From the NYSafe Act page -It's a semi auto with a pistol grip and muzzle device. It's not compliant here.
If he didn't own it and register it by 4/15/14 when they were banned for sale, then he would have to be LE or FFL to legally possess (which was the accurate point you had made).
But, if he owned it before 4/15/14 he was not required to give it up if he registered it. Registration before 4/15/14, being an FFL, or LE are the options for legal ownership as opposed to just FFL or LE.
