Olympic Arms OA-93 PT-Legal in NY State?

Does anyone know if a Olympic Arms OA-93 PT AR15 style 223 with the detachable stock is legal to own in New York State? A guy I know wants one but does not know if it is legal in NY. I know it would be in WI but with the different state laws out there I do not want to give him incorrect information.
 
No idea if it is legal or not, but it is a really cool pistol. Here's my experience with the OA-93 and Olympic Arms:

I was coming back from Bike Week in Daytona in March of 1993 and picked up a magazine that had the OA-93 on the cover (I still have the magazine). Well, I called around and found out that I could buy the gun, and my local dealer was going to sell it to me for $450 (a couple of bucks over his cost). I paid him for it and had him place the order with Olympic Arms. I couldn't wait for it to arrive. We called periodically to find out the status on the order to later be told that they had ceased production because of the potential legislature that was trying to get passed. I later found out that they were producing it, but shelving them, knowing that they could make more money if the ban was passed. The price went to something like $900....I kept my reserve on one....it then went to somewhere around $1800.....I told my local dealer to pull out of the pool for it and I bought a Ruger M77 in 223 with what I paid him initially. Last I remember hearing, later that year, OA wanted $2750 for the same gun (dealer cost) that I was going to get for $450. Since then, I have never had any desire to EVER do any business with OA.
 
If it's a pistol, then it should be legal so long as your friend in NY registers it as such. I'm not entirely up to these laws, but doesn't a stock on a pistol qualify it as a SBR?
 
It's the OA-93 Carbine. It is considered a rifle although the sytem works like the pistols which allows the detacheable stock. I'm not familiar with the NY laws, but you can't use a forward grip with one if you take the stock off.
 
Gggrrrrrrrrrrrrrrrrrrrrrrrrr.....You made me look up Olympic Arms' website. :cuss: Something I haven't done since I heard they came out with that hideous OA-98 model. I see they did turn the OA-93 into a carbine, you can order the upper by itself, and they have made the OA-93 with the detatchable mag, again (at one time, they had it welded or staked into place to get around the 10+ removeable magazine description). Still no idea if it is legal in NY or not, but you have me drooling over the original OA-93, again. Damn you!!!! :cuss: If I didn't have such a distaste for OA. :scrutiny: :banghead:
 
Yeah......sarcasm.......I've always liked that OA-93 pistol and wished they didn't screw me out of the one I was going to buy back in '93. I guess there is still hope.....if I still want an OA-93. ;)
 
NYS Firearms Laws

Just so we are on the same page, NYS is still under the 94 firearms ban.
It is the same as the Federal version,but it has no sunset clause.

Thanks to Pataki's deal, we are still screwed and have to continue to live under the ban.

So if this firearm meets the requirments of a dreaded PRE BAN "A" weapon
it would not be legal in NYS. (If it were manufactured before 1994 it would be grandfathered.)

Read Article 265 - section 22 for the definition of an AW. (Page 285)

Of course, you could call the NYS Police Firearms Division and ask them for a clarification, but don't be suprised if they don't know either. :confused:

I don't have an answer for this particular gun as I think it would fall into a grey area of the law, in other words, it would depend on who's interpetation is acceptable to NYS Police.

I read the NYS definition of an "assault weapon" and the OA-93 PT should be legal. It accepts a detachable mag and has a pistol grip but none of the other requirements to be classified as an "assault weapon".

It's my belief that the stock would have to be fixed (non folding or non removeable) to meet the intent of NYS Law.

Please get in writing a ruling on this firearm before purchase, as I would hate to have you entrap yourself.

Like I said before,it's all in the interpitation. I just don't trust them :(

I read the NY law out of curiosity and would also get the official verdict in written form.

I do know, however, that the OA-93PT was legal under the old federal assault weapons ban with the removeable stock. Funny...you couldn't have the folder or collapseable at that time, but you could just yank it off.......just another good reason to make sure it's ok with local officials. Making sense has nothing to do with law at times.
