I post information about my Second Amendment case presently pending at the U.S. Court of Appeals for the DC Circuit (Washington, DC). I am on the threshold of forcing the U.S. Government to the negotiating table with my Motion (laying in wait when my case is remanded to the U.S. District Court in DC) for Negotiated Rulemaking with the U.S. Government. Hamrick (pro se) v. President Bush, et al, DC Circuit, No. 04-5316; appealed from U.S. District Court for DC, No. 03-2160. A Second Amendment case employing the RICO Act to allege the U.S. of racketeering an unlawful and an unconstitutional protection scheme over the Second Amendment.

I have already won remand for further proceedings on Second Amendment grounds but lost my RICO Act claims ($9 mil). However, I filed my Motion for Rehearing & Rehearing En Banc disputing the dismissal of my RICO Act claims. My case is still pending at the DC Circuit.

Interesting read.

Sounds like you're running into something we've found here in MD--the NRA generally won't devote resources where it knows its not assured a victory. Not trying to turn this into "why the NRA isn't doing what I wish it would do" thread, just pointing out that that's what you're up against.

My guess is the NRA is worried the present makeup of the SCOTUS is about one, maybe two justices short of what we need to get a solidly pro-2A ruling.

I would suggest you point the court to the legislature's stance on the 2A; http://progunprogressive.com/?p=141 should be an interesting read for you. In re: S.397, Congress found:

(a) Findings- Congress finds the following:

(1) The Second Amendment to the United States Constitution provides that the right of the people to keep and bear arms shall not be infringed.

(2) The Second Amendment to the United States Constitution protects the rights of individuals, including those who are not members of a militia or engaged in military service or training, to keep and bear arms.
