SB 168, sponsored by Steve Neville of Aztec, passed in committee in the NM legislature and has been forwarded to the Senate Judiciary Committee.

NM folk: Please look up the Senate Committee members on the NM Legislature site and ask them to support SB 168. It will be especially effective if you are from that Senator's District. There are 6 - D's and 4-R's on the committee. Richard Martinez (D-Espanola) and Lidio Renaldi (D-Gallup) are the swing votes. The Republicans will support the bill. McSorley, the chair, Grubisek of Santa Fe, Linda Lopez of Albuquerque, and Michael Sanchez of Belen (also the Majority Leader) will oppose it.

SB 168 will fix a quirk in regulatory interpretation that bans CCW holders from entering an establishment that sells alcohol in any form. This means that most grocery stores, c-stores, etc, are off-limits. Places that serve liquor by the drink will continue to be off-limits.

PLEASE, PLEASE, do NOT send e-mails declaring your RKBA and other consitutional arguments. Point out that this is a women's safety issue first and foremost. New Mexicans are forced to disarm in the area where they (particularly women) face the greatest risk.

I will try to keep you informed of developments. When the bill comes up before this committee, if you have a chance to go to SAF and offer comments, please be sure to do so.

Here in Colorado, we can carry anywhere. It's never been a problem. I'm sure it never will be.
 
The info below was posted by someone on packing.org. Looks like SB111 is a better bill than 168. Either would be better than the current situation.


SB 111: Best of three bills, including SB 167 and SB 168, all of which seek to eliminate the idiotic and malicious criminalization of carrying a concealed firearm in a so-called "liquor dispensing establishment." This will legalize CHL holders entering an establishment selling alcohol for off-premises consumption. While it's not as good as repealing NM 30-7-3 altogether, it's a step in the right direction.

SB 167 and 168 introduce a goofy, Texas-style test of how much of said establishment's income is derived from alcohol sales. SB 111 is free from this unnecessary complication.

HB 163: "Castle Doctrine/Stand your Ground" law.

Very similar to Florida's recently-passed law on this topic. I am not a legal expert, so I cannot say whether it actually creates a presumption of innocence on the part of a homeowner or driver defending himself against e.g. burglars & carjackers et al, but it is definitely a step in the right direction.
 
Any of the three (111, 167, or 168) would be better than what we have now, but none of them will allow me to carry in a restaurant that serves alcohol for consumption on site. It won't happen this session, but we really need something that will allow you to carry anywhere just so long as you maintain a 0.0 blood alcohol level. That way I could take the wife out to a decent restaurant without having to disarm first.

I just made a quick visit to Texas, and it was nice to go into decent sit down restaurants without having to leave the pistol in the car. I had to chuckle about the prominent signs proclaiming "unlicensed carry" to be a felony, knowing that either my NM or FL CCW permits made me legally "licensed".

"SB 111 (known around here as the gun bill) passed the Senate at about 1:30 by a vote of 26-5. The 5 are the usual gun haters, M Sanchez, McSorely, Lopez, Feldman and Ortiz y Pino. The only real debate centered around the “need” to be armed."

Now, on to the House!!

An identical bill is making its way through the House. It was voted unanimously out of its first committee yesterday, and has two more to go before a floor vote.

New Mexicans, please do a little research (full details on GlockTalk under Carry Issues), and contact your House rep and urge them to support the bill. Women voters will particularly have an effect because they are the ones who will really benefit - not having to disarm to go the the grocery store, drug store, etc.

The House Bill (HB 588) easily passed the House consumer committee, but has been bottled up in Business and Industry for some time. We need to take action to blast it out!

Phone calls will also work - call the switch board and ask for the Representative and urge them to support HB 588 and bring it to a vote in committee. No need to state a long list of reasons because the Representative will only receive a for/against statment.

The link seems to be broken. Use the first part of the link to get to the NM legislative site. Then click on Business and Industry. The list of members should appear. Click on each name and it will let you link to their email if they have one.

I spoke to my State Senator this morning and he thinks most of the commitee other than the women who are in education will support the bill.

We just need to let them know that there is a lot of interest in the bill and ask them to bring it up for consideration quickly. Go ahead and write even if they are not from your district - it shows interest in the bill.

Keep it short and sweet. There is also a thread on this at GlockTalk with an excellent sample email. I would urge you to modify his email because "form letters' carry less weight. Talk about defense of women and the elderly who must disarm at the locations they are most likely to be attacked - store parking lots.

A couple of thousand emails and phone calls in the next few days would have a huge impact.

If you call, all you need to tell the secretary is that you urge Rep. ____ to bring HB 588 before the committee and you request his support of the bill. That will be the essence of the message anyway. None of the reasons will be reported to the Representative in the phone message.
 
The House bill is scheduled to be heard by Judiciary this afternoon (Fri. Mar 2) after the floor session.

If it gets out of Judiciary okay, we need to be ready to ramp up requests to the House Speaker and Majority Leader to quickly get it to the floor.
 
I contacted Swisstack & Komadina both by phone and email on Thursday.
 
The House bill has now passed all three committees and is on the Speaker's table. All the New Mexico folk need to email the Speaker and the Majority Leader and ask them to bring the bill to the floor quickly.

In Minnesota we can carry anywhere other than Federally prohibited places and places that have 'omgz no gun in here' signs. I carry in bars and liquor stores all the time, I just don't drink while carrying because the limit is low, that and I really don't drink anymore anyway. I replaced boozing with guns and ammo. :D
 
I'm glad I came across this thread; I was thinking of starting up a petition to somehow get the law changed here in NM. Things are much further along than I had envisioned :)

To that end, I just e-mailed the Speaker and Majority Leader, asking them to bring the bill to the floor and urge fellow legislators to pass the bill. I enclosed a brief summation of why I believe passing the bill to be in NM citizen's best interest.

Thanks for the updates, I'll be checking back to see what's happening.
 
One More Time Around the Block

The House passed their bill - 588- will only 8 dissenting votes. It has been sent over to the Senate where it has been assigned to only one committee - Judiciary - which passed the Senate version of the bill (close in language) on a 10-1 vote.

Once again we need to contact Senate Judiciary and aske them to bring up the House bill 588 as soon as possible.

I sent emails to every member of Judiciary, except the 2 Democrats that didn't have an email address listed.

Here's hoping all goes thru smoothly.

My question, and slightly off topic for this thread: Is there any move afoot to work our the details with NM law so that there may be full reciprocity with Texas? Texas law already recognizes New Mexico's carry permit - - Surely this is meeting y'all more than half way.

And yes, I realize the reciprocity thing needs to take a back seat to curing what is wrong with residents' carry status "on premises."

Me, I'm legal with my retired peace officer ID, but there are a lot of Texans who like to travel to NM, and spend quite a bit of money. It'd be nice if the CHL holders could legally carry in your fair state. :)
