The self-refuting Washington Post: “No one needs” a gun 1 in 20 Americans already own
Last Wednesday, The Washington Post published an editorial entitled, “No one needs an AR-15 — or any gun tailor-made for mass shootings.” That piece followed an earlier series of articles about the AR-15 under the heading, “AMERICAN ICON: The gun that divides a nation.” Both efforts were meant to echo and amplify Joe Biden’s call to ban semiautomatic long guns and “large capacity” magazines. They were, however, ironically self-refuting and established beyond any doubt that AR-15s are in fact shielded by the Second Amendment. Meanwhile, the logic of the authors’ arguments (such as it was), had no limiting principles and would inevitably lead to calls for banning ALL guns.

North Carolina Permit-to-Purchase Repeal: It’s Been a Long Time Coming
Two weeks ago, the North Carolina General Assembly passed S. 41, legislation that sought to remove the requirement that all law-abiding North Carolinians apply for, and receive, a permit-to-purchase (PtP) before they could lawfully acquire a handgun in the state. The bill also sought to remove the absolute prohibition on valid carry permit holders carrying handguns intended for self-defense into any church that also has a school attached.

The U.S. now has a majority of states with constitutional carry laws on the books after Florida Republican Gov. Ron DeSantis signed a bill into law Monday that eliminates the requirement for an individual to obtain a permit to carry a concealed firearm.

NRA Asks Entire Eleventh Circuit to Hear Case Challenging Florida’s Law Banning Young Adults from Purchasing Firearms.
For years, the NRA has been litigating a Florida law that bans young adults aged 18-20 from purchasing a firearm. In 2021, a federal judge begrudgingly upheld the law, despite finding that it imposed several restrictions on the people’s right to keep and bear arms while affording very few public safety benefits. The judge, however, felt like he was bound by Eleventh Circuit precedent that forbid him from striking the law.

Update from La-La-Land: Prioritize “Decarceration”
In Los Angeles, the local transit agency has resorted to the desperation tactic of playing classical music in a downtown subway station to see if it has any impact on the crime, vagrants, drug users, and calls to police from transit customers. Even as violent crime (robbery, aggravated assault, and rape) in the metro system increased 24% in 2022 compared with 2021, some politicians feel that ramped-up music is preferable to ramped-up policing. Hilda Solis, for instance, a member of the Los Angeles County Board of Supervisors, reportedly issued a statement to The L.A. Times indicating she supports “safety interventions” that “introduce alternatives to deploying additional armed law enforcement on the system.”

NY Court: “Innovative” Gun Control is Unconstitutional
Our alert last week pointed out that “[g]un control advocates are ceaseless innovators in the realm of limiting freedom,” with one of these original ideas being so-called “red flag” gun confiscation laws. The alert added that these laws are open to challenge, citing United States v. Rahimi, 61 F.4th 443 (5th Cir. 2023), a case invalidating a federal firearms prohibition that, like “red flag” orders, “works to eliminate the Second Amendment right of individuals subject merely to civil process.”

U.S. House Judiciary Committee Advances Pistol Brace Resolution
On April 19, the U.S. House of Representatives Judiciary Committee voted 23-15 to advance H.J.Res.44, which would reign in the Bureau of Alcohol, Tobacco, Firearms and Explosives’ attempt to regulate pistol stabilizing braces. The resolution employs the Congressional Review Act, which grants Congress the authority to disapprove of new federal agency rulemakings, nullifying the rule and prohibiting the agency from enacting a similar one in the future.

Biden ATF Director Supports “Assault Weapons” Ban, (Still) Can’t Explain What that Means
Steven Dettelbach – Joe Biden’s appointment to lead the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) – recently appeared twice on Capitol Hill to argue in favor of that agency’s funding and to answer questions about its priorities and activities. During those appearances he repeatedly underscored he is not a firearms expert and could not himself define what an “assault weapon” is. These were remarkable admissions from a man whose job is to oversee an agency that enforces highly technical federal firearm laws. A reasonable person might ask how Dettelbach can possibly be qualified to direct ATF or whether he occupies that post solely as a compliant puppet to execute the White House’s political orders.

Court Issues Order Blocking Illinois’ Ban on Commonly Owned Firearms and Magazines from Taking Effect in NRA-Backed Case.
In January, the Illinois Legislature passed the Protect Illinois Communities Act (“PICA”), which banned more than 190 commonly owned arms by mislabeling them “assault weapons” and banned commonly owned magazines by mislabeling them “large capacity.” An ILA-backed lawsuit was promptly filed, challenging PICA under the Second Amendment. Today, a federal court issued an order blocking PICA from taking effect, holding that it likely violated the Second Amendment.

The Disingenuous “Assault Weapons” Ban
On April 25, 2023, Washington Gov. Jay Inslee (D) signed HB1240 into law. The legislation is a sweeping, and flagrantly unconstitutional ban on commonly-owned semi-automatic firearms. The law prohibits a host of rifles by name, including America’s most popular rifle, the AR-15, “in all forms.” The prohibition also targets centerfire rifles capable of accepting a detachable magazine and are equipped with one enumerated feature – such as certain popular barrel attachments, grips, and stocks.

