URGENT ALERT -- YOUR IMMEDIATE ACTION REQUIRED

SPEAKER OF THE HOUSE TO DECLARE THIS WEEK AS "GUN CONTROL WEEK" IN THE ILLINOIS GENERAL ASSEMBLY
*

According to information obtained by the ISRA, the gun control movement
plans a final, all-out push to destroy your rights and take your guns
away from you this week in the Illinois General Assembly. Under orders
from Chicago Mayor Richard Daley, Speaker of the House Mike Madigan may
require that the House of Representatives remain in session until it
passes Daley's 2010 gun control package. Among the bills that Daley has
demanded that Madigan get passed are the following:

* HB180

<http://ilga.gov/legislation/BillStatus.asp?DocNum=180&GAID=10&DocTypeID=HB&LegID=40197&SessionID=76&GA=96>*
-- a scheme to run gun shops out of business by forcing shops to get
licensed and comply with a slew of burdensome regulations.

* HB5480
<http://www.ilga.gov/legislation/billstatus.asp?DocNum=5480&GAID=10&GA=96&DocTypeID=HB&LegID=50534&SessionID=76>*
-- would ban private firearm sales and force citizens to process private
sales through licensed gun shops. (Yes, those are the same gun shops
that will be run out of business by HB180 above)

* HB5495
<http://www.ilga.gov/legislation/billstatus.asp?DocNum=5495&GAID=10&GA=96&DocTypeID=HB&LegID=50564&SessionID=76>*
-- would prohibit law-abiding citizens from purchasing more than one gun
per month. Of course, criminals are exempt from this gun-rationing scheme.

* HB5751

<http://ilga.gov/legislation/billstatus.asp?DocNum=5751&GAID=10&GA=96&DocTypeID=HB&LegID=51102&SessionID=76>*
-- would give you 90 days to surrender all your semiautomatic rifles,
pistols and shotguns to the state police or face felony prison time.

* HB5849
<http://www.ilga.gov/legislation/BillStatus.asp?DocNum=5849&GAID=10&DocTypeID=HB&LegId=51468&SessionID=76&GA=96>*
-- would make it a felony to use a case other than one designed for a
firearm to transport it and give the police greater power to confiscate
your guns for "improper transportation" even if you have committed no
other crime.

* HB6123
<http://ilga.gov/legislation/BillStatus.asp?DocNum=6123&GAID=10&DocTypeID=HB&LegId=52103&SessionID=76&GA=96>*
-- would make it a felony to sell a firearm to someone who looks like a
gang member (ie: Black, Hispanic, shaved heads (all races), tattoos (all
races), motorcyclists (all races), etc.)

Daley wants these bills passed once and for all before the McDonald v
Chicago decision is handed down by the U.S. Supreme Court later this
summer. He will spare no expense or dirty trick to get these bills
passed THIS WEEK.

*HERE IS WHAT YOU NEED TO DO TO SAVE YOUR GUNS:*

1. Phone your State Representative and politely tell him/her that you do
not support any of the bills above or any other gun control legislation
and that you'd appreciate it if they would vote against all gun control
legislation. If you do not know how to contact your legislator, then
follow this link: Illinois State Board of Elections website

2. Copy this alert and send it to all your friends and tell them to act
today!

3. Please post this alert to any and all internet blogs and bulletin
boards to which you may belong.

4. The ISRA needs to raise $150,000 by July 4th in order to defray
expenses of fighting Daley in the General Assembly. That is why we badly

* HB6123
<http://ilga.gov/legislation/BillStatus.asp?DocNum=6123&GAID=10&DocTypeID=HB&LegId=52103&SessionID=76&GA=96>*
-- would make it a felony to sell a firearm to someone who looks like a

This doesn't seem remotely legal, even beyond the extremely thin ice even by today's "standards" of constitutionality.

And will McDonald put some teeth into the 2A, like prison time for violating it? Not that Chicago politicians are unfamiliar with prison...

Acknowledged...

calls in to Murphy and Mathias. Regardless of how stupid the proposed legislation may appear, judge it against the logic in this current condidtion:

To buy a gun in Illinois, I must first obtain a FOID. (background check and issue by Il. State Police), then complete 4473 at purchase time to start background check.

Then if background is re-approved, wait 24 hours for a long gun and 72 for a handgun. (This "cooling off" period is to limit "passionate, angry purchase prior to heinous act.)

