receiving a firearm with a C&R question

I qot a question on receiving a firearm with a C&R. Specially does the shipper have to send a copy of his FFL. I got a handgun shipped to me, but no FFL. I know he has to have one, since i got it through the Mail. Do i need to log it in with his FFL or will his address due?

I don't think you can mail a pistol to a C&R. My understanding is that only 01 FFLs can mail pistols to other 01 FFLs.
 
As an 03 C&R FFL holder I get C&R pistols sent to me.:) Now getting just about any 01's to acknowledge my 03 as real, is another Zebra of a different stripe. :cuss:
 
No NO NO NO

You as an 03 C&R can not receive a handgun through the mail. Only 01 FFL's and manufacturers, and gunsmiths can mail to each other through the mail on handguns. Business FFL's.........

C&R

As a C&R you can have a C&R handgun shipped to your address on your C&R. But only through fed ex, UPS etc... Not through the Post office. You can have a rifle shipped to your house though. (C&R of course).

As an 03 C&R FFL holder I get C&R pistols sent to me.

From the USPS website: "Handguns may be mailed by a licensed manufacturer or dealer of firearms or an authorized agent of federal government."

The USPS does not recognize C&R licenses, only dealers and manufacturers (01 and 07 FFLs) can mail firearms. You may do it and get away with it, but if a package is lost, at the very least, you will lose the firearm. USPS will not pay insurance for illegally shipped items.

As to the original question: No, the shipper does not have to include a copy of his FFL.
 
I have had a few handguns shipped to me by 01's and at least one that I know of from a big company(I will not mention names). If this is not allowed by the USPS, then the shipper would be at fault, as he signed the forms at the post office and if the gun got lost and USPS would not pay, he once again would be Liable.

I wasn't sure of getting a copy of the seller's FFL. Every other gun I have got included their FFL. I was thinking this may be more of a curiosity, then a rule.

c&r can get c&r handguns shipped to house via ups or other private carrier.

UNLESS you are in the ban states like CA.

stoliver, is there a difference between sending and receiving? Note that the original poster is the recipient. The pistol was shipped by an 01 FFL, who is legally entitled to ship via USPS. Is the law specific that an 01 FFL may ship only to other 01s and to 07s, or does the law stop at saying who may place the item into the mail?

Pistols, revolvers, and other firearms capable of being concealed on the person (referred to as handguns) are nonmailable unless mailed between the parties listed in 11.1.3 and 11.1.5 after the filing of an affidavit or statement required by 11.1.4 and 11.1.6.

11.1.3 Authorized Persons

Subject to 11.1.4, handguns may be mailed by a licensed manufacturer of firearms, a licensed dealer of firearms, or an authorized agent of the federal government or the government of a state, territory, or district, only when addressed to a person in one of the following categories for use in the person's official duties:

a. Officers of the Army, Coast Guard, Air Force, Navy, Marine Corps, or Organized Reserve Corps.

b. Officers of the National Guard or militia of a state, territory, or district.

c. Officers of the United States or of a state, territory, or district, whose official duty is to serve warrants of arrest or commitment.

d. USPS employees authorized by the Chief Postal Inspector.

e. Officers and employees of enforcement agencies of the United States.

Yes Gator, but isn't that "MAILING," as in USPS. That is different than UPS or Fed-Ex, no? (which would be called shipping)
I have never heard of a restriction on mailing a C&R handgun to a C&R (I would think the big guys that do it would have heard from BATFE by now if they were doing something illegal.

Got some in the South down here. Louisiana way. Actually got some nice homes in the area for around 125 - 150k :p

Easy. Check out the Raleigh/Durham (RDU) area in North Carolina, home of Research Triangle Park and all sorts of fantastic technology/biotech jobs.

A nice home can easily be had here, well within your price range.

This area is consistently judged one of (if not) the best places to live and work in the USA.

I've had quite a few handguns mailed to me USPS by 01 FFLs. As an 03 FFL, the only thing I have to remember is I can't mail one to someone else. How it gets to me is the sender's problem.
 
Yes, it is mailing, that's what we are talking about. As for restrictions on mailing C&Rs, see my post above.

Your original response was to someone that said "sent." I just wanted to make it clear that you cannot "mail" a handgun, but you can ship a handgun to a C&R holder.

they are not allowed to ship a gun to you through the Post Office unless you are a business FFL. They are breaking the law....... You still are not allowed to receive a handgun from an FFL unless you are one of the FFL's listed by the Post Office regulations...

Seems like alot of 01's are doing it wrong then. Surprised USPS is not cracking down on it.

Interesting. When I bought a Swedish M96 from a guy in Alaska, it was sent USPS Priority. IIRC, I even had to go to the Post Office to get it because it was signature required and no one was home at time of delivery.
 
I don't see anything in the DMM requiring an FFL for sending or receiving long guns. There are requirements that other federal laws be complied with, however.

Postal Regs (Publication 52, Section 432.1(d)) state that all Federal Regulations must be followed.

Federal Regs (27CFR 478.29 and 478.30) says that a FFL must be used if transporting interstate.

Why even bring up the fact that FFLs aren't mentioned? It is immaterial whether or not the DMM mentions FFLs for mailing of long guns.The rules are published by the Federal Regulations and the DMM states that you must abide by them. It makes about as much sense as saying that my truck's owners manual doesn't say anything about carrying firearms. All it might do is confuse someone who is too lazy to check the laws and make them think that it's OK to mail interstate without using a FFL.