Canada’s Gun Confiscation Program in “First Phase”
Late last month, federal Public Safety Minister Marco Mendicino announced “the first phase” of the federal government’s gun confiscation (“buyback”) program, part of the May 2020 ban on “assault weapons.” The Canadian press reports this initial step is a contract with the Canadian Sporting Arms and Ammunition Association (CSAAA), a group representing Canada’s hunting and sport shooting industry, to work with Public Safety Canada and firearm businesses and retailers. This phase, according to the news report, will cover approximately 11,000 now-“prohibited” firearms and related parts held as inventory, which the law now bans licensed retailers from transferring, selling or returning to the manufacturers.

Study: Restrictive Gun Control Laws “Unlikely” to Solve Problem of Youth Gun Violence
A first of its kind study published in late May in the American Medical Association’s JAMA Network Open concluded that community-level “social vulnerability” factors like poverty, unemployment, crowded housing, and minority status were much more likely than “permissive” gun control laws to be strongly associated with a high gun-violence death rate among youth. “Our results suggest that legislation alone, although important, will not address the problem of gun violence in the US and needs to be accompanied by genuine, deep, and long-term investment in historically marginalized communities to reduce inequities.”

Up until 2018, deep blue Vermont was a model for sensible gun laws – meaning they had few and politicians on both sides of the aisle understood the tranquil state didn’t need any. Bi-Partisan House Coalition Votes to Nullify Biden Administration Pistol Brace Rule
There isn’t much Republicans and Democrats in Congress agree on these days, but a Joint Resolution in the U.S. House of Representatives to disapprove the Biden Administration’s pistol brace rule passed out of the House Tuesday with bipartisan support. The measure received the backing of 217 Republicans and 2 Democrats, Reps. Jared F. Golden of Maine and Mary Sattler Peltola of Alaska. House Joint Resolution 44, as it is captioned, now moves to the Senate for consideration.

Stop the Presses! NRA and CNN Agree: Joe Biden Lies on Guns
It’s not often that NRA finds itself in agreement with CNN’s reporting about firearms, but the outlet’s fact-check of Joe Biden’s Connecticut gun control speech last week proved the cable news channel is capable of accurately reporting on guns … when it wants to. The piece noted that Biden “made at least five false claims related to guns, a subject on which he has repeatedly been inaccurate during his presidency.” While we might quibble that CNN actually undercounted the number of false claims related to guns Biden made in that address, their reporting was right on the money in the examples they did cite.

“Smart Guns,” Dumb Policy
In 2002, Democrat lawmakers in New Jersey passed a first-of-its-kind bill to restrict the handguns that could be sold at retail in that state to “smart guns” (called “personalized guns” in the bill). The law would take effect once the state’s attorney general determined that “at least one manufacturer had delivered at least one production model of a personalized handgun to a registered or licensed wholesale or retail dealer” anywhere in the country. Among other things, the attorney general was required to set standards, determine whether a handgun met the statutory definition of “personalized handgun,” and compile a list of qualifying guns which could be sold in the state. (Manufacturers seeking to have a gun approved would have to provide a handgun for testing, pay an application fee, and pay the costs associated with testing the gun to ensure it was a “personalized handgun.”) Wholesale and retail gun dealers would be prohibited from importing into and offering for sale any handgun that wasn’t a “personalized handgun,” but this did not apply to handguns sold or transferred to law enforcement officials in New Jersey.
St. Louis and D.C. Show Gun Control Isn’t About Public Safety
With many prominent government officials exhibiting a flagrant indifference to violent crime, it’s getting harder for anti-gun politicians to pretend that their gun control schemes are anything other than a means to harass law-abiding gun owners. Recent incidents from anti-gun jurisdictions St. Louis and the District of Columbia further illustrate this point.
Examples of Truth and Sanity Slip Past Editorial Process at The Trace
Last month we reported on a surprising fact check by CNN that sought to hold Joe Biden accountable for several false statements he made during an anti-gun speech in Connecticut. Yet perhaps even more shocking were recent articles at the anti-gun propaganda site The Trace that managed to deliver accurate and relevant information on firearm-related crime in America. At this point, it is too early to say whether the latter examples were editorial slip-ups or actual instances of journalistic integrity.
Media, Academics Tout Eddie Eagle-Like Safety Program
On July 17, CNN ran a story with the headline, “A one-minute video reduced kids’ unsafe behavior around guns, study finds.” The item summarized the findings of study published in the Journal of the American Medical Association (JAMA) Pediatrics titled, “Effect of a Gun Safety Video on Children’s Behavior Around Real Guns.”