As a FOID holder, I have previous purchases, and waiting only adds to my anger and passion. That is to say, none of the guns I own are up to the task planned. :cuss:

This given the 113 dead Chicagoans who testify to the inefficiency of gun bans for the law abiding. Now 2 Chicago state reps want National Guard to patrol the mean streets and provide targets for the criminals.:fire:

These "new" acts will do less than nothing to stem the bloodshed, but only affect gun owners outside Chicago who are lawabiding!
Another reason to not elect Democrats in illinois. 50 years of control and power has robbed them of their ability to use logic, see clearly or care for anything other than their re-election and campaign coffers. Republicans in Cook county are complicit and unless we change everything at the ballot box November 2, we will lose the cartridge box soon after!

* HB6123
<http://ilga.gov/legislation/BillStatus.asp?DocNum=6123&GAID=10&DocTypeID=HB&LegId=52103&SessionID=76&GA=96>*
-- would make it a felony to sell a firearm to someone who looks like a
gang member (ie: Black, Hispanic, shaved heads (all races), tattoos (all
races), motorcyclists (all races), etc.)

So, profiling people based on appearance is considered bad when it comes to cleaning out all of the illegals and sealing off the border... but is justified when it comes to gun sales? Interesting "logic". And so the hypocrisy of the left shines again.

This whole list of laws appears to be a final act of desperation for the losing side. Even if they pass these laws, they are exposing themselves to endless law suits down the road if McDonald goes our way.

* HB6123
<http://ilga.gov/legislation/BillStatus.asp?DocNum=6123&GAID=10&DocTypeID=HB&LegId=52103&SessionID=76&GA=96>*
-- would make it a felony to sell a firearm to someone who looks like a
gang member (ie: Black, Hispanic, shaved heads (all races), tattoos (all
races), motorcyclists (all races), etc.)

HB6123 said:
Sec. 24-3. Unlawful Sale of Firearms.
(A) A person commits the offense of unlawful sale of firearms when he or she knowingly does any of the following:
(l) Knowingly sells or gives any firearm to any person who is a street gang member. For purposes to this paragraph "street gang member" has the meaning ascribed to the term "street gang member" in Section 10 of the Illinois Streetgang Terrorism Omnibus Prevention Act.

Emphasis added. Amended section is underlined.

(As an aside, that is really quite a name. I didn't know the street gangs were in league with the terrorists. :rolleyes:)

Looking to said act,

(740 ILCS 147/10)
Sec. 10. Definitions.
"Streetgang" or "gang" or "organized gang" or "criminal street gang" means any combination, confederation, alliance, network, conspiracy, understanding, or other similar conjoining, in law or in fact, of 3 or more persons with an established hierarchy that, through its membership or through the agency of any member engages in a course or pattern of criminal activity.
For purposes of this Act, it shall not be necessary to show that a particular conspiracy, combination, or conjoining of persons possesses, acknowledges, or is known by any common name, insignia, flag, means of recognition, secret signal or code, creed, belief, structure, leadership or command structure, method of operation or criminal enterprise, concentration or specialty, membership, age, or other qualifications, initiation rites, geographical or territorial situs or boundary or location, or other unifying mark, manner, protocol or method of expressing or indicating membership when the conspiracy's existence, in law or in fact, can be demonstrated by a preponderance of other competent evidence. However, any evidence reasonably tending to show or demonstrate, in law or in fact, the existence of or membership in any conspiracy, confederation, or other association described herein, or probative of the existence of or membership in any such association, shall be admissible in any action or proceeding brought under this Act.
"Streetgang member" or "gang member" means any person who actually and in fact belongs to a gang, and any person who knowingly acts in the capacity of an agent for or accessory to, or is legally accountable for, or voluntarily associates himself with a course or pattern of gang‑related criminal activity, whether in a preparatory, executory, or cover‑up phase of any activity, or who knowingly performs, aids, or abets any such activity.

I don't see anything in the proposed bill about race, hairstyle, motorcycles, or tattoos.

<http://ilga.gov/legislation/billstatus.asp?DocNum=5751&GAID=10&GA=96&DocTypeID=HB&LegID=51102&SessionID=76>*
-- would give you 90 days to surrender all your semiautomatic rifles,
pistols and shotguns to the state police or face felony prison time.

This one also seems to be BS.

