NRA Lawsuit against Washington State

Alright. I emailed the DOL on Friday evening about my application and asked for an update. It was 30 days (Feb. 20) from the time I actually mailed it to them and background check and fingerprints at the KCSO the same day. Received this from Jennifer at the DOL this morning.

"Great news we received your application from your Law Enforcement Agency. We will be issuing you your license no later than tomorrow March 23, 2009. Thank you for your patience in this process.Have a great day!"

I don't know if they actually received my background check with my application, but seeing as I will have it probably within a week or so, I don't care. :)
 
HB1052-2009-10 should be heard tomorrow... and a reply from Ross Hunter...

Your assistant asked me to keep in touch if I heard anything new.

Representative Moeller has introduced HB 1052 - 2009-10.

This would appear to clear up the AFL issue for both non-immigrant and immigrant aka Green Card Holders issues with the stated license.

Non immigrants would still be required to get the license, but green card holders would not, which makes sense as the license does in fact violate a legal permanent residents 14th and 2nd amendment rights.

Guys, thank you so much on your efforts. I watched your activity closely and bugged my representative asking to support the bill

Here is the question that I have
I am a green card holder, moved to WA from Virginia about a year ago, and I gave my firearm collection to a friend to keep in Virginia.
Now, when I will gain the right to keep it, either through AFL or if the bill passes - how should I transfer the firearms?
My friend is VA resident, and I'm a Washington resident. Legally he possesses the firearms now. So if I will take it back, it sounds like out of state transfer to me, which (according to the federal law) should go through the licensed dealer.

What do you think? is there a simpler way?
 
Just as I thought, they are hitting this a fix to a "sporting" event so it looks like the Senate Judiciary likes it....

Well..I have applied for my AFL at the WCSO in bellingham...they were VERY VERY CONFUSED...they said they had only seen the AFL application once before. If anyone else has to go there let me know and I will post the problems I had so it will be easier for you...
 
uhhhh...

Shouldn't the government assume people who can legally own firearms are going to only use their firearms in a legal fashion?

Isn't the opposite of that (the government assuming all people are going to use firearms illegally or against them, so ban them) somewhat socialist or communist?

If they're legal permanent aliens, why shouldn't they be allowed to have firearms?
 
It is only WA State that has this law for now... even on the civics exam for becoming a US citizen mentions that we can own firearms...

If HB1052 does not pass, then I hope the lawsuit in August will set things straight.

EFFECT OF CHANGES MADE BY JUDICIARY COMMITTEE (Recommended Amendments):

The law is reinstated that makes it a class C felony for a person who is not a citizen of the United States to possess firearms.

There are three exceptions to this:

1. A lawful permanent resident may possess firearms. A definition of a lawful permanent resident is added.

2. A nonimmigrant alien who is a resident of Washington may obtain an alien firearm license in order to possess firearms. A definition of who is a nonimmigrant alien is added. An alien firearms license is obtained through the sheriff of the county where the person resides.

3. A nonimmigrant alien who is not a resident of Washington does not need to obtain an alien firearms license.



I hope this gets the thumbs up and signed, that way 90 days after signing, we are free and clear !!
 
you sure about #3?

a nonimmigrant wa state resident needs an afl, but it is ok for nonimmigrants who are not wa state residents to carry firearms without an afl?
 
Nope reading the bill amendments

So what this means is
If your a non-resident (H1, L1 etc.) in WA you can't own a gun without an AFL, however if you're a non-resident (Same visa) from Oregon and you're in Washington at the moment, you can own the gun, buy the gun, whatever.

If you're resident (Green card) you're OK.

I find this a most unusual amendment, I'm not sure that it's enforceable, since it could be covered under the Jim Crow laws, since it's specifically making Non-Immigrant Aliens who reside in WA second class.
 
That & I think it has to do with the fact that prosecuting a person from another State only because they are ignorant of the law would get WA State in too deep... That would be along the lines of the case cited about the man Czech that drove up to WA to help move his friends and the WSP busted him for his carry pistol.

It has got to go back to the House first, because the Senate amended the bill.
 
I'm so upset at the DOL i****s.
I was told by Jennifer and Bruce Tanaka that my AFL was issued back on March 23 and should have it in 7 to 10 days. Needless to say, 16 days later and I still don't have it. Talked to Zandra today and she said they screwed something up and it will just be issued today. Now another 7 to 10 day wait.
I'm sure if I hadn't been calling and bugging them that it would still be much longer. I had called a few days ago and she told me to wait and it should arrive. Today, they say there was a problem with them and it is just issued. :-\\
 
Hey Zaharia, I had exactly the same problem although a little while ago.

I was contemplating sending them a note telling them that my Car tab renewal would be forthcoming 30 days after they requested the renewal, then call them 29 days later and explain I'd had a clerical error and that the renewal would now be delayed by 7 days :) but then I went and bought a truck so lost the opportunity. I also suspect that the DOL have about as much sense of humor as they have competence.
