Gun ban backers get say at hearing

Assault gun ban advocates got their say at a House hearing yesterday, but they were clearly outnumbered during an often-heated debate.

When House Judiciary Joseph F. Vallario ordered Leah Barrett, executive director of CeaseFire Maryland, to stop reading from her testimony and condense her remarks, she was visibly disturbed.

"I urge you to consider the merits of this legislation, and vote with common sense. The House should do the right thing," Ms. Barrett said as Mr. Vallario barked at her.

Mr. Barrett quoted a Gonzalez-Arscott poll showing 77 percent of Marylanders support an assault weapons ban, with 68 of the state's Republican voters also in favor.

Ms. Barrett was backed by Sarah Brady, whose husband was severely injured during the attempted assassination of Ronald Reagan on March 30, 1981. Mrs. Brady has worked for 10 years to maintain the federal ban, which expires Sept. 13.

"Night after night, drugs are used and kids in schoolyards are mowed down (because of these weapons,)" said Mrs. Brady. "We are now facing terrorists, it makes it that much more easy for terrorists (to acquire weapons)."

Hyattsville Police Chief Douglas Holland, representing the Maryland Chiefs of Police, equated a vote on the ban to a vote guaranteeing the safety of police officers.

"Our concern is the support of an officer's safety. These weapons are superior to our officer's weaponry. This bill is very necessary to preserve the safety of the officers," said Chief Holland.

The bill is similar to the federal law and would ban 45 types of assault weapons, including the Bushmaster rifle used by the snipers who terrorized the Washington region last year.

But even law enforcement is divided on such a bill.

State police Lt. Col. Steven T. Moyer pointed out that 34 of 53 law enforcers killed in Maryland in 2003 were killed with handguns.

"The data does not support moving forward with (the assault weapons ban)," he said.

Phillip Lee, of Silver Spring, said there are statistical flaws cited by bill proponents.

"We have one of the most violent states in the union," Mr. Lee said. "We're No. 2 in the murder rate, with 220 times the number of assaults, yet there are no AK-47 deaths, no AR-15 deaths."

The bill should be killed, Mr. Lee said.

Del. Neil Quinter, D-Howard, defended his bill saying he supports the right to bear arms from the Second Amendment, but as a society, people should not have access to nuclear weapons or assault weapons because they are designed to kill large numbers of people.

That's about as fair and balanced as it gets. The Gazzette/Capital isn't exactly known for their conservative views, but in recent months they have printed pro gun letters to the editor, and even a pro gun editorial by one of their own writers.

Besides, they're reporters; they have tp write something hot and controversial regardless of the facts.

Senate Hearings

Just wanted to let everyone know that RiffRaff is at the Senate Hearings in Annapolis and he says they haven't even gotten to the concealed carry yet. He's been there since 1:00PM. He'll post updates when he gets home.
 
I was chatting with some fellas at my local gun shop today and the thing we all agreed on is that we probably won't see ccw this year.

BUT, the important part is that it'll get voted on and we'll see everybody's true colors on the issue. There's a few die hard Democrats that are very pro gun in this area.
 
Maryland AWB SB288-HB1298

Hi everyone!

I just found out about this board from another. Although I'm unable to be in Annapolis for the AWB hearing I have been in contact with the delegates in my district (#31). I was able to speak with Delegates Donald Dwyer Jr. and John Leopold. Both delegates said that they would definitely vote agaiinst the AWB. Mr.Dwyer advised me that he was a sponsor of HB859 regarding concealed carry and that he was trying to get more delegates to sign on HB859.

Early this morning I received a call from Del.Joan Cadden's secretary in reply to a call I made about HB1298, HB859,HB414, and HB251. According to her secretary Del.Cadden is going to vote NO against HB1298 and YES for the other three. (HB859-concealed carry,HB414-repeal of integral safety locks,HB251-repeal of ballistic fingerprinting)

I also contacted Sen.Jimenez, Sen.Gianetti,Del. Theodore Sophocleus(dist 32) and Mr. Vallario. I did receive a letter from Sen.Jimenez stating his opposition to the AWB. I have not received any reply from Sen.Gianetti, Del.Sophocleus or Mr.Vallario.


If we pull together there's no telling what we can accomplish!

you're right in my neck of the woods....I live in Brooklyn Park.

Your delegates are the same as mine and I too received the same responses from them a few months ago...All of them are VERY pro gun....surprising since Jimeno and Cadden are Democrats.

Welcome to THR...check back often; we have a lot of get-togethers at On Target for some good old fashioned gun talk and trying out each others' handguns. We usually start a thread about a month ahead of time. There's a LOT of great Marylanders here on THR.

I just walked in the door a few minutes ago, Not one Anti at the hearing today, not one! Interesting enough the committee members opposed to the bill were not present either.

The antis may just lose this one if they continue to rest on their laurels. Time to start the mail and calls as I believe this will hit the floor. Maryland could just become a shall issue state if we work this...
 
Sorry about the elipses, had to get food, 10 hours at the Senate Office Building, whew. Anyway, the usual lobbyists were there as were a bunch of just average citizens, in all 25 signed up to testify for, none against. The majority of the committee is for the bill with a slight adjustment from a "reasonable period" to 90 days.

