Legal Question about selling ammo

I listed some 30-06 ammo for sale in a local classifieds paper. I just got a call today, from a guy in another state saying his buddy got one of these papers and lives nearby and he would be interested in this ammo. He asked me to email him pictures of the ammo and said he would either mail me a check and I could ship the ammo to him, or his friend that's local could just meet me and pick it up.

Is there anything wrong with me meeting his friend to sell it to him? I don't want to break any laws here. I know with a gun this would be a huge no no, but with ammo is it fine? Or should I stay away from this deal?
 
There are no laws on private sales of commercial ammunition (at least none in the free states).

The only "no no" is you can't use the US mail to ship it (fedex and UPS or other commercial carrier will do fine).

Since you don't list your state, you're opening this thread up to every WAG folks want to render.
 
Well, I'm from VA and the guy is in MD. He said his friend would be willing to purchase this for him, and his friend is local.
 
Is it legal for me to sell to his friend, knowing that his friend is buying it for him? Or is that illegal?

To repeat myself, there are no laws on private sales of commercial ammunition (at least none in the free states).

Last I looked, Virginia was a "free state".

Without a law covering an act, is the act illegal?
 
It is legal because there is no law prohibiting it.

FEDEX won't ship ammo for private parties without a bunch of HAZMAT hassles with them. UPS ground is the only shipping option.
 
It's not HAZMAT for loaded ammo. It gets labelled ORM-D and goes via ground. NO Hazmat applies... odd, but true.

If it's shipped FedEx, It's ORMD-AIR. The assumption is it will be on an aircraft at some point during transport.

Call the 800# to be sure you get packaging, markings etc all correct. The FAA ( and almost all ) govt agencies are in a revenue generation mode. The fines can bankrupt you.

Actually, no. All you need is an ORM-D Small Arms Ammunition sticker .... or just hand write that on the side of the box.

FEDEX will NOT accept the shipment that way. (Neither will USPS). It doesn't matter what the law is or what the CFR states. FEDEX, by company policy, will not accept a shipment of ammo from a private party without having their HAZMAT certification requirements met. I know it's not HAZMAT. I am not arguing that. I am just telling you that FEDEX doesn't care.

UPS ground is the only option for Joe Schmoe who doesn't want to become a certified HAZMAT shipper.

Here is the problem with FEDEX from their ground services terms of service:

G. FedEx Express will transport ammunition when packed and labeled in compliance
with local, state and federal law, and the Dangerous Goods section of this Service Guide.
Ammunition is an explosive and must be shipped separately as dangerous goods. You
agree not to ship loaded firearms or firearms with ammunition in the same package.

E. FedEx Express does not accept dangerous goods shipments prepared exclusively for
ground shipment.

Because of E. above, you CANNOT simply slap ORM-D on the box and send it.

FedEx shows a great amount of disdain for Joe Citizen when it comes to shipping guns and ammo.

UPS is quite happy for your business - I'd suggest you use them.

Your link opens USPS regs to item 10.0, but if you back up to items 8.5 and 8.6 you will find that the regulations take exception to certain things (ORM-D or not) and calls them Harmful Matter. It considers Harmful Matter to be dangerous to USPS employees, and thus cannot be mailed. Click the link and scroll up. Ammunition is specifically listed. Can't mail it by USPS.


Hometheaterman: 30-06 is heavy, the shipping charge will probably be more than the ammo is worth. It is legal to sell it to someone local who will transfer it to someone in an another state.

If you scroll down from where my link takes you to the Exhibit 10.4 DOT Hazard Classes and Mailability Summary, you'll find that many items classed ORM-D can be mailed.
 
If selling locally, maybe insist for it to be Cash.

If selling to a non local party, insist on a U.S. Postal Money Order.


Otherwise, ammo is gone, person whether 'local' or not is not going to be easy to find, and the 'check' could well be 'rubber'.
