Canton's malicious vendetta against Bartlett was purely retaliatory for his embarrassment of them by posting the dashcam video on the internet. How much money was wasted on this juvenile stunt? The prosecutor, Harless and Diels should be forced to pay the entire cost, including Bartlett's expenses, out of pocket. It was malfeasance in office, pure and simple.

Also the fact that the judge wouldnt let the entire video be seen by the jury wasnt right IMO either. I am glad the judge threw it out before the defense even had to present their case, but , still the judge was helping the DA stack the deck against them and the judge should have never allowed it to be heard in the first place.

That type of thing is happening more and more often: Judges are basically deciding what they want to allow the defense to be able to tell the jury, and if it doesn't fit the judge's 'plan' or whatever, they don't get to tell the jury the truth, the WHOLE truth, and nothing but the truth.

Our 'justice' system/legal system is NOT about justice, or TRUTH in MANY, MANY jurisdictions...it's about DA's/prosecutors, judges, and often the police dictating what THEY think truth should be... but rarely is it the WHOLE truth anymore, especially when rights are actually at issue.
 
I cannot help but wonder how many other poor slobs got steamrollered and convicted of bogus charges by Harless?
This is why he's done as an LE officer. He has lost all credibility in court, and even his past arrests and convictions can now be called into question. He's useless to the department. Worse, He's a liability.

You would hope so, but it's hardly a given.

A few years ago a Chicago cop shot and killed an unarmed man who wasn't even being detained. He lied and made up a "ripping yarn" about being "surrounded" and a "gang" trying to snatch his gun... too bad he forgot about the transit authority video cameras he was standing under.

His "punishment"? A thirty day suspension... followed by a PROMOTION to detective.

It's all TOTALLY dependent upon the culture of THAT police department. I doubt that his [Harless] behavior would be tolerated where I currently live. I'm almost certain it wouldn't be in Berea, Ohio.

However when you consider that this is not the first or even the SECOND video of him having a psychotic break in public, I don't have any illusions regarding the willingness and ability of the Canton PD to police itself. They KNEW who and what Harless is. With two PREVIOUS videos, it's obvious they just don't CARE.

Harless has a disciplinary hearing on 12/01. It was previously deferred because as the union put it, he was "unable to contribute to his own defense". Given the insane decision to go to trial AND allow Diels, his partner to lie on the stand (after lying in writing), I have NO confidence that Harless will be punished in any meaningful way.

The REAL punishment is going to come in the planned civil suit... which the city has virtually guaranteed that they, the Canton PD, Harless and Diels will lose.

The people calling the shots in Canton are dumber than a boxcar full of bags of hammers. Not only did they bring a pathetic loser of a criminal case to trial, they got a judicial finding that they'd violated Bartlett's 4th Amendment rights in the process.

Any REAL punishment of the Canton PD, Harless and Diels is going to come in civil court, and the prosecutor has already stacked the deck against them.

Any word on the outcome of the Harless hearing? IIRC that was scheduled for Dec. 1
My bet, after this latest delay, is that there's collusion between Harless's attorney and the Canton Police Department to drag this out until Harless's fraudulent "PTSD" claim can hit the system. He'll put in to retire on a disability. I don't know if his disability retirement payments can be attached in a civil judgment or not, and so far nobody on the OFCC forums has ventured a guess.

Based on their behavior up 'til now, the City of Canton and the Canton PD will offer Bartlett some contemptible "settlement" which his civil attorney will sneer at. The case will go to trial and they will lose... BADLY.

I can't imagine the money that Harless, Diels, the Chief of Police, and the two idiot prosecutors have cost the people of Canton. It's pure malfeasance in office.

Harless and Diels should be in prison just for their perjury. Everybody else should have to reimburse the city for the money they've wasted on this room temperature IQ vendetta against Bartlett.

And if the officer ever charged someone and testified against someone who has some money available to push for a new trial.

Washington,DC had a flood of appeals of DWI cases when the calibration of the breathalyzers was found to be in error

Anyone with money tried to get back into court, and many succeeded.

I'll let you form your own conclusion about the sum of the total. Needless to say, IMHO, this cop is a danger to any citizen on the streets. And I'm ashamed he's a sworn peace officer of my state.
 
The guy badly needs to be behind bars. I'm really hoping that he winds up being criminally prosecuted, though I realize its unlikely.

Not just unlikely but EXTREMELY unlikely.

Harless has a scam PTSD claim in the works, which he's already used to avoid a couple of disciplinary hearings, the last being on the 1st of December. It's been pushed back for the 2nd time, to the 15th.

