Yea, is anyone from western NY? Buffalo, syracuse, or rochester? If so, we are going to write a very precise legal petition, as well as flood the NY govt with letters of disgust.... we are even considering renting a bus and driving out there. If anyone wants to help or wants to be an "Extremist" (as the liberals would call us), post it on the boards. Id really hate to fight against my own American bretheren with weapons, but if it comes down to it, those NY law enforcement guys ARE NOT taking my weapons. Anyone else with me on that?
 
I am a close friend of NJR and i live in Greece, NY
My senator Joe Robachs daughter goes to my school and i will have a personal meeting with him and will persuade him as well. He is already a Republican so it shouldnt be to hard. If this passes, they will have to come by force to take my arms
 
I live/work around Rochester, and have some grave concerns about how the NY AWB is already written - passing the "grandfather repeal" will, if creatively read, ban nearly all semi-autos.

New York Anti-Gun Bill Moves Forward

Friday, March 04, 2005 A bill that would drastically expand the state`s current "assault weapons" ban by redefining what constitutes an "assault weapon" was approved by the Assembly Codes Committee on March 1. In addition to expanding the ban, A 2466 would require those who currently own any firearm deemed an "assault weapon" to register it, render it permanently inoperable, or turn it in to the police. Those who choose to register their firearms would be subject to an additional NICS check and would be required to have the firearm tested for entry in to the state`s ballistic imaging program. The bill is expected to be considered on the floor early next week, so members are encouraged to contact their Assembly member and urge him or her to OPPOSE A 2466!


Time is short, so phone calls, faxes, and E-mails are the order of the day.

It going to pass in the Assembly unless several of the Downstaters have a [not likely] change or heart. The Downstate Liberals have no fear of their voters. It shouldn't make it through the Senate.

Dear Chairman Minarik,

As a registered Republican, life long resident of New York State, and financial contributor to the RNC, I want to direct your attention to the current effort in the State Senate & Assembly to amend and strengthen New York’s so-called "Assault Weapons" ban. Please urge your Republican colleagues in our state’s government to oppose & defeat any and all pieces of legislation that would further infringe upon the gun rights of the law abiding, tax paying, politically active sportsmen of this state.

The usual anti-gun politicians in Albany are calling for a needless amendment of the current ban (in the form of S.2445 & A.3371) which would criminalize the possession of self-loading shotguns (a favorite of hunters), most detachable-magazine self-loading rifles (used by marksmanship competitors), and so called “pre-ban Assault Weapons†which are currently & legally owned without incident by countless New York gun enthusiasts, hunters, and collectors. Please understand that the unreasonable efforts of these freedom-robbing politicians should not be supported or tolerated in the least.

The roll that these unfairly maligned and demonized firearms play in crime is statistically negligible. The only thing accomplished by such restrictive legislation is the piecemeal infringement of our Second Amendment rights. If left unchecked, gun control will worsen to the point that the right to bear arms will be a hollow concept, and the individual citizen’s right to personal protection will be negated.

By standing in opposition to such draconian legislation as A.3371 & S.2445, NY State’s Republican Party will benefit by gaining the favor of countless New York gun owners who actively support their freedoms. I’m deeply passionate about this issue, and I know many others who take gun control into serious consideration when entering the voting booth.

Thus, I once again ask you to ensure that all of New York’s Republican lawmakers stand in opposition to any and all incarnations of a strengthened or amended “Assault Weapons†ban.

Seeing as the Republican majority in the state Senate is our last line of defense, it behooves us to let our state's GOP chairman know where we stand & what we will and will not tolerate!

Mr Minarik:

You need to know that I've avoided joining the NY Republican Party (for years) because I feel that it leans way too far to the left on most issues. At the National level I fully support President Bush and almost all of his policies. At the State level I just can't bring myself to offer support.

If I read the political winds correctly Governor Pataki is loosing support from both sides of the political debate. I would guess that the next election will be very close. I know many conservatives here in Upstate (myself included) that have historically not voted for Governor Pataki because of his unmitigated support for the gun control legislation predominately put forth by the "Downstate Caucus". I'm a lifelong hunter and shooter. The current crop of gun control bills threatens some of the firearms that I've owned legally and responsibly for many years. If these bills were to make it to the Governor's desk it would be wonderful if he were counseled to veto each and every one of them.

Upstate Conservatives should not have Downstate liberal policies rammed down their throats. In most areas the Upstate social demographic is diametrically opposed to Downstate. We shouldn't have to live by their philosophy nor they ours. I could support dividing NY into two distinct legislative districts; Upstate (North of Westchester) and Downstate (Westchester and points South). Each district would elect a single US Senator. The US assembly would remain the same. Each district would be allowed to adopt or reject any piece of State legislation. I'm not sure how taxation would work.

