Community Property vs Gifting Gun

Howdy, folks.
My wife, who recently bought us a Saiga as her first purchase told me that she wanted me to give her a list of what I want for my birthday but she was concerned about that form you fill out when you buy a gun where it says are you buying this for yourself. Since I can't buy a gun in VA we were discussing whether it would fall under community property. I mean she's stolen my guns from the safe, just as I've stolen some of hers. If she says to the clerk that she's getting the gun for her husband, would it be breaking the law?
 
It shouldn't, you can buy guns as gifts with your own money and give them to someone who isn't prohibited all day long.
 
a good way of describing it is if you are buying the firearm as a proxy for someone else it is not allowed.
 
fill out when you buy a gun where it says are you buying this for yourself.

It doesn't ask you if you are buying the gun for yourself, it asks if YOU are the purchaser of the gun.

If you buy it to gift then YOU are the purchaser, since it's your money.

If some dude in the parking lot gives you 200 bucks and you buy it for him, you are not the purchaser.

It never asks who the end user will be.

If she can legally buy the gun then everything is ok. She buys the gun, then gives it to you. Its a gift. Nothing says she can't give you a gun. If you were a convicted felon and she knowingly gave you or sold you one, thats different.

Why cant you buy guns in VA?
 
Not a VA Citizen but she is. Met her when I was stationed here. On vacation/PCS Leave at the in-law's over my birthday so I can't buy a gun in VA.
 
Even if you are not a resident of Virginia, you can still buy rifles and shotguns.
 
There is no such thing as state citizenship, but there is residency.

Where do you currently live? Where does she currently live?
 
not to sure about the purchase part but on the who owns it part. Who cares. if you are married to her and can legally own a firearm and she buys you a firearm. She may have done all the paperwork. However the firearm is going to go into the safe or where ever you put your guns. She will have the same access to it. She lives in the same roof everything the same so as long as you are married to her it should not be a problem