Either way a shall issue bill is gonna hit both floors most likely. Now is defintely the time to act, send mail, make calls, do what I intend to do, schedule a face to face meet (hey is a lobbyist can meet with them why can't I as a constitiuant ( I know I can't spell)).

To make my point maybe, call me an optimist, we can achive a suprise victory here. :what:

Riffraff....thanks for the updates.....I wasn't going to hold my breath on ccw, but I'll certainly send more emails, snailmail and phonecalls.

The Senate admitted that all of the public opposition to the AWB is probably what will kill it.

Here's an update from Phil VanCleave of VCDL who was there to support our neighbors:
"Yesterday I drove up to Annapolis, MD and spent the day waiting to
speak on Delegate Dwyer's "shall issue" bill in the House Judiciary
committee. I found out that they were having hearings on all their
gun bills the same day! The turn out was large - around 100 gun
owners and a handful from the other side. There were 3 Virginians
there, including me. Dr John Lott (More Guns, Less Crime) was there,
as was Sarah Brady. The mail bill that was discussed was a proposed
AWB that would mimic the Federal law that is going to sunset - thus
taking away the sunset for our neighbors to the north. As Sarah
Brady spoke the TV cameras were rolling. As soon as she and the
anti's gave their side, the news cameras packed up and left. The
opponents (pro-gun) then spoke to the committee. The first speaker
was from the MD State Police who said that the ban was a waste of
time and the State Police did not support the ban! Of course there
were no cameras to record THAT testimony. Just when I thought I
couldn't think less of the media, I am proven that I can actually
think even worse of them! Not sure where the bottom of that barrel
is...

A few notes - the anti's were truly obnoxious and whiny, even worse
than here in Virginia. I could not believe how they treated the
committee members. A few conservatives on the committee dared to
challenge the anti's statistics and the venom came out. One lady
from the equivalent of VAHV was particularly bad, talking over
committee members and acting generally like a spoiled little girl
having a temper tantrum. I have to admit that I enjoyed watching her
make enemies. The pro-gun side was polite, well-spoken, and factual.
Pro-gunners vastly out numbered the anti's. A good mix of pro-gun
people - young, old, men, women, black, white, Hispanic,
conservative, liberal, you name it!

Finally, they got around to hearing about the "shall issue" bill.
Somewhere around 70 people signed up to speak for the bill and 1 to
speak against. The 1 against was a no show (almost all the anti's,
including Sarah, left when the cameras left earlier in the day). But
instead of hearing the testimony of everyone who signed up, the
chairman suddenly changed the rules and after hearing about 10
people, including John Lott, they simply ask the rest of us to raise
our hands if we supported the bill. So after a 4 hour drive up and 4
hour drive back and 7 hours waiting to speak, I never got a chance to
do so. Fortunately I was prepared for such a scenario and I had
provided a handout to all 35 committee members describing Virginia's
success with "shall issue" and a color map of the states that have
concealed carry permit laws.

Delegate Dwyer apologized in the hall to those of us who did not get
a chance to speak. It wasn't his fault - the committee chairman was
playing games. MD gun owners have managed to get some key
anti-gunners unelected (including the previous Speaker!). Looks like
they have more to do (just like we do in our Senate).

It looks like the AWB and "shall issue" bills are tied just like
HB530 and SB660 here in Virginia, except the tie is that both the AWB
and "shall issue" will die in sort of a mutual suicide pact. We'll
see. I still have my fingers crossed that MD will do the right thing.

I will keep an eye on things up there and let you know what eventually happens."

So the antis are committing Drive-By Appearances now, Huh?

Hey people,

filing my range report regarding 3/17 hearings on the senate side. Long day. Our bill,SB-137 was the second to last bill to come up. A lot of our guys had been there since about mid morning,Drove some distance,but we hung tough. Did the chairman of the committee make us wait all day into the evening to testify because he's a rabid anti-gunner? It wouldn't surprise me . I actually didn't get up to testify till about 7:40. Didn't do well in my opinion, but I got my point across.

Interesting to note that MSP is not in favor of Shall Issue for Maryland citizens. They still want to regulate who get's a permit and who will not get a permit.

Senator Mooney was questioned at length about the language of his bill by another senator. Many very good points were bought up supporting Shall issue by just about everyone who testified. Retired MPD homicide Captain Hennessy who is now a delagate testified on SB-181 witness and victim intimidation and bought up several points that coincided with our bill.

Senator Nancy Jacobs again was a big help asking questions and getting answers regarding shall issue that otherwise would not be considered by other senators on the committee.

SB-662- the ballistic handgun requirement-shell casing-repel was withdrawn at the request of the MSP. MSP wants to study this and announce their findings sometime within the next year. More money into a black hole. Go figure.

I believe we did some good over the past two days. I was honored to stand with you folks and fight for our rights. I had the pleasure of meeting a lot of good people. For you folks who couldn't make it, we knew you were with us in spirit. We got their attention in a BIG way.
But it ain't over. We gotta continue with the phone calls,letters, E-mails,even visits to our senators and delagates if possible.
If we don't get what we want this year,let them know we'll be back next year and the year after that if need be. I damn sure will.
 