Assembly Advances Anti-Gun Violence Legislation

Measures Seek to Reduce Gun-Related Domestic Violence Incidences;
Protect Children; Enhance Gun Safety Education and Awareness


Here are the descriptions of the various bills:

Keeping Guns Out Of The Hands Of Criminals

Cracking Down on Illegal Gun Trafficking (A.2345/Paulin)

Noting that one percent of gun dealers account for more than half of the legal guns that make their way into the illegal market, Silver said it was important to take a two-pronged approach to address gun trafficking. To that end, this bill not only takes aim at illegal trafficking but also imposes penalties on legal gun dealers guilty of dumping guns into the illegal market. (Passed Assembly 5/25/05)

The bill, sponsored by Assemblywoman Amy Paulin (D-Scarsdale), imposes regulations on gun dealers to stop the flow of illegal weapons and also significantly increases criminal penalties for illegal gun possession and sales. The bill also requires stringent recordkeeping and reporting to prevent gun sales to criminals. Additionally, under terms of the legislation, gun dealers must implement a security plan, require employee training and prohibit minor's access to guns.

Tracking Guns Involved In Crimes (A.2213/Koon)
Another bill included in the package would require law enforcement personnel to submit ballistic information to the new ballistic identification databank whenever bullet shell casings or guns come into their possession. The measure is sponsored by Assemblyman David Koon (D/I-Perinton). (Passed Assembly 5/24/05)

Keeping Guns Out of the Hands of Violent Felons (A.1170/Dinowitz)
Another bill would eliminate a loophole that allows a convicted felon to obtain a firearms license and possess a gun after being granted a waiver from a parole board. The measure is sponsored by Assemblyman Jeffrey Dinowitz (D-Bronx).

This bill would stop the practice of allowing violent felons to possess a rifle or shotgun lawfully after being issued a "certificate of good conduct." It would also prevent felons who are issued a certificate of relief from disabilities or certificate of good conduct from obtaining a firearms license.

The bill narrows the relief afforded by these waivers to prevent convicted felons from obtaining a firearms license. It also criminalizes the possession of a rifle or shotgun by a convicted felon. (Passed Assembly 5/24/05)

Safeguarding Our Children

The Children's Weapon Accident Prevention Act (A.673 /Weisenberg)

This legislation, sponsored by Assemblyman Harvey Weisenberg (D-Long Beach), seeks to protect children from accidental shootings. Five new categories of crime would be created for negligent storage of a weapon under the bill's provisions. In addition, gun retailers would be required to alert consumers about the new weapons storage requirements and the New York State Education Department would have to develop a weapons safety program to teach children how to prevent weapon accidents. (Passed Assembly 5/24/05)

Childproofing Firearms (A.2302/Englebright)
This bill, sponsored by Assemblyman Steve Englebright (D-East Setauket), would seek to reduce child-related shootings, particularly those tragedies of children shooting children. This bill would make it a Class A misdemeanor to sell guns without childproof features. Covered under provisions of the bill are pistols or revolvers manufactured 12 or more months after the effective date of the bill. Design features could include making the weapon more difficult to fire by adjusting the trigger resistance of the gun to at least a 10-pound pull, altering the firing mechanism so that an average five-year-old child's hand would be too small to operate the gun or to require a series of multiple motions in order to fire the gun. (Passed Assembly 5/25/05)

Promoting the Safety and Effectiveness of Law Enforcement

Stopping Assault Weapons (A.2466/Lavelle)

This legislation, sponsored by Assemblyman John Lavelle (D-Staten Island), would ban assault weapons. Seeking to address the void left by the expiration of federal assault weapon ban, the Assembly proposal would expand the definition of assault weapon to prohibit more of these deadly guns in New York - including guns that have been modified to work like assault weapons. (Passed Assembly 5/24/05)

Banning .50 Caliber Weapons (A.4471/Eddington)
Another proposal, sponsored by Assemblywoman Patricia Eddington (D-Patchogue), would ban .50 caliber sniper weapons, which can be used to disable commercial aircraft and helicopters and are powerful enough to penetrate steel plating. These dangerous weapons, which are used extensively by the United States military and are accurate from over one mile away, continue to be available for purchase in New York by anyone who can buy a rifle. A report from the nationally-renowned Violence Policy Center found that these weapons have been purchased by the Al Qaeda terrorist network and used by other domestic and international terrorist organizations. Silver noted the Assembly had sought to include a ban on these weapons in a comprehensive state anti-terrorism law passed two years ago, but the proposal was refused by the governor. Silver called attention to California's recent enactment of legislation banning these weapons and called on New York to do the same. (Passed Assembly 5/24/05)

