Just moved to NC and not too familiar with the victim disarmament laws here. Is it "legal" for someone under 21 but over 18 to sell a handgun FTF to another NC resident with a NC CCW permit? The seller is a Mecklenburg country resident.
It appears that it might be legal for someone under 21 to acquire a handgun from a source other than a licensed dealer, but I would not want to stake my future on that kind of interpretive assumption. Rather, they look to the federal standards for such restrictions. Under federal law, at 18 U.S.C. § 1922(b)(1), federally licensed gun dealers are prohibited from selling handguns to persons under the age of 21. Further, all other purchasers of shotguns and rifles are required to be at least 18 years old.
North Carolina General Statute § 14-269.7 provides that it is a misdemeanor for any person under the age of 18 to possess or carry a handgun.
Anyone who purchases a handgun must have a handgun purchase permit or a concealed handgun license - regardless of the source of the handgun.I thought you didn't need a permit if its a private sale between individuals. Is this not correct?
