Here Comes The Flood Of New Gun Legislation

I hope I'm not off topic. But I didn't find these anywhere else. Back in the special session after the concealed carry act was signed in to law, several new bills were introduced in Illinois. These will be coming up for possible action this session.

ILLINOIS
HB3646 - eliminates "50% of revenue" clause for liquor sales, would prohibit carrying guns ANYWHERE alcohol is sold, period. (Including most gas stations...)

HB3649 - reduces licensing fees of concealed carry from $150 to 100, other cost changes.

HB3650 - establishes concealed carry reciprocity rules, "shall reciprocate" language, provisions for residents moving to IL to honor their CCW for 90 days, etc.

HB3651 - reduces concealed carry training requirements from 16 hours to 8 hours.

HB3669 - increases first time offense of carrying in to a school zone a felony (including colleges and universities, AND including parking areas thereof)

HB3675 - STRONGLY increases penalties for carrying a gun in to a gun free zone.

HB3714 - Establishes state wide 2% tax surcharge on ammunition

HB3725 - exempts federal firearms dealers from concealed carry training requirements

HB3762 - reduces age of obtaining Firearm Owners ID card from 21, to 18 (consent of guardian age change)
 
And on the senate side:

ILLINOIS

Senate:


SB2594 - same as HB 3646

SB2646 - institutes mandatory $100,000 liability insurance for ALL gun owners (with FOID). Provisions to seize or revoke FOID card and firearms if liability insurance isn't maintained.

SB2652 - repeals gun free zone on "Special Events" (concerts, etc)

SB2653 - repeals gun free zones on public gatherings (carnivals, parades, community festivals, etc)

SB2654 - repeals gun free zones for hospitals, doctors offices, nursing homes, etc.

SB2669 - effectively prohibits carrying firearms on ALL private property unless you have permission from owner IN ADVANCE.
 
West Virginia HB4250 looks like an attempt at constitutional carry as it strikes most of the current exceptions for carrying but leaves the phrase 'Any person'

Colorado HB1166 makes minor modifications to the concealed weapons application process that might make it a bit easier

Washington HB2551 would remove text from current law regarding the declaration of a state of emergency that prohibits the possession of firearms during a state of emergency

Kentucky SB88 would prohibit any regulations of firearms in any form by county, city or district boards of health

Utah HB0276 would change existing law to confirm that 'The mere carrying or possession of a holstered or encased firearm, whether visible or concealed,' does not constitute disorderly conduct

South Dakota HB1066 strikes one word, 'not' from Section 1. § 22-14-27 of existing law (carrying in public building) making it a defense to a prosecution that the defendant holds a concealed carry permit

Missouri

HB1535 doesn't have any text yet but the title reads 'Specifies that certain firearms, firearm accessorie, and ammunition be considered instrastate commerce and subject to serial number checks', might want to add this one to your watch list to see what the actual text of the bill is.

HB1539 also has no text yet but the title states it would modify provisions related to safety training requirements for a concealed permit.

Mississippi

SB2478 would decrease some fees for concealed carry licenses

SB2465 would grant enhanced carry benefits for members of the military

SB2657 would add a new section to existing law to authorize gun trusts

Illinois

SB2646 would give authority to the state police to deny or revoke a FOID if the holder does not have at least $10,000 insurance that covers negligent acts

SB2669 would make it illegal to carry a firearm onto private property without prior permission from the owner

SB2653 would remove language about prohibited places (for carrying) in any public gathering or special event on public property

SB2654 would remove language about prohibited places striking 'Any building, real property, and parking area under the control of a public or private hospital or hospital affiliate, mental health facility, or nursing home.'

SB2652 would remove language about prohibited places 'Any building or real property that has been issued a Special Event Retailer's license as defined in Section 1-3.17.1 of the Liquor Control Act during the time designated for the sale of alcohol by the Special Event Retailer's license, or a Special use permit license as defined in subsection (q) of Section 5-1 of the Liquor Control Act during the time designated for the sale of alcohol by the Special use permit license.'
 
