Hurricane Irene may bring another hurricane...

This morning I walked into a conversation regarding North Carolina's preparation for Hurricane Irene. This discussion included the disaster prep folks talk regarding a declaration of martial law in the counties east of I-95, which are predicted to be in the path of the storm.

With this declaration or martial law, it was reported on the news that this would permit LE and disaster preparedness personnel to lawfully demand that citizens surrender their firearms. I understood that recent revision to firearm laws in North Carolina clarified that this would not be the result of such a declaration.

Does anyone know the law on this issue? During the few times that one might need to rely on a firearm, are there laws on the books that would mandate their surrender?
 
I live in eastern NC, and am in the direct path of the storm. I have many freinds in law inforcement and I can tell you that isn't going to happen here in carteret county. Period. Not worth discussing.
 
Well that's certainly good to hear because martial law is pretty extreme.

That’s all well and good but the OP is asking about the law are your LEO friends going to ignore the chain of command if the law says to disarm?

So is a large hurricane/related relief. I went down and worked the MS gulf coast for a month after Katrina and you see all kinds of folks.
 
To the best of my knowledge, NC still has the law on the books that prohibits carrying firearms in an area in a "state of emergency". A year or two ago a bill went up to remove this, but I don't think it passed. This one is in serious need of activism.

Edit: Just did some searching - SB 594 from this past session seeks to address both the OP's concern regarding confiscation, and prohibition in state of emergency. It was referred to rules and operations committee and has sat there since April. North Carolinians are still SOL in this regard.

Note Section 7 in today's State of Emergency declaration:

The above SOE declaration appears to be overriding this NC statute:

"It is also a misdemeanor under North Carolina law for a person to transport or
possess, off his or her own premises, a dangerous weapon in an area during a declared
state of emergency, or in the vicinity of a riot. N.C. Gen. Stat. § 14-288.7 A concealed
handgun permit does not allow a permittee to carry a weapon in these areas. N.C. Gen.
Stat. § 14-415.11(c)"
 
Didnt the law that went in effect after Katrina make it illegal to seize firearms in a state of emergency?

Well, any state receiving federal funding. ie all of them.

EDIT Either way, when the Governor declared the state of emergency he specifically stated:

Section 7.

This order is adopted pursuant to my powers under Article 1 of Chapter 166A of the General Statutes and under Article 36A of Chapter 14 of the General Statutes. It does not trigger the limitations on weapons in G.S. § 14-288.7 or impose any limitation on the consumption, transportation, sale or purchase of alcoholic beverages.

Still, they need to get that silly thing (read:G.S. § 14-288.7) off the books before someone forgets to cut and paste Section 7 during the next SOE.

Our church group went to Gulfport many times and we were not supposed to carry even enroute to the state. Everyone left their shooters at home so they could travel 800 miles and stay in unsecured areas at night just to obey the rules. LOL, my bud asked me if I had bought "A" pistol. Of course my answer was an emphatic NO. He slyly grinned and said really--replied "no, I brought three and 800rds because I knew you didn't". Anyone who is idiot enough to travel that far and go where we went without protection deserves what they get.
 
Agree: Glad the the governor made the exception, but it needs wiped off the books...that was the crux of the issue for me.

There are big differences in "State of Emergency"-"Martial Law"-and "Disaster Area" declarations.
 
Just reading the news and saw that it's supposed to hit the Eastern seaboard of the US. Hopefully this ain't a Katrina, but if so hope that you're all safe and have made the preparations for the disaster including self-defense.
 
Me, mine and a few THR members in the area are as ready as we are gonna be in all areas if you get my drift. Wish us luck.
 
Stock market drop one week, earthquake next, then hurricane. All we need now is some zombies. Actually I learned that when your preprepared for natural disastersgetting ready for one is minimal. Got everything lined up in NOVA
 
Bring it :) I'm enjoying the natural disaster stuff. Laughed the whole way through the earthquake... Those of you closer to the shore..... please consider moving a little further inland. Larry, maybe we should move this to tatics??? LOL
 
The City of New Orleans is the entity that was confiscating firearms after Katrina, they finally had to concede it was unconstitutional and make every effort to return all the guns taken, as a result of several lawsuits. Any state or local government that does this will assuredly have legal action brought against it as soon as it hits the news.

Any of you folks in the path of Irene, I would urge you to consider taking a little vacation inland if possible.
 
I had a sister that lived on the oceanfront and had houses totally destroyed on both sides of her two separate times before she listened to me and moved back to a sane area a couple hundred miles inland. Pity those that live there but our good government keeps bailing them out everytime so I guess some will never learn, good luck to them all.

I'm in a wooded area in south Jersey and will spend the day tomorrow getting the chain saw ready and lashing down lawn furniture and other potential projectiles. From the look of the most recent map, the eye should be passing over my house sometime Saturday night. Neighboring Cape May County - 70,000 people - has been ordered to evacuate starting tomorrow. I'm hoping this is like the time I went out and bought a snow blower and then it didn't snow for three years. Good luck to those of you in the path and I hope we're all back here telling funny stories on Monday.