Banning Armor-Piercing Ammunition (A.2837/Koon)
This measure seeks to rid New York streets of deadly armor-piercing ammunition and ammunition that is designed to fragment or explode upon impact. Silver noted that 46 police and sheriff's departments around the state have signed a resolution in support of the .50 caliber ban and the armor-piercing ammunition ban. (Passed Assembly 5/24/05)

Domestic Violence (A.2404/O'Donnell)
This bill, sponsored by Assemblyman Daniel O'Donnell (D-Manhattan), has already passed the Assembly. The measure seeks to protect victims of domestic violence by requiring criminal or family court judges to inquire about the existence and location of firearms owned or possessed by a defendant when an order of protection is sought. Expressing concern for victims of domestic violence, Silver said that while current law provides for the mandatory revocation or suspension of firearms licenses upon the issuance of orders of protection, it does not require the court to inquire about the location of those weapons. My State Assemblyman responded to my last letter with a "I'll let you know if the .50 calibre ban picks up steam, thanks for writing" and then went ahead a voted for it the next day. He was rated C+ by the NYSRPA. Suzi is rated an F.
 
Yeah I can't even count how many children and spouses are the victim of domestic violence committed with .50 caliber rifles and ARs, AKs, etc. :barf:

They are making a quick beeline to total ban and confiscation. Halfway there it seems.
 
They ALWAYS pass the Assembly

Always. That's because the Sheldon Silver Downstate crew dominates the Assembly. They have this notion that no one worthy of mention lives north of Westchester County. In the past the Senate has always been the place where the anti-gun bills die. This year it seems that there are a LOT more bills than in the past so we'll see how well the Senate holds out.
 
I have sent some letters on behalf of you folks.

I have always remembered what my elders and mentors shared – one being a person would be smart to hoard single shot shotguns, and medium frame .38spl revolvers. This said right after Kennedy was assassinated in Dallas – I was in the third grade at the time.

I am also reminded of the words of Ragnar Danneskjold :

I brought down from “up north” a man’s daughter, and all save one firearm …when the gentleman finally got all his affairs settled, he re-joined his daughter, his firearms, and his Freedoms again here in the South. Not the first time, and yep – I'd do it again in a heartbeat.

I hate to read these kinds of threads not because of what's happening in terms of laws, but because of the posts from people saying they have or will flee their state because of the laws. Particularly California and New York.

Guys, these states have HUGE populations. You leaving means nothing. Your business as an individual means nothing. The taxes you pay mean nothing to the state's welfare.

Your vote DOES MEAN SOMETHING! YOU mean something! When you flee these states, the chances of fair laws coming and unjust laws going get slimmer and slimmer!

These states are GLAD to see you go, it means less opposition for their horrible laws! In their opinion, out with the bad, in with the good. You have got to get over these short term (relatively speaking--I'd consider a 10 year law short term) bumps and do what needs to be done, not flee! I'm not saying take up arms and storm the capitol, but when you are no longer a member of these states, you can't vote and your letters and phone calls mean nothing. You can't help us at all by leaving, and every one of you that leaves means one less vote, one less opinion and one less person to stand in the way of total demilitarization (and we all know where that leads...).

I'm sure those of you that have left aren't coming back, you could care less about the rest of us stuck with a bigger job now that you've gone. But you guys have got to think about the consequenses of you leaving instead of the consequences of these laws. With America being as apathetic about voting as it is, the more of us there are with purpose, the better chance we stand. We've got to bear the weight together, not abandon our responsibility!

If you don't like the laws, set out to change them! Don't leave the mess for the rest of us to clean up!
 
UPDATE...

Within hours of the Assault Weapon Ban bill A2466 passing the Assembly, Senator Frank Padavan (R-Queens) introduced the bill in the Senate S5504. This bill repeals the existing Assault Weapon
definition and replaces it with new definition language. The bill has been referred to Senator Bruno's Rules committee bypassing the usual channel of Senator Volker's Codes committee.

Some facts about new Assault Weapon Ban bill A2466/S5504

Bans all semi-auto rifles that have a detachable magazine and one or
more of the following.
Pistol grip (no further definition)
Thumbhole, telescoping or folding stock
Compensator (porting)
Muzzle brake

Bans all semi-auto pistols and centerfire rifles that have fixed
magazine of over 10 rounds.

