NJ Ammo purchase and Dicks Sports

I just went to Dicks in Woodbridge, NJ to buy some 20g sluggers and the guy behind the counter told me it's now state law that I need my FID card to purchase ammo because he has to record it. Every other place I've been to would take my drivers license or FID, but not Dicks.

I think this is Dicks policy and not state law, but I'd like some back.

I tend to try and pay attention about goings on in NJ (i have family back there) Not overly familiar with all the NJ laws, but i definitely haven't heard of this recently...

If it's just happening at Dicks - that may just be a dicks policy? Perhaps they think this law is coming, so they're trying to get people in the habit now?
 
Or maybe it's Dicks policy to tell people "it's state law" so they don't look like they are the ones burdening people. I should be able to make the purchase with my license.

I never liked shopping at Dick's - i always thought the name was very fitting...
 
I'm a cashier at Dick's, here in MN. It's not policy to record anything. We have enough paperwork to deal with when we close as is. When somebody buys ammo, it tells us to check ID, that's it. We sell so much ammo, it would be impossible to keep track of it all. The funny thing is that it asks if the customer is 18, even if they're buying a case of 9mm (7.98 btw). We could totally be caught in a sting if the cashier sold handgun ammo to an 18 yr old. My manager didn't even know the law was 21, I don't think any of em do. I don't know about your store though. That sounds like an incompetent cashier.
 
IncredibleGord, if the 9mm ammo is being used in a rifle, I believe that it is legal to sell to an 18 yr old depending on what state you live in. Guns like the Kel Tec Sub 2000, Hi Point 995, and the Beretta Cx4 storm are carbines that shoot 9mm. Think of it the same way with .22 ammo. It is used in handguns and in rifles.
 
I bought 200 rounds of .223 at Dicks in south jersey. he just handed me the box, said i didnt need any ID. This was maybe 3 weeks ago.
 
Many places in NJ recored the NJ Drivers License or FID # at the time of purchase. I don't know if this is law and I don't have a problem with it. I'm under the impression that LEO come in to check if recent crimes took place with a specified ammo. (any recent purchase). But I know I don't need my FID specifically. Rays sportshop used to record the purchase, so does Efinger, and so does Jim Flynn. Dicks is just being a...well I'll leave it at that. I might write to them. They actually turned me off and from a customer service stand point, they should be made aware of it. No one is breaking any laws so what's the policy for?
 
I bought some .380 and .40 at Dick's in Burnsville MN. No one asked me for any ID. The cashier looked at me and asked if I was over 21. I said yes. I am 59.
 
" if you can put it in a handgun, you need a FID" is what I was told recently in Ray's. I think this was a recent law put into place of some sort.

Tell him to re-read 2C:58-3.3, which is the new law (as of 4/1/08), and it applies ONLY to handgun ammunition. The law doesn't even require them to record the sale - that requirement was only for hollow-point ammunition [2C:39-3g(2)(a)]

As of the 1st April the law in NJ says that purchases of handgun ammunition needs a FID, to purchase in NJ.

NOT any other ammunition as you can see from the relevant bit below.

2C:58-3.3 "Handgun ammunition" defined; sale, purchase, etc., regulated; violation, fourth degree crime.

1. a. As used in this act, "handgun ammunition" means ammunition specifically designed to be used only in a handgun. "Handgun ammunition" shall not include blank ammunition, air gun pellets, flare gun ammunition, nail gun ammunition, paint ball ammunition, or any non-fixed ammunition.

b.No person shall sell, give, transfer, assign or otherwise dispose of, or receive, purchase, or otherwise acquire handgun ammunition unless the purchaser, assignee, donee, receiver or holder is licensed as a manufacturer, wholesaler, or dealer under this chapter or is the holder of and possesses a valid firearms purchaser identification card, a valid copy of a permit to purchase a handgun, or a valid permit to carry a handgun and first exhibits such card or permit to the seller, donor, transferor or assignor.