It's painfully obvious that he knows he's never going to be a cop again, even if they let him keep wearing a uniform. The PTSD grift is a way to keep getting a [tax free, no less] paycheck, regardless of whether he gets the boot or not.

My bet is that there's collusion between the Canton PD and Harless's attorney to keep dragging this out until they can approve his fraudulent claim.

NONE of this will of course get the City of Canton and the PD off the hook in the coming civil suit.

Here is the official video with audio that highlights the video that stickhauler provided that did not have audio. You can hear Harless say "As soon as I saw the bulge I should have taken 2 steps back, pulled my Glock 40 and put 10 bullets in your fu*kin' ass and watched you drop! And I wouldn't have lost any sleep! And he [fellow officer] would have been a nice witness as I executed you because you're stupid!"
Holy sh*t, that scares the hell out of me. What if that bulge was a cell phone? This cop is insane! This cop would have knowingly murdered another human being just because he wanted to and could get away with it. What a sicko. Officer Harless should not only lose his job, but he should never be allowed to purchase a firearm and should go to prison for a long time. The man is sick. I hope Harless loses everything. The man does not deserve to carry a badge or a gun. He is a threat to society. If the Canton Police Department and the City of Canton want to redeem themselves, they need to fire Harless, prosecute him to the fullest extent of the law, and never let the man carry a gun again for the rest of his life. If Canton wants to fix this, that's what they need to do. Doubt it will happen though as they will probably try to cover up as much as a they can, and if they do prosecute or fire Harless, they will only do the bare minimum. But that's not they should do if they want to earn the trust of their citizens.

  1. Canton hasn't the slightest desire to "fix" ANYTHING. Otherwise they wouldn't have brought the malicious retaliatory prosecution of the victim Bartlett AFTER he refused their "offer" not to prosecute him in exchange for a legal agreement not to sue them. It was extortion and witness intimidation every bit as egregious as if the cousin of a rapist had promised the victim that she wouldn't be killed if she agreed not to go to the police.
  2. Canton doesn't think that Harless actually did ANYTHING wrong (other than get caught). If they did, it wouldn't have taken THREE separate, virtually identical videos of Harless threatening to murder people in order to get him off the streets.
The Canton PD is corrupt, from the very top on down. In their eyes, Harless's only "sin" is having embarrassed them by ending up on YouTube.
 
His supposed PTSD is no reason for him to keep his job. It is reason for him to either lose his job or be reassigned. He does not belong on the streets hiding behind a badge.

I read another article that said the suspect in the video which started all of this mess was not found guilty of failure to notify. I believe he only plead guilty to illegal parking.

CCW permit holders in Canton need to tread very carefully if the city is willing to entertain the idea of bringing a cop like this back into the police department.

I am not sure where you came up with the notion of the city entertaining the notion of bringing back Harless. His attorney has said that the city agreed to arbitration. That was probably a compromise from being sued by Harless. More than likely they feel that arbitration will go well for them and Harless will be short of legal options at that point and so no longer a problem for the city.

Does the public get to be heard in the appeal?
For Harless' job? No likely. The public does not get to be heard for most jobs and behing not hired or not rehired based on non-job related opinions may be very problematic from a legal standpoint. Given that this is going to arbitrator, the arbiter will have the last word and the issue should be resolved. In arbitration, both sides agree in advance to the decision by the arbiter.

Don't be so sure that Harless won't get his job back.

It's GLARINGLY obvious that the Canton PD has nothing worthy of being called a working disciplinary process. Otherwise, Harless would have been dealt with TWO videos ago.

They don't actually think he did ANYTHING wrong... except embarrass them by getting caught.

If Harless can demonstrate that he either wasn't progressively disciplined, that they knew he was mentally unstable and didn't get him help, or both, he COULD come back.

But that's ok. When he finally DOES murder somebody, Canton will offer the survivors less money in a settlement than Harless will get from his sham PTSD claim. And as they have every step of the way, the rank and file of the Canton PD will resolutely stand shoulder to shoulder with him.

Good on the judge. Would like to see that cop share a cell with Leroy from the Outlaws: But that will not happen.

Recently in Lawton, OK the police chief re-hired a cop who had resigned under pressure because of a federal lawsuit that cost the city big bucks: He claimed to have PTSD from a stint in the US military and had physically attacked people he had stopped.

After being re-hired, the cop was on duty for a short time when he attacked a motorist. The motorist was on his way for kidney dialysis. The motorist was hospitalized with life threatening injuries as a result of the attack. The chief of police was given a choice of resigning or being fired: He chose to resign. The cop was also fired.