Amends the Criminal Code of 1961. Provides that 90 days after the effective date of this amendatory Act, it is unlawful for any person within this State to knowingly manufacture, deliver, sell, purchase, or possess or cause to be manufactured, delivered, sold, purchased, or possessed a semi-automatic assault weapon, an assault weapon attachment, any .50 caliber rifle, or .50 caliber cartridge. Provides that beginning 90 days after the effective date of this amendatory Act, it is unlawful for any person within this State to knowingly manufacture, deliver, sell, purchase, or possess or cause to be manufactured, delivered, sold, purchased, or possessed a large capacity ammunition feeding device. Provides that these provisions do not apply to a person who possessed a prohibited weapon, device, or attachment before the effective date of this amendatory Act if the person has provided proof of ownership to the Department of State Police within 90 days after the effective date of this amendatory Act. Provides that on or after the effective date of this amendatory Act, such person may transfer such device only to an heir, an individual residing in another state maintaining that device in another state, or a dealer licensed as a federal firearms dealer. Specifies penalties for violations. Provides exemptions. Provides that the provisions of the Act are severable. Effective immediately.

It is a typical assault weapon ban with all that entails. It doesn't apply if you register your AW with the police, but you can never transfer it to anyone, other than heir or FFL, within state. It is not a blanket ban on semi-automatic firearms.

Looking at the full text, the prohibition on .50 cartridges applies only to .50 BMG.

This sort of misinformation looks bad. It makes us look paranoid at best, or liars at worst. Here's what I found posted on DemocraticUnderground.com:

You heard right, because the bill would ban the sale of firearms to gang members the IRSA says it is discriminatory against African Americans and Hispanics. Meaning the ISRA views most law abiding Black and Brown people as gangbangers or at least looking like them.

There is a relentless push by Illinois Democrats to make gun ownership difficult or impossible. However, after receiving this email from ISRA, I did an on-line search and could not find anything substantiating the story in this email. Does anyone have any solid information?

Everything in the original email of the form <http://ilga.gov/.*> is a URL. You can copy the text within the brackets to the address bar and read the synopsis and full text of the actual bills on the webpage of the Illinois General Assembly.

As I posted above, the ISRA summaries of HB5751 and HB6123 appear to be wholly inaccurate.

Thanks. I am an ISRA member and actually received the email. I think they kind of blew it with this one, particularly the description of the gangbanger bill.

Don't get me wrong . . . there's an extremely strong anti-gun sentiment within the Illinois Democratic Party, a disgusting effort to blame the failings of government on law-abiding citizens who want to exercise their Constitutional rights . . . but ISRA needs to be careful about unsubstantiated hyperbole.

Nonetheless, despite the poor description of these bills, these are actually all added gun control measures that have been introduced in the past year or so in Illinois. Even though there already exists a strong anti-civil rights regime in Springfield, Mayor Daley and his crooked cohorts are relentless in their efforts to divert attention from their myriad failings, by blaming it all on guns.

I grew up in central IL, and I love Illinois dearly. But i do NOT miss crap like this!!!!

This is just sad :( Hopefully McDonald (and subsequent) cases will ease things in IL, INCLUDING getting rid of that asinine FOID card.

The calls do seem to make a difference. I've called my local state rep and have always gotten a return call from her staff. Of course, she's already on our side . . . the people who need to hear the message don't want to be bothered.

There's at least a glimmer of hope for some positive change, but it's only because the state is perilously close to political and financial collapse that anyone is paying attention. Nonetheless, the Chicago Machine is hugely influential, and will continue to press for draconian gun control measures.

The Illinois House has just released these bills onto the floor for debate.

WOW that is just crazy insane. Profiling at it's finest. Again WOW!!!!!

From your source:

Synopsis As Introduced
Amends the Criminal Code of 1961. Provides that it is a Class 1 felony to knowingly sell or give a firearm to a person who is a street gang member. Effective immediately

I don't see anything that "would make it a felony to sell a firearm to someone who looks like a gang member (ie: Black, Hispanic, shaved heads (all races), tattoos (all races), motorcyclists (all races), etc.) "

OK we all probably agree the gun laws in Illinois could be better as they could most everywhere else too, no need to discuss that.

Is there any update to the legislation that started this thread?

I don't think it went anywhere because I havent heard it blasted out on the local illinois gun forum, but I could be wrong.

OK thanks. Going to close this for now since this is in a forum with a very specific purpose. Would certainly reopen if there is more legislative activity.
