Transfer goes through, the guy comes back a denied, chances are, I'm hosed. Someone has to take the blame, and sh** flows downhill.

Paranoia isn't a valid business practice. Where have you seen anything from BATFE saying a dealer will be accountable if a denial comes back after the three business days? The law allows the transfer to proceed at that point, and unless you have a valid contractual reason to stop the deal, you really have no basis to refuse. Esp. if money has already been paid.

I want dealers to abide by the law, but I don't want them to add new restrictions that aren't already there.

No doubt. But given recent events, I'm glad I'm not an 01FFL.

Your skirts would be clean as a whistle with the BATFE. Katie Couric would be a different matter. If Cho had gotten his approval via an "expired delay" I would expect a lot more onerous activity on the "NICS improvement act" than we're seeing.

Arbitrarily changing a delay into a denial isn't acceptable. Being the poster child for a worldwide digital lynch mob by arming a bugnut "that didn't get approved" would be unpleasant. This is what people used to call a "first class anxiety". Conducting the transfer in accordance with law after the delay runs its course is the right thing to do but it should maintain a brisk trade in ulcer and blood pressure medication.
 
Well, it took two frickin days, but the FFL Dealer just called and said the approval came through. So I will pick up the rifle after work. Thanks everyone for your suggestions and support!

The FBI takes the blame in that case. I've had this happen once. You get a senior officer who basically says, "Um....er...turns out that was...um...denied." The FFL turns over a copy of the 4473 to investigators, and then it's in their hands to mop it up.

So long as nothing was blatantly suspicious in the transaction, the 4473 was done right, and the dealer made the call correctly, it cannot wash back on him.
