A man who allegedly robbed a Waffle House while armed with an AK-47 is fighting for life in hospital after he was shot by a customer of the restaurant he is suspected of stealing from.

The man, believed to be about 25 years old, is a suspect in an aggravated robbery that took place at a Waffle House in DeSoto, Texas, on July 7 about 2:30am.

Officers were called to the fast food restaurant and found the man in the parking lot, according to the DeSoto Police Department.

Officers interviewed patrons and complainants who advised the suspect entered the building, armed with an AK-47 rifle, and robbed numerous customers as well as the establishment,’ a police statement read.

‘Officers also learned that one of the customers that was robbed was a Handgun License holder and armed with a pistol. The suspect exited the restaurant and proceeded to the parking lot, followed by the customer/handgun holder.

‘The customer then called out to the suspect, who turned to face the customer while point the rifle in [his] direction. The customer/Handgun License holder then shot the suspect several times.’

DeSoto Police’s statement also said the man who shot the alleged robber was waiting for his wife to arrive at the restaurant, and feared the suspect would harm her if she arrived.

He was not arrested.

Police are still trying to identify the suspect – who remains in hospital on life support – and described him as a black man, 25 or 26 years old, 6-1 and heavily tattooed.

Pictures of his tattoos were released in an attempt to figure out who the suspect is.

From the description of the the incident in this story (and I haven't seen anything in the US press about this) it sounds like the armed citizen took no action while the robbery was in progress (it's not smart to draw on a drawn gun) but followed the robber into the parking lot and confronted him from behind, putting the armed robber in the position of drawing on a drawn gun.

I don't know what kind of citizens arrest laws they have in Texas, and the armed citizen told the police that he followed the armed robber out of the restaurant because he feared for his wife's (who was due to meet him there) safety in the parking lot.

I think we should note that the armed citizen was cool throughout the robbery and didn't take any action where he placed others in danger and put himself in a position of advantage before he took any action.
