Call the store manager in, Also report them to the ATF, and Dept of Agriculture, "that's wh handles business licenses in FL" www.fl.gov, It's not legal to withold a paid for weapon from a licensed carry holder. You actually may call a local deputy, "let themtry and explain stae law to them", it's not optional, anyone who has a valid license walks with whatever they purchased, it's not optional.
If they violate the law they can be shut down.

Any FFL can have any business rules like this, perfectly legal.
 
I have purchased 3 firearms from WalMart in the last 3 weeks. I was in and out in 20 minutes each time. They do have a silly policy about managers carrying the firearm out the door for you, but no delay. This is in NE Tennessee.

OP is in Florida. Regional or district managers may set different policy.

I know, but the item in question was if it is a WalMart policy. It isn't corporate.
 
Several friends and neighboors bought 22's and shotguns at Wallmart in Vero and there was no such law in effect. Call the state and ask them.

The Florida Constitution, Art VIII Sec. 5(b), permits counties to enact ordinances that require a criminal history records check and a 3 to 5-day waiting period when any part of a firearm sale is conducted on property to which the public has the "right of access",[18] such as at a gun show conducted on public property. These local option ordinances may not be applied to holders of a concealed weapons permit/license.[19] Only Broward, Palm Beach and Miami-Dade counties have enacted such ordinances.

The OP said it was a Walmart rule, noting at all to do with the law. Each store can have certain policies different than others.

Call the state and ask them.

Again, how is this relevant to the discussion? Also, the list of counties is not current.
 
For a 930 I would have waited a week. Silly people. But I guess pride is more important than patience. Only had to wait 24 hours for the PA-459 I bought last week. (Cabela's in Illinois) And they call us the gun un-friendly state! (LOL)

What counties are you talking about, In Palm Beach, Martin, Indian river, PSl you may walk in and buy a rifle and walk out with it, isn't that what you said you can't do?
If you just want to argue I am too busy. It's like a bad Fedex store, you got someone who doesn't know the law.
 
As of today, you may walk into the Wallmart in Vero, plunk down your 400 and change, and walk out with your shotgun, with no liscense of any kind. This is the current "non policy", they do a 30 minute proprietary background check, and you get your long gun and leave with it, the two gentlemen in the gun section said their check takes about 30 minutes.
Ammo is stocked at 8PM, every night, and disappears fast, they have more 223 than 22, and mucho 12 gauge and 45. The rest including 40 is iffy at best.
They do sell a "cricket" 22 caliber rifle, "kid size" for 100 bucks. Which is a good deal if you wanr a small semi auto 22. Plenty of scoped bolt guns,and 12 gauge pump, semi auto and lever action long guns. More decent scopes than I have seen prior to today. "not anything great, but a few Nikon and Leupold cheaper models.
So there is no 3 day wait of any kind, nor did they hear of any such wait in other stores.
If you need 223 I know they will have some tonight as I am going back for boxes of 20 for 12 dollars, "hopefully they will have some left".
But any Fl guys who are up this way now have the info straight from the employees who work there.
I am accumulating all ammo as it comes down, like averaging in when buying stocks, this way I don't get killed if it takes off on me, or drops way down, "which i don't see happening unless guns dissapear.
 
This is a new rule to me. Must be WM policy or an uneducated employee. I'm always in and out in no time at Walmart.
 
No the employees are the same guys that have been there for the 4+ years I live here. They were both standing there while the one discussed this with me. Just their own 30 minute check. I said ,"so I can buy that shotgun and walk out with it" and he said yes.

No they don't. They conduct a background check by calling the FDLE, just like every other FFL in Florida, in accordance with 790.0655, Florida Statutes. :banghead:
 
Why are they allowed to override the state pre-emption law?
Article 8, Section 5(b) of the Florida Constitution:
Each county shall have the authority to require a criminal history records check and a 3 to 5-day waiting period, excluding weekends and legal holidays, in connection with the sale of any firearm occurring within such county. For purposes of this subsection, the term “sale” means the transfer of money or other valuable consideration for any firearm when any part of the transaction is conducted on property to which the public has the right of access. Holders of a concealed weapons permit as prescribed by general law shall not be subject to the provisions of this subsection when purchasing a firearm.
 
So come up to Vero and we will go and buy a shotgun, If I am right you pay for it, and vica versa. These are the wallmart rules locally where I live, they don't know of any other rules.
Also they don't sell handguns, so that is not even an issue. Ammo was out last night just like they said.