Whew, what a long day. Didn't roll into Hagersbush until 10:30 last night. Sort of feel like I was run over by a truck. Good old Senator Frosh did his level best to make our testimony a war of attrition, hoping that the long delay would reduce our numbers. NOT SO! We spoke our piece, well-dressed, polite citizens willing to stand up and be counted. Guys and girls, my hats off to ya. Well done. We may not win this year, but sooner or later, we're gonna get 'em. Keep writing letters, make phone calls, send emails, GET INVOLVED. THE RIGHTS YOU PRESERVE, MAY BE YOUR OWN. To the High Road members that I met, it was a pleasure. Cliff, as always, it was good to get together with you again.

The legislative graveyard is the House Judiciary Committee, ever led by Chairman Joseph F. Vallario Jr. of Prince George's County, a lawyer whose practice happens to include representing drunk drivers.

Those same lawmakers had already created a loophole that allowed judges to review -- and reduce -- any mandatory sentence at the request of convicts. The review process was created in 1999 at the behest of House Judiciary Committee Chairman Joseph F. Vallario Jr. (D-Prince George's), who has made his living as a defense lawyer since 1964.

Since taking the committee's helm in 1993, Vallario has gained almost mythic status as the General Assembly's ultimate arbiter on crime and punishment.

"He's the litmus test," said Montgomery County State's Attorney Douglas F. Gansler (D). "We have our meetings, and that's what we talk about: What can we get Vallario to go along with? It affects our ability to introduce laws for law-abiding citizens."

Under Vallario's leadership, the Judiciary Committee snuffed a 1997 effort to ensure that violent rapists spend at least a few years in prison. It killed a bill last year that would have reined in the power of judges to change sentences years after they are imposed. It voted last year to allow the release of murderers and rapists serving life sentences whom the governor has refused to parole. And it has for three years running, from 1997 to 1999, killed efforts to lower the legal limit that determines when someone is driving drunk.

The battle over drunken driving laws resumed last month when the General Assembly began its annual 90-day session. Lawmakers, threatened with the loss of federal highway funds, are expected to lower the blood alcohol standard for driving under the influence from 0.10 to a 0.08. Without a similar federal incentive, an effort to close a loophole that allows drivers to refuse a breathalyzer test with impunity might be in jeopardy.

Nice turnout and response. Sounds like what we had in Urbana, IL when they tried to copy the CA AWB.

Lott, lots of folks here. Good job. Was anyone from GOA, NRA or any other professional group there? I didn't see the press' usual slam about the "very powerful NRA."

Both good and bad--they take a lot of heat for the people doing the work, but they also attract attention now that they've been vilified so much in the press.

Before getting to my main points, I had to say something about this quote from that one article... I must be confused. "These weapons are superior to our officer's weaponry" :confused: I was under the impression, that if our worst fears were wrong (you know, with how the bill is written it can be interpreted to ban all semi-auto rifles and pistols), that this bill would at least ban pre-ban and post-ban civilian semi-auto "assault rifles". Last I heard the police had the same guns plus full-auto real assault rifles available to them. So please someone explain to me how the guns addressed by this bill are superior in any way to those the police have/can have:confused:



I'm sorry guys that I couldn't be there either day- I was still ill yesterday. It sounds like there was a good showing.

I have to say, with the awakening (finally) of MD gun owners and with MD starting to become a more conservative state I have some hope for MD. I may be motivated to stay and fight instead of running. MD Democrats from rural areas are quite often pro-gun, as Howard County becomes richer, it has been becoming more Republican, some of the fastest growing parts of MD are the more conservative western and southern parts (Frederick, Calvert, and Carroll Counties- Anne Arundel is fast growing too, but it is more mixed politically), Baltimore County is becoming less liberal- I actually have some hope that this state will come around.

My predictions:
-This year the AWB will be defeated
-In one or two years the built-in lock law and ballistic fingerprinting law will be repealed
-Within 5 years we'll be shall issue

On the 16th after the Senate hearing, channel 11 news didn't report on the AWB, but they did report on the shall-issue bill, and it was in their first 2 or 3 stories. Even more, it was actually pretty objective. People are becoming aware that this is out there. It may well only be a matter of time.
 
I think CCW is an eventual win everywhere. (Well, maybe not Illinois...)

It's easy to point (even on TV) to many people using guns responsibly---cops, guards, PIs, delivery drivers, cash machine mechanics, business people making deposits, what the heck, who cares? People who need guns carry them.

This case can be made so the majority of people understand it and accept it with very few reservations. And frothing paranoids help us by being frothing paranoids.

But AWs....most people see them in Iraq news, police SWAT, and "extremist Rambo sniper postal mass murders." Harder to do PR. It's not an issue that people will become familiar with over time.

That's why it's really important to NOT let them get a ban through in the first place. You can convince people you "need" a handgun for defense, as the CCW changes show.

But convincing them you "need" a "military rifle" is harder.

Yes, I know "need" doesn't enter into it, but the reality is we're dealing with idiots and politicians.