Ha! Illinois is trying all sorts of attacks on people wanting to carry. While most other states are making it easier on lawful carry. It just proves even more it's a peeing contest on gun rights over in Illinois.
 
Well, Pezo, there are a few good ones too, but we know they'll never get called to the floor for a vote while Michael Madigan is running the show in the House. Best we can do for now is play defense. UNLESS he wants something else unrelated that isn't too distasteful, then our reps might be able to call the pro-gun bills in as leverage (conservative trading stock.)

Illinois's legislative system is about as corrupt and power-driven as it gets.

Georgia HB807 would allow firefighters to carry firearms on duty (with permission of department)

Kansas HB2473 would set up preemption within the state

New today from Mississippi:

SB2798 would set up preemption within the state

SB2831 would make it illegal for any state or local law enforcement from cooperating with any federal law or regulation created after January 1, 2014

New today from Nebraska

LB1110 would allow active duty military to apply for and receive a concealed carry permit

LB1035 would require the state police to report the number of people denied when trying to purchase a firearm

LB1030 would create the 'State Firearms Rights Act' which includes preemption and nullification of federal firearms laws for any firearm or ammunition that is within the state

LB1027 adds language to existing law about the seizure of firearms when a person is in 'emergency protective custody' and the restoration of firearm rights once the person is released from treatment

New today from Missouri

HB1530 would add changes domestic violence laws adding in provisions that would allow a responding officer to seize firearms

HB1556 has no text yet but it's title is 'Establishes the Missouri Firearms Freedom Act and changes the laws regarding firearms and concealed carry endorsements' - probably worth watching

New today from Hawaii

SB2938 would set up a means of online registration for firearms

SB2957 would require anyone apply for a permit to buy a firearm to provide a medical clearance from their doctor

SB2795 would set up a means for anyone prohibited to petition the court to be removed from the prohibited list

HB2246 is the house companion bill to SB2795

New today from Tennessee

SB1955 removes the requirement for judges to complete training in order to carry a firearm, once again creating a special class of citizen

SB1983 changes language in 39-17-1307 of current law in regards to unlawful carrying of a firearm, it clarifies the law by adding ' A person commits an offense who carries a firearm when such person is otherwise prohibited by law from carrying or possessing a firearm.' and adjusts penalties for the offense

HB1794 is the companion bill to SB1983

HB1827 would stop health care providers from asking about firearm ownership as a condition of treatment

HB1885 has no text yet but the title states 'specifies that the Class C misdemeanor offense of carrying a firearm, knife or club with intent to go armed is committed only if the person carrying the firearm, knife or club is prohibited by law from purchasing, owning or possessing a weapon.'

SB1974 is the companion bill to HB1885

You're information was what prompted me to set a meeting with Minority Leader Congressman Chad Campbell. He was the sponsor for Arizona HB2346.

First time meeting with a Congressman, should be fun. I was impressed he was still open to meeting knowing I'm pretty much opposed to everything he is for. :)

EXCELLENT NEWS Yo Mama! We need more people like you that are willing to get involed to let these legislators know we are watching, good or bad bills face to face, emails and phone calls actually do work.

West Virginia HB4271 would allow the possession of a handgun in a vehicle without a concealed carry permit

Georgia HB826 would remove private schools from current law regarding the possession of firearms

Utah HB0075 would change laws regarding prohibited persons for non-violent felony convictions

Louisiana HB72 would allow the possession of firearms within an establishment that serves alcohol by employees, law enforcement and those with a concealed carry license

Virginia SB39 would require all persons buying a firearm at a gun show to go through a background check

Hawaii

HB2607 is a companion bill to the previously introduced Senate bill making the state a shall issue state

HB2606 would remove liability for anyone that uses justifiable force and is not in the act of a crime

Tennessee

SB2031 would change existing language about storing a firearm in a motor vehicle to 'Notwithstanding any provision of law or any ordinance or resolution adopted by the governing body of a city, county or metropolitan government, including any ordinance or resolution enacted before April 8, 1986, that prohibits or regulates the possession, transportation or storage of a firearm or firearm ammunition by a handgun carry permit holder

SB2158 would create a 'State Interposition Act' relative to the Second Amendment.

