fora (including here) that the pistol brace amnesty registration might be an ATF trap to get people to document their possession of an illegal SBR. It was speculated that submitting a Form 1 might result in arrests and imprisonments of otherwise innocent people trying to comply with the new legal interpretation.

I’m just curious if there’s been any evidence of this?

What's the logic of this speculation? There's been no evidence that this is the case.

A friend filed for two braced ARs within one week, he got one approved a few weeks ago. So far ATF has not knocked at his door and I do not believe that ATF, being one of the lowest funded federal agencies, is looking to be sued for entrapment.

There was/ is a clause within the regisration application process, whereas you give UNKNOWN false info. That cannot be persecuted for. I don't remember the details but SCOTUS BAR approved attorney Mark ?? youtube channel stated this. His channel is ''four boxes diner''

Perhaps this is where ?one court case? suit arose, a guy in ?state? filed for a suppresor and was told NO, so he filed suit. They doidn't auto charge him

sorry so sloppy no edit I'm out the door to next stop here but the jist of my info is CORRECT and yes I splelled persecute on purpose LOL

thnx!

No evidence because its the ranting of a conspiracy theorist, an ignoramus or most likely some YouTuber wanting clicks. Possibly such an idiot would be all three.
Rule 2021R-08F became effective on January 31, 2023, the date it was published in the Federal Register. If the firearm with the “stabilizing brace” is a short-barreled rifle, affected person have 120 days from the date of publication to register the firearm tax-free, which is May 31, 2023.
That's not a trap because people aren't being asked to document their illegal possession as ATF gives clear, easy to understand options on how to register tax free that SBR. The rule clearly gives a 90 day window to file that special Form 1 nor take advantage of their other options under this rule.

Again, any idiot saying "pistol brace amnesty registration might be an ATF trap to get people to document their possession of an illegal SBR" hasn't actually read the rule. Likely has never heard of entrapment and doesn't understand how tax free NFA forms work.

I submitted a form 1 for a AR pistol on 01/18/23, and got the stamp-less form 1 approval on 03/09/23.

I already had 8 tax stamps, it was weird getting a from 1 back without the stamp.

The tax exemption for registering braced pistols is no different than the amnesty for unregistered machine guns in 1968 or the amnesty for registering Street Sweepers. No one went to jail in either case due to registering their machine guns or Street Sweepers under the amnesty period.

What? Are you sure? I was repeatedly told that mass arrests and imprisonments by the thousands would occur for the people who filed. People were certain I was a fool for filing, and weren’t shy about telling me so. Are you saying the pistol brace rule wasn’t a clever ploy by the Biden Administration to jail patriots by the thousands?

Are you sure? I was assured that was the case. 😏

If the rule is struck down in courts, what happens with guns that were registered? Can you unregister them so they go back to them being handguns? or do they remain SBRs and have to comply with all the rules of restricted firearms? My understanding is you will have to let ATF know if you cross a state line with it, and you can't just sell it face to face to another person. If you do sell it, does the new owner have to pay to have it registered?

Remove the brace and it becomes a handgun. Or add a 16” upper and it’s a rifle. An SBR is only an SBR when in SBR configuration. Just send ATF a letter telling them to remove it from the registry.

Nothing is ever removed from the NFA Registry, ATF will just make a notation that the firearm is no longer in NFA configuration.
While ATF asks that you let them know, its not required by any law or regulation.
