Did I misread the OP's original post? Didn't he say he had a 16" barrel? In which case he can put on what he damned well pleases.
Had a MagPul 'blade' on a Scorp before the tax stamp arrived; there are better choices.
The new BATF ruling (confusing, FUBARed, as is normal) is going to leave a lot of us with a moral dilemma.

Dude - READ THE THREAD. If I’m wrong as you claim, then so are you, because you’ve agreed with my statements.

The entirety of the clarification I provided agreed that 1) the addition to a brace today to a pistol does not matter, and 2) once the new rule does come into play, the fact a pistol comes from a factory or not is wholly immaterial.

As long as the lower was not factory built as a pistol lower you can put the brace on and take it off without any issues, I think, at least until the ruling takes effect.

the original claim specified that under the CURRENT laws, a factory assembled pistol would have issue with adding a brace - which isn’t the case. And under the FUTURE policy, any pistol which adds a brace will be under the scrutiny of the point system, regardless of whether it was factory assembled or otherwise. The the distinction wasn’t applicable.

Yup - the OP added the barrel length a few days into this thread, so we’ve all been chasing a dead rabbit.

Largely, any AR “pistol” with a barrel over 10.5” won’t be at the mercy of the new point system anyway, as the 4999 doesn’t apply for Firearms with >26” OAL, and certainly doesn’t apply to 16” barreled uppers, which inherently can’t be SBR’s.
