Of course, habitually with out even thinking about it. Else my brush with this kind of experince this past summer would have resulted in a fetching young lass walking into my home while I was just in my scivvies from a shower. Not that it would have been a bad thing, except that she was clearly underaged, and THAT could have caused problems.
 
I think you are still viewing my question from the hypothetical tenants point of view. It sounds like you (as a responding LEO) would have told the maintanence man he deserves to be yelled at, but would you ignore the fact that the man who yelled at him admits to having a gun in his hand? (he doesn't admit to waving it, that's what the MM said)
 
As the Director of a housing project and someone with 20 years in the business I can say that you should expect a letter from an attorney in about five days. Depending on the how aggressive the main office wants to be, you may find that there has been a warrant sworn out on you, if that be the case, I suggest that you not mention being an X-LEO to your cell mates.

Maintenance never got the door open so he could announce himself, you had an open work order and when the maintenance man realized that someone was in the unit, but not answering, he attempted to go away.

Management would be negligent in allowing a hostile, and potentially dangerous work place, if they allowed you to remain on the property.

Edited to add. Years ago, I was maintenance man and was going to help out an old lady who had a big load of groceries. She said if I would go up to her room (413) and get her shopping cart out of her storage room, she would appreciate it. Off I go, the elevator stops and I go to the room and use my master key to get in (I didn’t realize I was on the third floor) about the time I said to myself "Therese no shopping cart in hear" I turn to see the lady from 314 holding a .38! Thankfully she had been raised with guns and knew how to handle it, and she was a good sport about the whole thing.

I think as others here have said, that particularly in this forum "Strategies and Tactics" posters should expect critical responses. What would be the point if everyone responded "Yeah, that was exactly the right thing to do."

In general, I'm a big fan of "creating distance." I've read several posts this morning where people's reaction to condition orange is to actually close the gap! Are people really trying to induce a confrontation?!?

Ok, joking aside let this be my final word on this thread.

I had a guy atempt to make entry into my dwelling, which enfuriated me and I yelled at him.

Perhaps I made a mistake by holding the gun to my side while I yelled at him.

But what irks the crap out of me is all of the blowhards here who think they are God's reigning authority on these matters and who spend their day here critiquing everybody.

These same blowhards will high five and pat some guy on the butt when he waltzes in here and brags about how he fondled his .38 Super 1911 with +p+ ammo in it after he saw some "scruffy dude" in the parking lot and just knew that guy was up to something nefarious.

It is so reassuring to know that we have so many fine citizens out there who go out everyday in public with homicidal thoughts and itchy trigger finger. Some bozo who took a 12 hour course in order to get a CCW permit and now thinks he is a one-man vigilante squad.

Now this isn't a troll...I'm just tired of listening to morons yap about how they had some close encounter while picking up a loaf of bread at the store. Just because some squirrel walks into your view doesn't mean you had a "situation".

P.S. Kevmo if you keep sending me hate mail through my PM box over this thread I'm going to have to whine like a baby to the admins.

You're right. The way our law is written in OK it's almost a get out of jail free card if someone unlawfully enters your home. But no entry was made - just the attempt and that entry by an authorized agent of the apartments where you live wasn't unlawful.

IMHO if you lived in OKC and had shot the guy, Wes Lane (DA) would have charged you with manslaughter at the least - and he's a really pro-gun pro self defense DA.

If you've got a CCW I would strongly suggest you get out the little green book that came from OSBI and study up on the sections that address Felony Pointinf of a Firearm, Misdemeanor pointing of a Firearm and review your class notes. You were outside your residence when you yelled at the maintenance guy. At that point having the gun in your hand (even not pointing it at him) while yelling angrily was at the very least brandishing. A smart lawyer could make the case for Felony Pointing.

You blew it Krinkov. Learn from your mistake, accept responsibility for it and move on.

ASIDE: Your initial post was an implied invitation for the folks here to critique your actions. Sometimes critiques aren't favorable. When they aren't argue the points you want to make calmly and with logic - it'll get you further and garner more respect than the methods you have used so far... even if you don't win in the end.
