Assemblyman William D. Payne (NJ-29,D) has authored a bill for the 2006 legislative session, which would, "Prohibits the sale, importation, possession and carrying of handguns except by certain authorized persons."
I am still digesting the bill but am immediately struck by the redundancy of the synopsis. Sale, importation, possession, and carrying of handguns are ALREADY prohibited except for certain authorized persons.
After my first reading of the bill, in a nut shell it would:
1) Prohibit you from bringing a handgun into this state under pain of felony. Section 12 does allow for some minimal protection under the FOPA but this poor guy would probably be enjoying a taxpayer funded 5-year vacation in New Jersey complements of the taxpayers.
2) Disallow you from keeping a handgun in your home or place of business
3) Limit pistol purchase permits to only the enumerated persons in section N.J.S. 2C:39-6 (police, military, national guard, federal LEO, etc) that previously exempted persons from N.J.S. 2C:39-5 weapons possessions rules. The only exceptions would be:
Anyone losing their qualification to possess a handgun has 5 days to surrender it and along with its certificate of ownership (see next item) to your chief of police. Or if you notify the police you intend to transfer it to a qualified person, you have 60 days to do so.
4) Require you to obtain a "certificate of ownership" for each gun you own. IE, mandatory registration that needs to be renewed every three years.
This bill makes me absolutely nauseous. What a hateful piece of vomit.
There is not a single, reasonable thing about it. This is modeled after UK and Australian gun control in the worst fashion.

b) Those persons exhibiting "justifiable need" which as we all know is already a farking joke when it comes to the NJ shall-issue rules. NOBODY qualifies for justifiable need in this state. NOBODY . Justifiable need would still require the same two-stage process as a concealed carry permit. First you must convince your chief of police or state police that you need one, if they approve, you then get to try to convince a superior court judge that you do in fact have justifiable need. How many concealed carry permits have been issued in New Jersey? According to Clayton Cramer, only about 300 with most of those going to retired LEO, not to people demonstrating justifiable need.
