Wis new transfer law

Just read this on the Eau Claire stations web site. can't find actual law or rule.

MADISON, Wis. (AP) -- A legislative committee is set to vote next week on a bill that would allow Wisconsin residents to purchase rifles and shotguns from dealers anywhere in the nation.

Why wouldn't you be able to purchase long guns anywhere anyways? Do you currently have to register them when you bring them in the state or something?

Currently we have to purchase handguns from a dealer that is instate, we can purchase a long gun from a dealer in a state that borders WI.

Wow that's pretty strange. I've heard of states saying you have to register them if you bring them into the state but never an all out ban. Are private sales legal in WI? What if your dad lives in new hampshire and gives/sells you a gun? There's got to be a process right? Or would you just have to transfer it to your local shop first?

Don't mean to hijack your thread just curious. Sounds like WI is moving in the right direction though, considering their recent passing of conceal carry permits.

Ryan, he's saying that under the existing law they may only buy long guns IN Wisconsin or in an adjoining state. They can't buy long-guns in other states like most state's residents are allowed to do.

This law would remove the adjoining states restriction and let a Wisconsinite buy a rifle or shotgun in PA or TX or AZ or wherever s/he happened to be.

(Handguns are still an in-state deal, per federal law.)

It doesn't matter what state you're in in a case like that. The gun has to be transferred through an FFL dealer in either your state or his. Federal law applies there, not (just) your state's law.

this is a left over from previous federal law that only allowed for interstate sales of long guns to residents of adjacent states by FFLs.

I think that law was repealed in 1986.

Right. The FOPA, that everyone hates because of the Hughes Amendment, was a very good law in a lot of ways. Removing the "contiguous states" requirement was one of those positive benefits.

Exactly, this is just a belated revisionn to WI law to allow under state law what's allowed under Federal Law.


As a Wisconsin Resident my heart sank when I saw the subject line, thinking 'Oh no, univeral background checks?" and so imagine my delight to see that the law is one that's good for us, not bad for us.

Good news (if it passes), but I didn't know we couldn't buy a rifle from a non-contiguous state. How is it that I bought a rifle from Missouri last year and had it shipped to my local FFL? Am I in trouble?

No, as you *transferred it* from your local dealer not the one you *bought* it from.

Under the new law you could have walked into that same dealer and purhcased it over the counter and carried ot back to Wisconsin.