Biden Administration Stabs Gun Control Partners in the Back with Treacherous Overreach
Moderate members of both political parties are criticizing the Biden Administration for its recent move to defund longstanding scholastic archery and hunter education programs under a recently passed gun control law. The programs, which have no demonstrable connection to crime or violence, are the latest innocent victims of the misnamed Bi-Partisan Safer Communities Act (BSCA). The episode reinforces two critically important lessons that any pro-gun legislator should remember. One: there is no such thing as harmless gun control. Two: Moderates who join forces with anti-gun extremists will eventually be embarrassed by the partnership.

New Details Leaked on Biden Administration’s Upcoming Background Check Power Grab
Last week, we reported on the Biden Administration’s treacherous move to defund scholastic archery, hunting, and marksmanship programs under an obscure provision of the Orwellian Bipartisan Safer Communities Act (BSCA). The BSCA has proven to be the gift that keeps on giving for extreme and persecutory gun control, to the mortification of some of its more moderate supporters who thought they were voting for provisions aimed at reducing crime and increasing access to mental healthcare. Now, details are emerging of Biden’s latest plans to leverage the sprawling, sinister act in his continued pursuit of civilian disarmament. This time the target is eliminating the age-old practice of noncommercial, private firearm sales.
“Real Change” – Canada’s Violent Crime, Homicide Rates Hit Historical Highs
When Justin Trudeau’s Liberal Party was elected in 2015, its official election platform promised “real change” for Canadians. The Liberal public safety “plan will keep Canadians safe and protect their rights, without resorting to the politics of fear or letting ideology trump evidence in decision-making.” On guns specifically, the Liberal Party asserted that the Conservative government, under then-Prime Minister “Stephen Harper has steadily weakened our gun laws in ways that make Canadians more vulnerable and communities more dangerous. We will take pragmatic action to make it harder for criminals to get, and use, handguns and assault weapons.”

Last month, the NRA had the privilege of attending and sponsoring the 12th Annual Legally Armed in Detroit’s Ladies Shoot. This event is the largest, free, women’s shoot of its kind. Most of those in attendance had never fired a gun before. Thousands of ladies partook in this one-of-a-kind, judgment-free event, with the assistance of NRA and USCCA volunteer instructors. This made for the perfect introduction to firearms and firearms safety. Following the event, many showed a deep interest in seeking further firearms training. NRA-ILA has long-supported new NRA Board Member, Rick Ector’s, Legally Armed in Detroit event. Last month, as we set-up at Midwest Shooting Center (formally Top Gun), we were once again reminded of where it all began.

Biden Admin Oversteps Authority to Attack Law-Abiding Gun Owners, Again
Last Thursday, the Bureau of Alcohol, Tobacco, Firearms and Explosives (“ATF”) announced a new proposed rule on the “Definition of ‘Engaged in the Business’ as a Dealer in Firearms.” --the definition that controls when individuals engage in sufficient commerce in firearms so as to need to be licensed under federal law as a Federal Firearms Licensee (“FFL”). Under the proposed rule, Biden’s ATF would go well beyond statutory authority to fabricate presumptions of when an individual needs be an FFL, and the rule itself acknowledges its unlawfulness.

Your Help Urgently Needed! Comment Period Open on Biden’s Illegal Background Check Rulemaking
Your help is urgently needed, as the official comment period on ATF’s rulemaking, “Definition of ‘Engaged in the Business’ as a Dealer in Firearms," began on Friday, September 8. Comments on the rule will be accepted for 90 days, until December 7, 2023. The more comments ATF receives exposing the flaws, false premises, and overreaching nature of the rule, the more ATF will have to answer for if the agency persists in this ill-conceived effort. While it might be true that no amount of well-reasoned opposition will cause the Biden Administration to discontinue its persecution of gun-owning America, thoughtful comments exposing the proposal’s true nature may embarrass ATF into rewriting some of its worst provisions. And if that doesn’t happen, judges will be on notice that ATF was warned of the proposal’s problems when the final rule is, inevitably, challenged in court.

Government Continues to Downplay, Distort Data on Defensive Gun Use
In 2021, John R. Lott, Jr., the president of the Crime Prevention Research Center (CPRC) released a paper on the “serious errors” he found in Federal Bureau of Investigation (FBI) reports purporting to track “active shooter incidents” (ASIs). The FBI’s annual or biannual reports – which aim “to provide federal, state and local law enforcement with data so they can better understand how to prevent, prepare for, respond to, and recover from these incidents” – contained, according to Dr. Lott, critical errors. In one instance, the failure to include “many major missed cases” meant that once those cases were accounted for, what the FBI had presented as a drastic increase in ASIs between 2000 and 2013 was actually a “slight, statistically insignificant upward trend over the 38 years from 1977 through 2014,” and one that was, moreover, attributable to high numbers in a single year (2012).

Update: New Mexico Governor’s Unconstitutional Carry Ban Temporarily Halted, NRA Files Suit
On September 8, New Mexico Gov. Michelle Grisham (D) surprised her political opponents and allies when the politician purported to suspend the U.S. and New Mexico constitutions and state statute using a “public health emergency order.” The governor’s directive attempted to unilaterally prohibit law abiding gun owners from exercising their right to bear arms for 30 days in Albuquerque and the surrounding Bernalillo County.