Mississippi

HB705 would add language to the laws regarding declarations of a state of emergency that specifically prohibits the confiscation of firearms

HB667 adds language to existing law concerning carrying of firearms that states carrying may not be disallowed at highway welcome centers and rest areas

HB708 adds language to existing law that clarifies that county, or local government may not confiscate weapons during a state of emergency

HB899 would lower the fee for concealed carry permits to $75

HB700 would lower the fee for a concealed carry permits to $50

HB691 would lower the cost for a concealed carry permit to $5 for anyone over 65 & older

HB1019 would prohibit public housing authorities from restricting 'lawful possession' by residents

In today:

Colorado SB100 would repeal the high capacity magazine ban passed last year

Wisconsin people take special note of these two HORRIBLE bills, if passed they would remove just about all means of self-defense in the state

Wisconsin SB511 would remove immunity from civil litigation for those that use deadly force to protect them self, by repealing § 895.62 & would remove the ability to defend oneself and others by repealing § 939.48

AB652 is the companion bill to SB511

Mississippi HB1385 would clarify that weapons shall not be confiscated during a natural disaster

West Virginia HB4310 would make concealed carry permit registrations and application confidential and not subject to disclosure to anyone except law enforcement

HB4288 would set up preemption in the state

HB4308 would set up criminal penalties for any municipality that enforces any firearm law determined null and void (from the municipal home rule pilot program) after July 1, 2014

HB4309 would allow a person to store a firearm in their vehicle at the state capitol complex as long as it is locked up and out of view

Colorado SB135 would repeal article 27 of title 12, removing all language that allows the purchase of firearms in contiguous states.

Illinois HB4319 would add more prohibited places for carrying a firearm including bars, licensed video gaming, licensed fraternal, licensed veterans & licensed truck stop establishments

Florida S0546 would add confidentiality exemptions for information provided to a tax collector by a concealed permit applicant.

Florida H0733 would create the 'Second Amendment Preservation Act', basically nullifying enforcement of federal firearm laws within the state
 
One other in IL House and one in IL senate (in addition to HB4319):

Illinois HB4290 - A certified firearms instructor who provides or offers to provide false certification that an applicant has completed firearms training is guilty of a Class A misdemeanor, not eligible for court supervision, and permanent revocation of the firearms instructor certification.

SB2686 Provides that in cases when the holder of a valid Firearm Owner's Identification Card applies for renewal in accordance with the Act and the Department of State Police fails either to approve or deny the renewal of the card within 30 days... shall toll the expiration date of the applicant's Firearm Owner's Identification Card until the Department of State Police has renewed or denied renewal of the applicant's Firearm Owner's Identification Card or until 180 days after the expiration of the applicant's Firearm Owner's Identification Card, whichever is sooner.

Someone correct me if I am wrong, but I believe state preemption means that state law governs what is legal and not local ordinances. In the case of gun laws, a local government can not enact laws more restrictive than the state laws. State sets the standard.

I may be wrong, but this is the way I understand it. I hope someone will correct me if this is incorrect. Always looking to learn.

Yes, preemption means no local government can create any law that is more intrusive than what state law is.. in other words the state runs the rules.

Preemption means local government "MAY NOT" create any law that is more intrusive than what state law. I use the words MAY NOT in place of "can" as sometimes although not permitted, they pass illegal firearm laws anyhow and wait for the state to "force them" to back down. It is similar to the way "NO GUNS" signs do not prevent persons from entering with a GUN, but depending on state they make it illegal via trespass or direct force of law.

Below is a law firm's opinion from 2011 on preemption that says preemption is not so cut-and-dry (exceptions):

Agreed there are those local governments that just don't seem to care, we have had several incidents here in PA where a local government had to be sued into complying with state law.

