Have you ever given a firearm to someone as a gift?

Unfortunately yes. I gave my step-son a Remington 870 Express as his 18th birthday and high school graduation gift. He even picked it out. Later I had to retrieve it before he was convicted of credit card fraud. He stole and used some of my cards.

Many .22's over the years,..a few H&R single shot shotguns and a few deer rifles...all bought cheap,..some good,..some bad,..some REALLY good,..but none really bad,...many nieces, nephews,....a few friends....

guns

Gave my grandsons 28 guns in January and my new son in law 4 handguns as he only owned rifles.

I gave my best friend a .40 S&W CZ for his 60th birthday. It had laser engraved hand made grips. He sold it...then he said he didn't need the grips cuz he sold the pistol and sent them back...sigh

IIRC, a purchase of a firearm for other than yourself is a straw purchase if the person receiving it would not qualify for the purchase on their own.

Not exactly. A straw purchase is when one person buys a gun from an FFL on behalf of another person, whether or not that person is legal or not to purchase/possess that firearm.

Example: Let's say my next door neighbor is perfectly legal to own/possess a firearm but he wears a tinfoil hat and does not want his name on a form 4473 because he thinks it is a government conspiracy. He gives me the money for a gun, I go to a dealer, fill out the 4473, pay for the gun with his money, and then give him the gun. That is a straw purchase even though the recipient of the gun is legal to purchase/possess it.

Example: I have a girlfriend. She is a felon. I buy a gun from an FFL, using my own money, as a gift for valentine's day. There is no straw purchase. I bought the gun with my money and gave it to her as a valentine's day gift. I am guilty, however, of providing a gun to a prohibited person, which is a completely separate felony than a straw purchase. Now, if she gave me the money to buy the gun on her behalf, now I have committed to completely separate felonies: 1. a straw purchase, 2. providing a gun to a prohibited person.

NavyLT - Good points. The "Intent" of purchase defines a straw purchase. That is why gifts are not a straw purchase. It might be another crime but not a straw purchase.

Gave my wife a Ruger single six for her birthday so she can keep it in her hiding hole next to the bed. simpler to use then the gun on my side of the bed.

I thought it was a great gift :) my mother- not so much.

Moreso of late, with my son getting a handful of choice items in the past three years as I thin the herd and his interest picks up. Most recently I gave him an Interarms-made PPK/S .380 for concealed carry. Oh, and I just bought my wife a Walther PK380 for Christmas, though she doesn't know it yet.

Every birthday so far, and an NRA Life Membership accompanied that first one...
