SBR Required Documents.

I am wanting to build an SBR from a Draco.
Can someone please explain to me the exact documents I will need to do this?
I have checked the stickies and I have been to the BATF Website which is as clear as mud to me. Any Links and help with accomplishing the paperwork will be highly appreciated.

As an individual or a Trust/LLC/Corp?

You'll need a "Form 1" (Batfe 5320.1)
You'll need a check for $200,.

You'll need your supporting documents:

For an individual:
FBI Fingerprint cards FBI FD-258LEBATFE 5330.20 (Certificate of compliance)
Passport photo (Attached to 5320.1)
CLEO Signature (On completed Form 1's)

For Trust/LLC/Corp
Copy of Full Trust, or articles of incorporation
Form 1 (No need for CLEO Signature or Fingerprints)

That's pretty much it.

Your Form 1 needs to be in duplicate, Printed FRONT TO BACK. Each with original signatures both your's and the CLEO's.
 
I posted this on another forum many moons ago. I think it might help you out. This was a Trust/LLC/Corp type Form 1 that I did.

I just thought I'd chronicle my FIRST attempt at getting an NFA weapon registered with the Bureau of Alcohol, Tobacco, Firearms and Explosives.
Since I have a spare lower, I thought I would register this one and make it a Short Barrel Rifle (SBR). Since I already have a pistol, and a carbine, I figured the logical next step is to have a registered SBR. That way, I have all the bases covered and can mix and match as my heart desires.

I thought it would be interesting to chronicle this process for anyone who would like to read about it. I also went ahead and sent my lower to Orion Arms to get the requisite engraving done on the lower. I think it cost some $20 to get the lower engraved. They do a nice job, and the engraving fulfills the requirement as laid out by the BATFE. When I got it back, I built the lower with a lower parts kit and set it on a shelf. This all happened in the winter.

I finally got off my duff and started the paperwork for registering the lower via the BATFE.

I went to the ATF website and downloaded the PDF from this page. The form I use for constructing a SBR is 5320.1.

I'll give you the line by line of how I filled it out. I'll put the field number and what I wrote in the field for the process I used.
1. Checked box A. Tax Paid.
2. Checked box Corporation or Other Business Entity.
3a. Trade Name: Entered the name of my LLC as it shows on the Certificate from the state.
3b. Company name with address of record. Matches the Certificate from the state.
3c. Left blank.
3d. County of the address in 3a.
3e. My current phone number.
4a. Spike's Tactical Apopka, FL (Exactly as it appears on the Receiver.)
4b. Short Barrel Rifle
4c. 5.56 Nato. (My understanding is even if you plan on making multiple calibers, you need to put in ONE caliber.)
4d. Model: ST-15 (Exactly as it appears on the receiver.)
4e. 7.5". (Measure by putting a cleaning rod into the end of the barrel against the closed bolt face to the end of the barrel. DO NOT include the length of the flash hider/threaded muzzle device unless it is permanently pinned to the barrel.)
4f. 27.75" Length from the muzzle of the barrel to the end of the stock with the stock fully extended. Of course you CAN NOT build the gun to get that measurement. What I did was measure from the front of the barrel to the back of the receiver, and then the back of the receiver to the end of the stock while extended and added those together.
4g. Serial number as it appears on the receiver.
4h. Any other engraving on the lower. Be as specific as you want to.
4i. "All legal purposes."
4j. NO. (This rifle has never been on t he NFA Registry before now.)
5. I don't have a Federal Firearms License. I left this blank.
6a. I left this blank as well. I actually called the BATFE. I am registering this rifle to my LLC, so I wondered if I needed an EIN for my LLC before I could get the application done. I was told this is ONLY for FFL's. Other LLC's need not fill this out.
6b. As noted in 6a. This was left blank as well.
7. My Signature.
8. My printed name. Partner, of "Goofball enterprises", LLC
9. Today's date

That's it. There is a small blurb below box 6 that states: "Important: All individual applicants (including Federally Licensed Collectors) must complete the reverse side of this forum and submit, in duplicate, FBI form FD-258, Fingerprint Card."

So applying as a LLC saves you the hassle of answering a bunch of questions, getting fingerprints, getting passport size photos, and getting your Law Enforcement Officer signature. (Which is a big pain in the ass for some municipalities.)

Some things to look out for:

I went ahead and got a cashiers check made out to the Bureau of Alcohol, Tobacco, Firearms and Explosives in order to leave a record and make sure the funds are there. I haven't bounced a check in my life, but I don't DARE bounce a check to the government. I'm not that brave. I always make sure I send SECURED FUNDS.

Even though the instructions indicate you need a check of $200, if you are doing more than one at the same time, you can write just one check.

If you are sending more than one application at the same time, in the same envelope, you can send only ONE copy of your Certificate of Incorporation.

Make sure you print the front and back of the forum on ONE SHEET OF PAPER front and back. They will not accept it if the form is printed on two different sheets.

Your application must be made IN DUPLICATE. Each one needs a real signature in INK. If you are going to fill one out, and photocopy it, make sure you sign both copies AFTER you copy the forum.