We have also started to see bills being introduced by state legislators that would require civil penalties when a local government is found in violation of state preemption laws (case in point the new Arizona bill I will add in my next post)
 
US HB3933 would exempt any firearm valued at $3000 or less from bankruptcy assets

NJ S993 would reduce the maximum magazine capacity to 10 rounds

NJ A2447 has no text yet but the title states 'Adds conviction of unlawfully possessing weapon to list of crimes that statutorily prohibits someone from buying or owning firearm.'

Georgia HB875 makes several changes to existing law including stopping anyone from being excluded from public housing because they own a firearm, removing bars & places of worship from prohibited places, changing the definition of a courthouse, possession on school property

This one you really need to take the time to look through, there are tons of changes in it

West Virginia SB445 clarifies current law about carrying a handgun for protection while hunting

Vermont H0706 changes language about possession on school property from 'while within a school building or on a school bus' to 'on any school property

Tennessee HB2180 would give handgun permit holders the right to pursue civil litigation if they are injured on the property of a business that prohibits firearms if the cause of the injury was the ban prevented the person from being able to defend themselves

Tennessee HB2145 is a federal law nullification bill

Tennessee HB2144 sets up preemption and would void any current local law controlling weapons

Arizona HB2517 also sets up preemption rules along with civil penalties for any political subdivision found to be in violation

Illinois SB2686 sets up a grace period when a firearm owners id card has expired and the holder can show proof of submission of a renewal application

New Mexico HR3 states 'No person carrying a firearm, except a law enforcement officer, shall be permitted to enter the house chamber, galleries, lounge, hallways or committee rooms.'

New bills submitted to IL Legislature:

Illinois HB4319 - adds multiple prohibited places to concealed carry; establishments licensed under the Video Gaming Act where alcoholic liquor is drawn, poured, mixed, or otherwise served for consumption on the premises; licensed fraternal establishment, licensed veterans establishment, or licensed truck stop establishment, as defined and licensed under the Video Gaming Act, and alcoholic liquor is not drawn, poured, mixed, or otherwise served for consumption on the premises. Finally, also provides that any person (rather than the owner) lawfully in possession and control of private real property of any type may prohibit the carrying of concealed firearms on the property (deletes under his or her control).
 
No problem, it helps to have a second set of eyes sometimes, especially early in the morning when ours aren't always working good yet! :)

I've only been tracking Illinois, specifically, to keep an eye on things for my concealed carry students - and for my own benefit so I don't get blind-sided by something. You've caught one that I missed the other day when I was doing my "morning routine", too!!!

We really do need input from people, this site is a MONSTER to handle when the laws come rolling in this fast ... and to let you in on a little 'secret' there's only two of us doing all the work (and we both also have our own businesses) so it can be overwhelming some times.

Having so many eyes looking and 'keeping us honest' really helps

Maryland HB521 would make the state a 'shall issue' state, they have been trying to get this through in this state for a long time now

Illinois HB4376 adds language to existing law regarding the transportation of firearms in a vehicle

Tennessee HB2232 would exempt honorably discharged and retired vets from certain training requirements for a handgun permit

Kentucky HCR85 would create a 'gun violence task force'

West Virginia HB4369 nullifies 'all future federal and local' laws concerning firearms

Arizona SB1266 adds 'an elected or appointed judicial officer in this state' to the list of exempted people in 13-3102 ' Misconduct involving weapons; defenses; classification; definitions'

Arizona HB2535 would amend Section 1. Title 13, chapter 31 to add section 13-3121 stating a chief law enforcement office must approve a request for certification within 15 days if the person is not prohibited (regarding NFA sign offs)

Florida H0255 would change insurance law making it illegal to discriminate against someone because they own firearms

Utah HB0301 would exempt active duty service members who currently possess a Utah CCP from 53-5-704(4)(a) 'requires permit from home state'

Rhode Island H7214 would add 'containers and storage devices designed and sold for the purpose of safe storage of firearms.' to the list of tax exempt items
