Man, what is wrong with people ! Was this just a random attack or something else? I guess I would have given him two to the chest.

Are you suggesting that I as an onlooker intervene or What I would do if I was the old man on the ground ? Either way I would have assisted the man or lead poisoning for Mr. Nofreakinclue !
 
It seems that a lot of people are under the delusion that having a pistol on your person is all that is necessary to be safe. Notice that the victim in this story was pinned to the ground and could not get to his pistol? We often hear how most gun fights happen within 7 yards. ALL real unarmed attacks happen within hands reach. Usually just like the one in the story. Either someone gets knocked out within the first few seconds or they end up rolling around on the ground where a pocketed hand gun is virtually useless.
The combat shooting world is full of overweight, out of shape Walter Mitties who can discuss to the nth degree the virtues of this hollow point or that holster but are clueless about how to get out of a simple choke hold.

There is a world of difference between being a "gun fighter" and being a fighter with a gun. Learn how to fight.

How is he and the Misses physically and mentally handling being attacked?
 
I agree with the deputy. Too bad he missed.
Practice with a small sight radius like the Derringer would greatly improve the chances of connecting.

I'd long contemplated one of those NAA mini-revolvers for CCW, but this sort of seals the decision I eventually made against it.
 
What city did this happen in? Daytona? Titusville or Cocoa? I used to live in the Sanford/Orlando area. Scary stuff.
 
As any of the officers who shot at Amadou Diallo will tell you, if you're behind cover, you have an opportunity to wait, see what happens, and respond. If you're out in the open, and you feel you're about to come under lethal atack, then you shoot NOW before the attack can start (or re-start).

As any of them will also tell you, expect to be prosecuted. Comes with the hand you've been dealt.

This attacker may be going for his gun, under the seat. Or another weapon. Or just wants to use his car (a lethal weapon) to run you down.

And you're sitting there, unable to run away or take cover, with a two-shot gun. And you have a duty to protect your wife.

This moment may be the only opportunity to end the attack, before he jumps in the car, closes the door (there goes your shot) and runs you down.

So shoot. Shoot him in the back. Because you believed if you didn't, he'd have killed you in the next instant.

And then go stand trial, and pay all those costs. But, tell you what--I wouldn't convict you.

Stay safe.

(BTW: Shoot and miss is what he actually did, and BG ran away? In that case, his solution was better than mine!)
 
shooting was in Fla according to Fla law he was legally there and had no duty to retreat had he killed the scum no charges filled.
 
The thread is pretty long so I doubt anyone reads this, but here's my 2cp.


- I would fire the first chance I got, with the intent to stop this attacker from attacking more. "Shoot in the back" is Hollywood nonsense. During the course of combat, "backs" are shown again and again. Are you saying a spinning roundhouse kick is half assault, half retreat, depending on where in the spin they are?

- So you wait until he turns around after you "draw a bead" on him, and see he now has a full auto UZI. You miss, he kills you both. But at least you had hollywood honor.

- I shoot when I feel I am in immediate and imminent threat of bodily harm. I definitely would feel that way. As far as I know, you don't drive a car away by reaching under the seat.


This is a no brainer. I have this image of some THR members having badguys back up to them, with them shouting "turn around so I can shoot!"
 
If the guy feared for his life than he has every right to shoot him in the back whether he was reaching for a gun, a lead pipe, or a lolipop. If he turns around with a gun, who knows how many shots the bad guy may get off even if you shoot him with the derringer.
 
Well I wouldnt shoot him in the back because then I would go to jail, but I would yell at him and make him turn around towards me and unload 4 .45 cal rounds in his chest. Id save my other 4 for his friends.
 
A situation like this is exactly why both the wife and I carry all the time. I would shoot him, or hope that the wife had already taken care of it (she is the better shot anyway).
 
I'm in my early 20's, pretty fit, single (so the 'hit my wife' thing is something I cannot relate to like you married types). That said, the scumbag would've experienced the angry end of my Sig P6 at least 9 times, and possibly another 8 if he hadn't been neutralized. I usually consider gas pumps to be red alert areas, but I buy most of my gas on base now, so I don't worry so much about crime and I'm not allowed to carry there anyway. I use either drive-thru ATMs or, if I have to walk up to one, it is with lots of back-up. When we have to hit an ATM, its a group effort of between 5-10 guys. We wait until all of us get our cash, then off to the bar.
 
The circumstances prompting the attack are not clear. If it was out of the blue or a robbery (as opposed to mutual combat from an argument) I think shooting him would be the only safe option.
 
If you've ever had major surgery, you can appreciate how vulnerable it makes you feel. Recovery is slow and painful. Your ability to defend yourself is so severely compromised that even the most minor assault could be life threatening. In my opinion, your friend acted well within reasonable limits. This from a guy who recently recovered from surgery with long walks through my side of town, carrying an LCP in my gym shorts and a very capable neck knife. Early on, I couldn't have defended myself from an angry Chihuahua. A single punch to my stomach could have easily killed me, let alone a full blown attack by a BG with bad intentions. I'd have taken my shot and lived, happily, with the consequences.
 
This is similar to a case a number of years ago where two mopes robbed a fastfood joint. One herded the customers into the back with his drawn gun and the other stayed out front to empty the registers. The thug with the customers momentarily turned around to see how his partner was doing and was promptly shot in the back by an armed customer.

I am not sure that anyone here would say that was "wrong" but I could be wrong.
 
Take aim with cocked weapon and start yelling at the top of your lungs, "Drop it! Don't point that at me! I'll shoot." If anyone is in earshot, they can testify he warned the attacker, who continued the attack.

And shoot him through the chest.

I think Sean Dempsey nailed it as this is the crux of the situation. If I have been assaulted and hurt badly, even if my wife had not been assaulted on top of it!, and the guy is not QUICKLY AND ACTIVELY RETREATING (i.e. he is standing around, loitering, going to car, getting something!!, or otherwise still within range of a handgun), my answer is shoot.

The time when I would not shoot: the BG is RUNNING away and likely out of range of my handgun, since I am injured and on the ground.
 
After punching my wife, I'm thinking 15 rounds spaced about 2 inches apart from the sphincter up...but then, I despise criminals.
 
Shoot him. The BG already attacked someone minding their own business. BG also had the upper hand with the victim already beaten. Sounds like the BG also parked his car very close to the victim's car, indicating to me the BG wanted a weapon close at hand.

Was the BG going for a gun or other weapon of his own? If so then fire away, even if it is into the BG's back. Otherwise...

I'd yell somethin like 'stop!' or 'hey @$$hole', if he turns around fire away.

A shot in the back is gonna look bad.
