Court Partially Blocks Enforcement of Virginia’s Unconstitutional Private Sales Ban
On July 14, a judge in Lynchburg, VA, partially blocked enforcement of the Commonwealth’s new ban on private firearm sales, ruling it effectively prohibits law-abiding adults under age 21 from acquiring handguns, in violation of Virginia’s constitutional right to keep and bear arms. The decision came in the case of Elhert v. Settle.

Czech Government Endorses Human Right to Armed Self-Defense Constitutional Amendment
The Czech Republic continues to be at the forefront of the battle for gun rights in Europe. On July 13, the Czech government announced that it endorsed a plan to enshrine the right of individuals to use a firearm to defend themselves and others in the central European nation’s constitution. The move comes three years after another pro-gun constitutional amendment passed the Czech Chamber of Deputies (the lower house of the Czech Parliament) but failed to receive final approval.

Member Spotlight: Meet the student who was harassed for posting a picture with his firearm
Austin Tong was an average college kid working on his degree from Fordham University in New York City when, last week, he posted a couple pictures on Instagram that made him the target of an irrational Internet mob and a scurrilous university investigation. The pictures he posted – which nearly got him kicked out of school – were of a retired police captain who was recently killed by looters, and one of him holding an AR-15.

Everytown’s Hail Mary
At least, that’s what Everytown did. A Politico reporter used FBI NICS data acquired by Everytown to claim “Blocked gun sales skyrocket amid coronavirus pandemic.” The claim in the article is that the number of people denied the ability to purchase a firearm through the FBI’s National Instant Criminal Background Check System (NICS) has, well, skyrocketed. The title and the first line of the article are pretty similar.

Virginia Shows that State Firearms Preemption is Essential
Much like the rest of the country, Virginians have been buying firearms at a tremendous pace. According to data from the Virginia State Police, there was a 158 percent increase in firearm transactions in June 2020 when compared with June 2019. This came after a nearly 100 percent increase in May 2020 over May 2019. Moreover, research from the National Shooting Sports Foundation, as well as anecdotal reports, suggest that many of these transfers are to first-time gun buyers.

In response to a public expression of lawful political speech, “safety officers” come to the person’s home at midnight to interrogate him. He is accused of intimidation, making threats, hate crimes, and disorderly conduct. He is found guilty and his punishment includes exclusion from the community, suspension of his academic privileges, a ban on taking leadership roles in campus organizations, mandatory meetings with appropriate officials to learn about correct ways of thinking and speaking, and the presentation of a formal written apology, to be submitted in draft form “for approval.”

Last Monday, the U.S. Court of Appeals for the Fourth Circuit reinstated an NRA-supported challenge to Maryland’s convoluted handgun licensing scheme. An earlier trial court decision had dismissed the case on technical grounds, claiming the plaintiffs lacked standing to bring the lawsuit. Three judges of the Fourth Circuit overruled that erroneous decision, finding that a gun store plaintiff has standing to raise a Second Amendment challenge on behalf of its customers. The case is Maryland Shall Issue v. Hogan.

Gun Controllers Try to Hide Joe Biden’s Anti-gun Extremism
With Fall 2020 upon us it is time again for gun control advocates’ quadrennial tradition – dishonestly attempting to convince voters that a brazenly anti-gun presidential ticket does not pose a threat to gun owners. This year the deception is again being backed by longtime Massachusetts anti-gun advocate and wealthy businessman John Rosenthal. Despite both Joe Biden and Kamala Harris’s advocacy for gun confiscation and a host of other draconian gun measures, in a piece for Newsweek with the farcical title, “Individual Gun Ownership Is Not at Stake in This Election,” Rosenthal claimed “[p]rivate gun ownership for responsible citizens will remain unchanged” during a Biden presidency. The piece is in the same vein as others that have lied about the ticket’s anti-gun aims.

