It is my understanding that WA is one of the few states where even if I could find an affordable one, I could not legally own a fully automatic (ie: M16A1) rifle. I know someone is working on a change of the silencer restrictions, but I've seen no activity on the machine gun restrictions.

The range I'm a member of rents them, however (and has a sign that they have a Class III, although 'License' is a loaded term). I looked but could not find what the criteria is for corporate ownership.

How can a corporation legally own what an individual cannot own/possess/control? And what criteria does that corporation need to meet? I assume I can't form an LLC for the purpose of purchasing an NFA rifle, but can't seem to Google my way to finding out for sure.

Anyone know how this works (ie: corporate ownership of machine guns)?

RCW 9.41.225 - Current law prohibits any person from manufacturing, owning, buying, selling, loaning, furnishing, transporting, possessing or controlling machine guns. Persons violating this prohibition are guilty of an unranked felony. Specified law enforcement personnel and related persons are exempt from this prohibition.

In WA, the only Title 2 firearms a non-exempt person can legally own are AOWs and Noise Suppresssors.
DDs, MGs, SBRs and SBSs can only be possessed by FFL/SOT dealers and Gov/Mil/LE agencies.

The "Class III" signs, you see, indicate that that buisness is a FFL/SOT dealer.

So, if you became a Type 01-FFL Class 3 SOT dealer or Type 07-FFL Class 2 SOT manufacturer and made a business selling/making Title 2 firearms, you could legally "possess" a MG in WA.

I see a lot of musings about an "NFA Gun Trust", and that my local dealer (Wades) does a lot of them. I take it that does not change anything with respect to MGs (ie: still prohibited)?

A trust does not change what type of Title 2 firearms you can legally own in WA.

Why the trust/corporation route to obtain Title 2 firearms is popular is because, a trust/corporation does not need a CLEO sign off on a Form 1/4. Whereas an individual needs to have a CLEO sign off.

CLEO = Chief Law Enforcement Official for were you live (city/county)