Bans all semi-auto pistols with one or more of the following
Second hand grip or pistol grip that can be held by
non-trigger hand.
Folding, telescoping or thumbhole stock.
Heat shield
Muzzle brake or compensator (porting.

Bans all semi-auto shotguns with one or more of the following
Pistol grip or vertical handgrip (neither term is defined.
Folding, telescoping or thumbhole stock.
Fixed magazine of more than 5 rounds.
Detachable magazine.

Revolving cylinder shotguns are also banned.

Any of the above parts in the possession of the gun owner is
considered to be an assault weapon. In other words, if you remove the
offending parts from your gun and keep them, you still have a banned
weapon.

Options for the owner of banned guns.
Render the gun permanently inoperable.
Turn it in to police, no compensation.
Register the gun with the State Police.

Whether your vote means something depends on a lot of things. As you point out, these states do indeed have huge populations, and it just might be rational to determine that the center of that voting mass is such that the situation is hopeless.

Each man and woman must make their own decisions in those difficult circumstances.

If one has run the numbers and soberly arrived at the conclusion that the center of mass is hopelessly against him, the consequences of staying has no positive impact on changing the river's course. It leads to only two places:

-Compliance and acceptance of the Rape of your Rights, or
-Noncompliance, with significant, chronic risk to yourself and family, and possibly the poor schlubs they send to your door.

There is no responsibility to accept the Rape of your Rights, nor duty to defend the plains alone in the face of a Panzer brigade.

This awesome battle for the Second Amendment, but one front in a war for the very soul of the Republic is larger than NY, CA, NJ and MA. Fight we must in those places, so as not to completely yield the field, but the greater reality is that the war will not be won in those places.

The simple, ugly truth is that so long as the courts lack the courage and will to enforce the Bill of Rights, (as the 2nd circuit so recently did) States whose voters are largely inclined to this sort of darkness will get away with whatever they can. As we can see here, should this gain further momentum, they can get away with a great deal.

If we ever see this mess cleaned up in our lifetimes, it will be because the greater majority of states come to the side of the angels on the BofR, the hue and cry bubbled up to the federal level, and then settled as liberating rain on these dark places.

I have no doubt that it can be done. If the Civil Rights movement could wash away an entire history of institutionalized racial bigotry in one section of the country, then the Constitutional Rights movement can certainly wash away a mere 100 years of institutionalized individualist bigotry in another.

Fighting from ground that can be successfully defended is an axiom of conflict.

I just left NY a couple weeks ago.

My leaving means reclaiming my freedom. I can now walk into a gun shop and buy a handgun or "assault weapon" or any size magazine, pay for it, do the standard yellow form & NICS, and walk out with it. No prohibition, no permission, no registration, no criminal treatment.

With a little more paperwork (federal only) I can own machineguns, suppressors, destructive devices, short-barreled shotguns & rifles, etc. I can even walk a few hundred feet down the street, plunk down some cash, and blast away with an M16 or MP5 or the like.

The already depressed western NY region just got a little more depressed. A lot of businesses just lost a customer. A company just lost a talented & experienced software engineer. While certainly that isn't much impact, it can only tighten the squeeze on those remaining.

In contrast, where I am is enjoying an economic boom. New freeways are going in. Housing developments are popping up at an almost alarming rate. Finding new employment is just a matter of time, not uncertainty.

The taxes you pay mean nothing to the state's welfare.

Wrong.

The absence of my tax payments is not matched by a reduction in NY spending, it will be matched with several thousand people having to cough up another buck each year. Small, yes, but not nothing.


One's vote ultimately means nothing so long as there is someone else voting in opposition. NY City plus other urban centers flat outnumber the rest of the state's voters. My vote had no impact so long as there was someone else neutralizing it - and the other side simply has far more votes in NY.


I spent upwards of 15 years trying to obey and fight NY's oppressive laws. My leaving NY may have little impact as you claim, but likewise my presence had little impact on oppressive laws enacted by would-be tyrants. By staying, I might have had a tiny positive influence against a flood of negatives ... but by leaving, I have come to enjoy a tremendous improvement in my liberty. By leaving, I have improved my liberty enormously more in just one day than my efforts over 15 years. I stayed long, voted often, obeyed laws, wrote letters, swayed hearts & minds, to no avail; in a day all those state restrictions were lifted (all I need now is a general shall-issue CCW permit - Georgia isn't "Vermont style" but it's close).

That is a good point, I'll take it to heart.

However, I refuse to leave California until there's nothing I can do. I'll have to see what happens with SB357 and see how the majority of people react when ammo manufacturers (hopefully) withdraw from all CA sales.

Depending on how it goes, I may come closer to moving out of state.
