Legal gaff in GUNS magazine?

The August 2008 issue of GUNS magazine has an article on the Kel-Tel PLR-16, a .223 pistol which takes AR15 mags.

On page 58 they have a photo of an "accessorized" PLR-16 with a caption that reads

Tricked out with a red dot sight, light and forward pistol grip, the Kel-Tec PLR-16 doubles as a home defense pistol.

Uh oh.

While I see the utility here, doesn't the addition of a forward pistol grip turn a handgun into an "AOW" in the eyes of the BATmen?
 
In any state, a forward grip on a pistol makes it an AOW under the NFA and requires either the $200 manufacture tax (if you "make" it yourself) or the $5 transfer tax (if you purchase it from an SOT).