It is only binding on "bricks and mortar" retailers in NJ and does not affect on line purchases from out of state suppliers EXCEPT a few vendors (Midway for example) out of an abundance of legal cowardice/caution are restricting handgun ammunition sales to NJ until they implement the same "fax and keep a copy of the FID" process as they already do for Illinois residents.

This also does NOT affect reloading components.
 
The fact of the matter is you can't blame a retailer for being overcompliant, more so in a state like NJ. What is and is not handgun ammo can be debated (I'm not claiming 20 ga is) and is not what you might expect the average store clerk to know. I'm not in favor of it but I can understand the management requiring ID on all ammo sales in NJ to keep out of trobule with the state.

For shotgun shells, the only law is federal law - which says no sales to anyone under 18. It's at the discretion of the owner whether or not to "card" you.

Also 20g ammo is not handgun ammo.

As predicted before this law passed, retailers are scared to death, and are making up their own policies out of a "CYA" philosophy - and I can't really say that I blame them. Even before this law passed, I had dealt with online retailers who flat-out refused to ship to NJ, because according to them, "the law says we have to see your ID in person to sell you ammo". When I pressed them for "what law is that?", they just said, "Well, that's what your State Police told us".

As I'm always fond of movie quotes to sum up a real life situation, allow me to para-phrase slightly: "It's a big crap sandwich, and we're all gonna have to take a bite"
 
Sounds to me like the clerk was just uninformed... You can't expect much from the minimum wage counter jockeys. I try to avoid the "Sporting goods stores" for anything firearm related :)
 
Agree with above post.. just a counter jockey doing what his nitwit manager told him to do.

Just purchased .308 at Ramsey Outdoor in Ledgewood, NJ. The guy handed me the box of ammo and said have a nice day. The guy at the counter next to me was buying hand gun ammo (.22). The guy behind the counter asken him for his FID card. I actually questioned why him and not me. The reply was "anything that goes into a handgun or hollow point ammunition requires FID card" (I didn't bring up Thompson Contenders) :eek:
 
Wow, more "confining limits" in action if this is indeed the case. Still not as bad as California, but I shudder to think what will happen if that trend continues. Seems like it's a case of the clerk being ill-informed and naive, which is both easy to accomplish and satisfying if you don't know any better. Thankfully we've got people on here who care and keep them in check. Keep it up folks!
 
I ran out of NJ years ago I thought that it sank in the ocean. Soon I'm sure. Don't miss it though.

In my experience, Dick's is named appropriately. I try to avoid them unless it is a last resort. Customer service is better at WalMart if that tells you anything.

I have to agree with you there. Considering the fact that these commie States tend to pass multiple new gun restrictions each year, it has to be hard to keep up with it all.
 
I think everyone is giving dick's way too hard a time.

1) Dick's may only sell long guns, but at least they bother. Pretty much every other large retailer who does so in other states doesn't bother in NJ.

2) Dick's actually sponsors shooting competitions in NJ. I've helped put on one match that has been sponsored by the local Dick's several years in a row. (they cut back in 2009, but they did so for everything sports related they sponsored, and they were far from the only ones).

3) Getting a reliable employee willing to get a pink card in NJ at a price they can afford to pay is hard. Unless they can bag a retiree who want part time work and an employee discount, it's pretty much forced onto the employee. This doesn't make for good help.

4) combine the above with the fact NJ often gives dubious advice to FFL holders, it is not surprising they get some funky instructions for compliance.
 
I feel sorry for people that live in states where gun laws are so restrictive. I can literally walk about 100 yards to Wally World or the sporting goods store right next door and buy what I want. As long as I have the money I can buy any kind of ammo available. No stupid "card" to show. I dont even have to show a DL! Just pay my money and walk out the door. If I were younger they may ask to see ID to make sure Im at least 18.

We visited my Mom in NJ in about 1995. Thinking we needed to enjoy some Trap Shooting we found an open club, then bought some shotshells. We were informed that any left-over shotgun shells would have to be returned to the club desk!
