LAPD's DACA situation

The interesting question is a non-citizen placing a citizen under armed arrest. Yet another reason to avoid California - they arm aliens and disarm citizens.
Guess what? I arm aliens every week. Right here in Texas. Legally.
And so do gun dealers across the country for the reasons I explained above.

There are differences between a legal immigrant vs illegal and alien vs citizen.

Permanent residents are required to:
-File U.S. income tax returns as a resident
-Obey all laws of the U.S., states and localities
-Register for the Selective Service (if you are male and between age 18 through 25)



You'll be terrified to learn "non citizens" serve in the US military and have since 1776. :)
 
You'd be terrified to realize you misread/misunderstood what I wrote. And you'd be terrified to know I work with legal immigrant aliens in one of the few Departments that hire on a green card, as long as they are actively working for their citizenship. Twice I have thrown parties for officers who earned their citizenship - didn't see you there. However, we don't have general arrest powers.

That question is, and this would be for lawyers, and Constitutional scholars, is there a Constitutional conflict here or not, and is there a conflict in state laws?
And yes, oh observant one, everyone in what would BECOME the United States in 1776 was an immigrant, BUT, genius, they WERE citizens - of Great Britain. Now, are we done with this sidebar?

I didn't misread or misunderstand anything you wrote.
There is no question federal law does not prohibit a "non citizen" from being a state or local police officer, they clearly allow states to make that decision. There is no Constitutional conflict.
If you spent five minutes on Google you would know that.
 
Seems that California is running out of Cops when they are asking illegal immigrants to put their lives on the line by being LEO's.
Tennessee is too. Back in 2015, some agencies started hiring non-citizens to be cops.


Colorado does it too as does Illinois.


No one wants to be a cop due to poor pay, lack of benefits, and horrible work environment.
 
OK guys,
Let's cut to the chase.
DACA persons are prohibited from possessing forearms/ammunition under federal law.

Nor, under current federal law, can DACA types serve in the ,military.

Under what federal law re-interpretation do those prohibitions simply disappear if a "State' wants to employ them as armed law enforcement ?
Cops charged and convicted for domestic violence still carry guns on duty under the Lautenberg Amendment.


I've personally witnessed officers with misdemeanor DV check out their duty gun at the start of their shift and turn it in at the end of their shift.
 
I see that. I also saw FOP asked the very same question I did when the IL law was signed, though that is specific that only those allowed to work here are authorized to become LEO. I was curious about the legalities of non-citizens arresting citizens, which provoked a HUGE emotional response. Since it is apparently legal, I hope that they make the restrictions stringent. We require our green card officers to get citizenship within five years, IIRC, or they are terminated. We also don't have general arrest powers.