Surprise! Prosecuting Violent Criminals Reduces Violent Crime
On July 22, President Donald Trump and Attorney General William Barr announced the expansion of the Department of Justice’s Operation Legend to Chicago in order to combat the increase in violent crime that has gripped the city in the wake of the Covid-19 pandemic, rioting, and sustained de-policing efforts. Describing the effort, a DOJ press release noted, “Operation Legend is a sustained, systematic and coordinated law enforcement initiative in which federal law enforcement agencies work in conjunction with state and local law enforcement officials to fight violent crime.” The release went on to explain that the move was necessary due to a 51 percent year over year increase in homicides in the Windy City.

Biden’s Debate Performance Shows U.S. Supreme Court and Second Amendment on the Ballot in 2020
Since the death of Associate U.S. Supreme Court Justice Ruth Bader Ginsburg in mid-September, the more vociferous elements of the radical left have called for a total transformation of the high court should the Democratic Party capture the presidency and the U.S. Senate in November. These extreme voices have called for an end to the Senate filibuster in order to enable a purely partisan court-packing scheme that would secure a left-wing majority on the Supreme Court. The strategy amounts to a tacit admission of what many have long suspected – that the plan’s proponents view the federal judiciary as another legislative branch of government that is key to ratifying unconstitutional measures, rather than an independent body tasked with acting as the arbiter and defender of the U.S. Constitution.

The FBI released its annual “Crime in the United States report” with crime statistics on September 28th with data covering calendar year 2019. The data shows that crime continued an established downward trend through 2019. The FBI has not yet released any data on crime for the current year.

NY Hospital Study: Shilling for the SAFE Act?
Northwell Health, the largest health system and largest private employer in New York State, has announced a research study called, bizarrely, “We Ask Everyone. Firearm Safety is a Health Issue.” The project will require, as part of routine screening of emergency room patients, asking questions about firearm ownership and guns in the home. Implementation will begin at three Northwell hospitals initially (two on Long Island and one on Staten Island), with plans to expand the program to include “inpatient and ambulatory settings” across all of its facilities.

Spending that Sweet, Sweet Taxpayer Money
The Centers for Disease Control recently announced the projects funded by more than $7.8 million dollars to “Prevent Firearm-Related Violence and Injuries.” This is after the National Institutes of Health funded more than $11 million in firearms-related research from 2014 to 2017.

A recent article on a gun control news site laments that the COVID-19 pandemic has thwarted ballot initiatives to expand gun bans and restrictions. Initiatives in Florida, Oklahoma, Ohio and Oregon have stalled, allegedly due to the difficulty in collecting signatures. “Without the pandemic, we certainly would have been able to collect the signatures that we needed,” says a supporter of the Oregon initiatives.

Law Professors Make Case for Second Amendment Rights in Uncertain Times
Americans have made clear that they value their Second Amendment rights, especially during uncertain times. Faced with the COVID-19 pandemic and then widespread civil unrest, Americans have bought firearms in record numbers. Through September, the FBI had processed a record-setting 28,826,449 total National Instant Criminal Background Check System checks for 2020. With three months of the year still left, 2020 has seen 456,699 more checks than any previous year. In August, the National Shooting Sports Foundation estimated that roughly 5 million Americans purchased a firearm for the first time in 2020.

The Incredible Shrinking Gun Control Message
Throughout the two presidential debates and single vice-presidential debate the moderators did not ask a single question about gun control or the right to keep and bear arms. The dearth of coverage on Second Amendment issues at the debates follows a larger trend. Anti-gun lawmakers up and down the ballot, and even anti-gun organizations, have made the calculated decision to avoid gun control messaging in a year wracked by uncertainty.

Was Bloomberg Group Shamed Into Being (Sort of) Honest?
The gun-ban proponents at Everytown, New York Billionaire Michael Bloomberg’s personal anti-gun advocacy apparatus, have finally begun talking about guns in their political ads. In August and September, we pointed out that Everytown seemed rather focused in its political messaging on things like health care, pharmaceuticals, and school funding. An odd collection of topics for an organization that claims as its primary sales pitch that it “(has) a plan to end gun violence.”

