As I understand it, if I ship a firearm interstate to an FFL as a private individual, I should always ship to the premise or mailing address on his FFL/EZ-Check.

FFL's should know this right? And they should never ask to ship elsewhere for whatever reason (e.g. they recently moved).

deadin You are correct on all three assumptions.
No, he's not.
No Federal law or ATF regulation requires shipping to any particular address.

FFLs May Ship Firearms
to Locations Other than the
Business Premises Address

ATF has received numerous inquiries asking if a Federal firearms licensee (FFL) may ship firearms to an address that is different from what is listed on the recipient’s Federal firearms license.

Neither the Gun Control Act (GCA) nor its implementing regulations contain specific provisions requiring that an FFL have firearms shipped to his/her licensed business premises when receiving firearms. Therefore, an FFL may lawfully receive firearms at his/her mailing address, storage location, or other address where the licensee intends to ensure safe and secure receipt of the firearms.

ATF Industry Circular 74-13 outlines “Guidelines for Verifying Identity and Licensed Status of Transferee.” It states, in part that “when the shipment is to be made to an address other than the transferee’s premises as listed on his or her license or on his or her certified list, it is suggested that the transferor verify the address as being that of the transferee.” ATF encourages FFLs to verify to the best of their ability that the shipping address is a valid location where the licensee is prepared to receive and subsequently possess the firearms. This may require that you contact the FFL listed on the license to verify that the address listed is accurate. In addition, if an FFL requires frequent delivery of firearms to an address other than his/her licensed business premises, ATF recommends that the shipping address be placed on file with the Federal Firearms Licensing Center (FFLC) as an additional mailing address. It should be noted that any FFL receiving firearms at locations other than his/her licensed premises must still maintain accurate records of acquisition and disposition of firearms.

Please be advised that there may be State laws that prohibit the receipt of firearms at a different address than what is listed on the license.

OP, if the receiving dealer asks you to ship to an address not shown on his FFL........get that request in writing. It would be VERY unusual for an FFL to use a delivery address not shown on his FFL.

Thanks. I was going off the FAQ posted on GunBroker.

I will follow up with the buyer or transfer this through my FFL. While it is probably legitimate, better to be safe than sorry.

Only ship firearms to the mailing address shown for the FFL license as displayed on the EZ-Check verification web page.

Do not ship firearms to any other address provided by the person who provided you with the FFL number. Federal ATF law requires that you only ship to the address listed on the FFL license and no other address. We recommend that you use the EZ-Check verification, even if the buyer provides you with a certified copy of their FFL license. The information on the EZ-Check verification is always accurate and you should contact the ATF if the certified FFL copy does not match the EZ-Check web site verification.

You must still have at least a faxed copy of the certified FFL license, the EZ-Check web page is for viewing and double-checking that the FFL license information is correct.

The ATF now accepts a faxed copy of a Federal Firearms license as proof of authenticity for verification. This should help to make online firearm transactions easier and less confusing than before. A copy of the ATF newsletter detailing this policy change can be viewed by clicking this link: http://www.atf.gov/publications/newsletters/ffl/ffl-newsletter-2005-08.pdf

Please note that the ATF (and GunBroker.com) recommend that you use the online FFL EZ Check system to verify the validity of the faxed license prior to shipping an item. The shipping address must match the address shown by the online ATF FFL EZ Check system as the mailing address for the FFL license.

The online FFL EZ Check can be used by clicking the following link: https://www.atfonline.gov/fflezcheck/

Yet another error in the FAQ's posted on GB. And yes, there are several, and they cause FFL's no end of headaches.

It's endless .Without Bubbles, Dogtown and other knowing FFL'S, lots of us would be staring through the relentless nightmare of the Graybar Hotel. Thanks for your constant vigilance.

An FFL can request you ship to any address, on their license or not.

Not a -common- practice ... and many distributors will not ship to an un-listed address ... but it is perfectly LEGAL for them to do so.

Personally, I would ship through my FFL, just for the extra peace of mind. If you don't, make sure the receiving FFL will take shipments from a non-FFL…some won't.
