DELAY on NICS Background Check for everyone at LGS this afternoon

I went to my LGS today to pick up a couple of transfers and got my first DELAY on my NICS background check. In fact, everyone there to pick up a firearm who did not have a concealed carry permit got a delay during the almost two hours I was there, including two police officers who were visibly upset (in Texas they don't have to call in a NICS check if you present a current concealed carry permit.)

I had to take off work and wasted about 3 hours total to try to pick up my firearms only to be told to come back next week. I can't express how frustrating this is, given that just this calendar year I've purchased many firearms (edited to avoid comments about exactly how many guns I've purchased) without a delay of any kind. Of course there is no recourse to this delay and no reason given for it. This is the first firearm I've picked up since the election and the tinfoil hat-wearing conspiracy theorist in me thinks this may be intentional, perhaps a harbinger of things to come.

Have any of you been experiencing these delays? All I could think on the way back was about a right delayed being a right denied.

You have bought 75 guns this year and don't have a Concealed Carry Permit?
 
If you've bought 75 guns this year I don't think you need to worry all that much about your rights to keep and bear (and buy) arms being infringed.

It should not matter if I've purchased 1000. The number is irrelevant. The fact that there were blanket denials across the board going on is what is the most troubling.

Most of the shooting I do is long range target shooting, so I never felt compelled to get a concealed carry permit. Its only been in the last few months that I've begun to purchase any handguns. Being that I work 6 days a week, upwards of 60 hours a week, it is difficult for me to find the time to take a CC class. I was hoping to find the time to do so over the holidays. Now I pretty much feel compelled to in order to avoid this hassle again.

It wasn't meant to be snarky. Just that I find it interesting someone obviously passionate about firearms doesn't have a carry permit. Even with Constitutional Carry, having a permit allows you to carry in other states. Sorry about the delays btw.

I didn't take your comments as snarky. Almost all of my shooting over the past 30 years, since I got out of the military, has been long range target shooting. It has only been in recent months that I have purchased more than a couple handguns at all. I can't carry at work so I never felt the need to get a CC permit, especially as Texas has been a constitutional carry state for a bit now.
 
Sucks being made to wait. I don't see a deliberate action, but much more likely a computer systems issue in .gov land.
I am sure you are right; at least I hope it is not deliberate. Even so, it is disconcerting to realize your God given rights are subject to the whims of an ineffectual, inept government system. I have other firearms at home to protect myself and otherwise exercise my 2A rights until I can pick these up, but there WERE a couple of first time gun buyers there today who also got delays who don't have that option.

Nope. Ran four NICS checks between 430-5pm all were "proceeds"

Until the USSC rules that the Brady Law is unconstitutional, then get used to it.
 
I bought last week and to wait until today to pick them up. First time I ever had. To wait. Joked with the lgs if I was in a restricted state. :p

I asked a couple other gun shops I frequent today if they were experiencing increased delays and they said it was happening a lot more the last week or so. It seems very suspicious to me.

I was picking up transfers so I've already paid for the guns, but several of the guys today were buying directly from the LGS and got denied. I would not be surprised if they do not come back to complete the transactions.

I'll put my tinfoil hat back on and speculate that if I were a gun grabber coming up with new backdoor gun control strategies, then increasing the number of delays might prove to be effective with dissuading first time and casual gun enthusiasts from actually completing the transactions.

I can understand it if the the background checks were called in, but I have never had a delay when I used their online EZ check.
I had not either. My LGS does all the 4473s electronically. They do probably thousands of checks a month so they have it down to a science and double and triple check everything.
 
Does this mean the BATFE has to be notified of all the delayed people’s names and addresses. Seems to be a new thing. Or is it in the wings and not implemented yet?
I’ve held off buying til I get clarification. I’m always delayed as was my boss, the gun shop owner.

Well, you live in The Glorious People's Socialist Republik of Illinoistan (see what I did there, PapaG?) so, could be that.....

I picked up a Ruger Wrangler Monday, it was proceed directly to the cash register. It was even the "Tactical FDE" version. :eek: It was all they had left, they were running a sale. I had been kicking around the idea of getting one after shooting my son's, and 40 bucks off was a good incentive.
 
I laugh every time I see a post about a delay. Where I live it takes two trips to transfer a firearm. The first trip is to fill out the paper work and the second trip is to pick up your firearm. The wait time is 10 working days so that works out to 14 calendar days. The state has to run a lot of checks, including your medical records, before they will give you a proceed. I've had a carry permit since 1992 but it really doesn't mean much other than I can carry a loaded firearm in a vehicle legally.

My guess about what happened here was caused by a systems failure. I wouldn't get too worked up about it unless I was denied. Then you have a real problem.

I suspect you dont know the difference between a NICS denial and a delay.

No.
A new federal law requires FBI NICS to notify local law enforcement of denials, not delays. If the delay status changes to proceed, there is no notification to local LE.

It is new. Passed this summer and signed into law. It's the NICS Denial Notification Act of 2022 and there are numerous threads here on THR.

When Connecticut DPS revamped their system a couple years ago everyone was delayed on background checks and the LGS couldn't even get through to DPS. I left the gun in LGS safe and he called me five days later after finally getting through to Ct DPS.