Washington State Firearm Confiscation Law Found Unconstitutional
Earlier this year, in a ruling of first impression in Washington State, the Kitsap County District Court decided that the state’s compulsory “firearm surrender” laws violated the Fourth and Fifth Amendments and the analogous provisions in the state constitution. “In our constitutional system of government, individuals have rights that the government and its agents (including courts) must respect. Among those rights are the right to be free from compelled self-incrimination under the Fifth Amendment, the right to be free from unreasonable searches and seizures under the Fourth Amendment, and their counterparts under Washington’s constitution.”

BATFE Leadership Push Biden to Target Pistol Stabilizing Braces and Unfinished Receivers
Just in case anyone needed further proof that much of the federal bureaucracy is more interested in serving themselves and left-wing political interests than public service, news broke this week that rogue elements of Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) have been conspiring with Joe Biden’s transition team to enact gun control by executive fiat. At the top of these anti-gun government functionaries’ wish list is executive regulation of commonly-owned pistol stabilizing braces and materials used by individuals to make their own firearms –sometimes referred to as unfinished or “80%”frames or receivers.

Bloomberg Scores Another Failure in Big Sky Country
LR 130, a ballot measure to limit local government authority to regulate firearms, was supported by the NRA and approved by Montana’s voters. Voters had to contend with a barrage of misinformation along with the typical outsized spending by Michael Bloomberg’s Everytown for Gun Safety to defeat the measure.

Gun Control Research Methods: Close Enough
Social science methods are not perfect, but that has never stopped anti-gun researchers from making outlandish claims. Most recently, a team of researchers led by Doctor Apurva Bhatt from the University of Missouri Kansas City sought to evaluate the effect of changes in Missouri firearms laws on suicides among teenagers and young adults. Their analysis is burdened by a fundamental disregard of applicable firearms laws and their findings are so suspect that even uninvolved anti-gun researchers have formally acknowledged the problems.

Déjà vu: California May-Issue Gun Licensing Results in Bribery Scandal
On November 23, the Santa Clara County, Calif. District Attorney announced that a grand jury had indicted a county undersheriff and sheriff’s captain for “requesting bribes for concealed firearms (CCW) licenses.” A pair of individuals were also indicted for offering bribes to receive licenses to carry. The story received worldwide attention when one of those accused with offering a bribe was revealed to be Apple’s chief security officer.

In late November, the Trump administration took its firmest action yet to counteract ongoing banking discrimination against businesses that serve America’s gun owners. The Office of the Comptroller of the Currency, a significant banking regulator, issued a proposed rule to prohibit politically-motivated service denials and to ensure large, nationwide banks would have to make offered products available to all law-abiding customers without ideological bias.

Trudeau’s Toxic Gun Ban: No Buy-in to the “Buyback”
Under the Liberal Government’s scheme, over 1,500 firearms and devices listed in a government regulation immediately became a “prohibited” firearm or “prohibited device,” as did “any variants or modified versions.” Individuals in legal possession of these newly prohibited firearms or devices on the day the regulations were announced are protected from criminal liability arising from their possession or ownership, but this “amnesty” period ends on April 30, 2022.

UK: Tory Government Set to Further Regulate Antique Firearms and Air Guns
Under UK law, an individual may not possess, purchase, or acquire a shotgun or rifle without a shotgun or firearm certificate. The onerous application process requires an applicant to divulge sensitive personal information, including medical data and contact information for the applicant’s general practitioner. An applicant must detail their firearm storage arrangements, which are subject to warrantless inspection. The applicant must also provide justification for possessing a shotgun or rifle and two character references.

The “guidance” was officially published in the Federal Register on December 18th. ATF will be accepting public comments on this “guidance” until January 4, 2021.

After Colluding with Biden, BATFE Raids Polymer80
On December 10, agents from the Bureau of Alcohol, Tobacco, Firearms and Explosives raided Dayton, Nev.-based Polymer80. The company manufactures unfinished, often referred to as 80 percent, receivers and frames. There are also reports of BATFE confronting Polymer80 customers and confiscating certain unfinished frame kits. The move marks the first direct assault on unfinished frames and receivers since the news broke in November of collusion between BATFE and Biden's transition team to target these items by executive fiat.
